TOWN OF NANTUCKET ZONING BOARD OF APPEALS 1 EAST CHESTNUT STREET NANTUCKET, MASSACHUSETTS 02554 Assessors Map 67 Parcel 429 Lot 18 R-C-2 17 Amelia Drive Plan File No. 30-D Deed Ref. 728/65 At a Public Hearing of the Nantucket Zoning Board of Appeals, held at 1:00 P.M., Friday, April 2, 2004, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the Application of the GREY LADY NOMINEE TRUST, GREGG J. HOFFORD AND CATHERINE J. HOFFORD, TRUSTEES of PO Box 2586, Nantucket, MA 02584, Board of Appeals File No. 026-04, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-9B(2)(a)(b)(c) (light manufacturing; storage and warehousing; fabrication and assembly of component parts for off-site construction or use, respectively) to operate a carpenter's shop on his property that is situated within a mixed- use commercial-residential neighborhood. Applicants are constructing a conforming addition onto their existing storage garage structure (attached to their single-family dwelling) that would be used for his shop. A total of about 3,140 square feet of floor space would be used for the shop with the remainder to be used in conjunction with the single- family use. The uses on the site would require four parking spaces and a loading zone, all of which would be provided on site. The Locus is conforming in all other respects to the zoning requirements. The Premises is located at 17 AMELIA DRIVE, Assessor's Map 67, Parcel 429, Plan File No. 30-D, Lot 18. The property is zoned Residential-Commercial-2. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation fmding that the matter did not present any issues of planning concern. There were no letters on file in favor or opposed. There was a written statement on file from the direct abutter to the southwest, and the original owner of the subdivision, that granted permission to site a portion of the conforming loading zone to the rear of a shared driveway layout. 3. Applicant, through their representative, stated that the property was situated in a mixed-use residential-commercial area and that the Board had granted several similar Special Permits with some in the general area. The Lot currently contained a single- family dwelling with an attached storage garage behind it. Applicants now proposed to construct a conforming addition onto the existing storage garage at the rear of the property that would be used, with a portion of the existing interior garage space, in conjunction with his construction business. There would be a total, of about 3,140 square feet of interior commercial space on the first and second floors, requiring three spaces, (with one required for the dwelling unit). The remainder of the storage space would be used ancillary to the residential use. All parking and loading zone requirements would be met on site. There would be no outdoor storage of goods and materials related to the construction business. 4. Based upon the foregoing, the Board finds that the proposed use is in harmony with the general purpose and intent ofthe Zoning By-law. The Board further fmds that a grant of relief with conditions would be consistent with similar relief previously granted by this Board. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-9B(2)(a), (b) and (c), to operate the business as proposed, upon the following conditions: a. There shall be one commercial tenant in the structure; b. The improvements on the site shall be done in substantial conformance with the site plan "0402" done for "Grey Lady Nominee Trust", done by Emeritus, a reduced copy of which is marked as Exhibit A, and attached hereto, with no exterior storage related to the business on site; c. There shall be no commercial activity on Sundays; d. Hours of commercial operation shall be limited to the hours between 7:00 AM to 7:00 PM. from Monday through Friday. On Saturday the hours shall be between 8:00 AM and 6:00 PM. The Board acknowledges that there would be times after 7:00 PM and 6:00 PM, respectively, that there may be commercially related activity taking place on site, as the Applicants live on the property, but the use of any power tools is to terminate at 7:00 PM and 6:00 PM, respectively; e. When power equipment is being operated, all doors and windows in the shop area shall be closed to avoid excessive noise; and f. Any hazardous materials are to be stored and disposed of in accordance with local, state and federal regulations. 6. In separate action, by a UNANIMOUS vote, the Board approves the site plan, attached as Exhibit A, as required under Section 139-23.
