NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at
1:00 P.M., FRIDAY, APRIL 2, 2004 in the Conference Room, Town Annex Building,
37 Washington Street, Nantucket, Massachusetts, on the Application of the following:

Applicant (Gould) is seeking a MODIFICATION of a SPECIAL PERMIT issued
in the Decision in BOA File No. 040-98, that related specifically to this unit, located
within a multi-use residential-commercial structure, to allow reallocation of existing
permitted seating. The original Decision contained a signed copy of the proposed floor
plan and Applicant proposes to modify that floor plan to reallocate up to 12 interior seats
to the outdoor patio to the east in order to provide a place for smokers, due to the Town
By-law that prohibits smoking in restaurants. Applicant owns the restaurant business
known as "Cambridge Street" and is permitted for up to 83 interior seats for patrons. The
Board of Selectmen has already modified Applicant's liquor license to include the patio
area for smoking and provision of tables, but did not allow table service without relief
from the Zoning Board. Applicant is not seeking table service at this time but reserves the
right to return to the Board to seek such relief. There are two apartments on the second
floor, one of which the Applicant has control of. The structure also contains a separate
restaurant not owned by the Applicant and under several other permits issued by the
Zoning Board. This change would not impact those Decisions. There would be no
increase in the parking requirement or change in the footprint. See also BOA File Nos.

RESTAURANT LOCATED AT 12 CAMBRIDGE STREET, Assessor's Map 42.3.1,

ADDENDUM
Applicant is seeking a modification ofthe Decision issued in BOA File No. 040-98, that
related specifically to this unit, located within a multi-use residential-commercial
structure, to allow reallocation of existing permitted seating. The original Decision
contained a signed copy of the proposed floor plan and Applicant wishes to modify that
floor plan to include 12 seats on the outdoor patio to the east. Applicant owns the
restaurant business known as Cambridge Street and is permitted for up to 83 seats for
patrons. Applicant proposes to take up to 12 seats from the interior restaurant area and
place them on the patio area to the east of the structure in order to provide a place for
smokers. The Board of Selectmen has already modified Applicant's liquor license to
include the patio area for smoking and provision of tables, but did not allow table service
without relief from the Zoning Board. Applicant is not seeking table service at this time
but reserves the right to return to the Board to seek such relief. The structure immediately
located to the east is a commercial structure that is not traditionally open at night and the
Locus is situated in the middle of the downtown commercial district. There are two
apartments on the second floor, one of which the Applicant has control of. The structure
also contains a separate restaurant not owned by the Applicant and under several other
permits issued by the Zoning Board. This change would not impact those Decisions.
There would be no increase in the parking requirement or change in the footprint. The
Applicant has received approval for a six-foot gate and fence to restrict access to the
structure from the public sidewalk from the Historic District Commission in Certificate of
Appropriateness No. 43,409. Deliveries would continue to be made during the daylight
hours through the patio area. The Town Code that does not allow smoking within a
structure accessed by the public generates this request.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, April 10, 1998, at 1:00 P.M., in the
Conference Room, at the Town Offices at 37 Washington Street,
Nantucket, Massachusetts, the Board made the following decision
on the application of E.M.R.E. CORPORATION, FOR ITSELF AS OWNER
AND CATCHIT CORP., LESSEE c/o Reade & Alger Professional
Corporation, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 040-98:
2. Applicant, Catchit Corp., is seeking a MODIFICATION of
the Special Permit relief granted in Board of Appeals File No.
050-90, as previously modified in Case Nos. 034-91, 064-91, 043-
92, and 056-93, to allow for conversion of retail space to
restaurant seating area. Applicant is the tenant in restaurant
Unit NO.3 upon the Premises, which has a seating capacity of 43.
Applicant proposes to convert the adjacent retail space to
restaurant use, adding 40 seats to its existing restaurant. The
parking requirements are said not to be changed with the
conversion as the existing retail space is said to be permitted
for a total of six (6) parking spaces and the required parking
for the additional restaurant seats and three additional
employees is six (6) spaces.
In addition, and to the extent necessary, Applicant is
seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
~139-18B(2) and (3) (Parking Requirements).
The Premises is located at 7 SOUTH WATER STREET, Assessor's
Map 42.3.1, Parcel 131, Land Court Plan 8787-B, Lot D-2. The
property is zoned Residential-Commercial.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable. There were no letters of
opposition received, nor was any opposition heard at the public
hearing.
4. Applicant, through counsel, represented that it
currently operates the restaurant space allocated to Tenant No.
3, as noted in prior Board of Appeals decisions. Applicant
proposes to expand the seating for its restaurant by breaking
through an existing wall between its restaurant space and the
adjacent retail area of approximately 650 square feet, allowing
for tables and chairs to accommodate an additional 40 diners. The
area being expanded into is shown as "Retail" on the Exhibit A
attached to Baord of Appeals decision 064-91. Total seating
capacity for the restaurant use, as expanded, would be 83 seats.
No expansion of the existing food preparation area is proposed;
no take-out food will be served. The existing restaurant
entrance will continue to be used for purposes of general public
access. The premises are located within the Core District and
the Resident Parking Permit District, as shown upon the Nantucket
Parking District ~ap.
5. Based upon the materials presented at our public
hearing, the Board finds that the existing retail use (including
square footage and employees) is permitted for four (4) spaces,
not six (6), as erroneously noted in our decision in File No.
056 - 93. Applicant's proposed expansion would require two (2)
additional parking spaces, and a grant of relief would be in
harmony with the general purposes and intent of the Zoning By-
law. In addition, the Board finds that the modification to allow
the applicant's proposed conversion of the retail area to
additional seating capacity for its existing restaurant will not
be substantially more detrimental to the neighborhood than the
existing use of the premises.
6. Accordingly, by unanimous vote, the Board hereby GRANTS
the MODIFICATION to allow the expansion of the existing
restaurant use as noted above, and GRANTS a SPECIAL PERMIT
pursuant to the provisions of ~139-18B(2) (a) and (b), waiving the
requirement for two additional parking spaces, upon the following
conditions:
(a) Total seating capacity for applicant's restaurant
use shall not exceed eighty-three (83) seats.
(b) No take-out food service shall be permitted in
conjunction with applicant's restaurant use.
7. The Board also voted to approve applicant's site plan
with floor plan attached and on file with the Board of Appeals,
submitted in accordance with the provisions of ~139-23 of the
