At a Public Hearing ofthe Nantucket Zoning Board of Appeals, held at 1 :00 P.M.,
Friday, March 12, 2004, in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, on the Application of FIVE CHESTNUT STREET,
LLC, of 12 EAST 86TH STREET, SUITE 535, NYC, NY 10028, Board of Appeals File
No. 019-04, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (alteration/expansion ofa pre-existing nonconforming
structure/use). Applicant proposes to construct an about 4' x 12' second floor dormer to
expand one ofthe eight guestrooms on the southerly side of the rear of the structure. The
addition would be conforming and all work would be done within the existing footprint.
There would be no increased requirement for parking. See also BOA File Nos. 028-92,
065-01,023-02, and 058-03.
The Premises is located at 5 CHESTNUT STREET, Assessor's Map 42.3.1,
Parcel 5, Plan 48, Pages 485 and 525. The property is zoned Residential-Commercial.
2. The Decision is based upon the Application and the materials submitted with it
and the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation fmding that the matter did not present any issues of planning concern.
There were no letters on file from abutters.
3. The Applicant, through her contractor, represented that she wished to add a
conforming about 4' x 12' second floor dormer to expand one of the eight guestrooms on
the rear of the existing nonconforming multi-use commercial structure. The dormer
would be constructed on that portion of the structure used as a licensed lodging
establishment. There would be no expansion of the footprint or alteration to any of the
uses currently permitted by previous grants of Zoning Board relief. There would be no
additional parking requirement. The Nantucket Historic District Commission had already
approved the plans submitted in Certificate of Appropriateness No. 42,712.
4. Based upon the foregoing, the Board finds that the construction of a conforming
dormer addition as proposed to expand one of the eight existing guestrooms in the inn
would not be substantially more detrimental to the immediate neighborhood, especially in
the absence of any neighborhood comment, which has been part of the record in past
Applications that have concerned this property. The Board also finds that a grant of relief
in this instance would not affect the other permits related to this property and all other
relevant conditions are to remain in full force.
5. Accordingly, by a vote offour in favor (Waine, Loftin, Toole, Wiley) and one
opposed (Sevrens), the Board GRANTS the requested SPECIAL PERMIT relief under
Nantucket Zoning By-law Section 139-33A to allow the construction of a conforming
addition to expand one of eight guestrooms without increasing the number of guestrooms,
upon the following conditions:
a. The alterations/expansion of the structure shall be completed in
substantial conformance with Certificate of Appropriateness No. 42,712
issued by the Nantucket Historic District Commission, as may be
amended; and
b. There shall be no exterior construction related to this project from May 15
to October 15 of any given year.
