A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at
1:00 P.M., FRIDAY, MARCH 12,2004 in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the Application ofthe
following:

Applicant is APPEALING two separate rulings of the Nantucket Zoning
Enforcement Officer dated December 8, 2003, under Nantucket Zoning By-law Section
139-31. One notice stated that the Locus was in violation of Nantucket Zoning By-law
Section 139-20.1.B(l) due to the existence of two curb cuts. Applicant states that both
curb cuts pre-date the 1999 enactment of that particular section. The other notice denied a
request for a building permit for work upon the Locus due to the two curb cuts and
further alleges that a plumbing business was being operated from the property. Applicant
states that said plumbing business is a "home occupation" as defmed in Zoning By-law
Section 139-2 (Definitions), and outlined in Section 139-7A(4). Otherwise, the Locus is
conforming in all respects with dimensional zoning requirements.
The Premises is located at 42 SOUTH SHORE ROAD, Assessor's Map 80, Parcel
117, Plan File No. 10-A, Lot 16. The property is zoned Limited-Use-General-2.

This is an appeal under Nantucket Zoning By-law 5139-31, from two notices issued by
the Zoning Enforcement Off icer on December 16, 2003 (the date of mai ling thereot,
although both notices were dated December 8, 2003 \, copies of which are filed
herewith. One such notice is a Violation Notice, alleging that the existence of a
second "curb cut" is in violation of Zoning By-la\'J ~139-20_l.B(1), In fact, both

Dear Mr. Dussault:
This office has filed a complaint pertaining to a violation of the Nantucket Zoning Code
on ')'Our property at 42 South Shore Rd. (Map# 80, Parcel# 117). The complaint concerns
conformance with the driveway and parking provisions of S 139-20.1.
A secondary curb cut continues to be in use without the benefit of Planning Board
approval, as required in 9139-20.1 B( 1). This is the second time you have been cited for
llse of this curb cut.
You He haeby found in violation of S 139-20.1 of the Zoning Code, and are given
thil"ty (30) days to comply with the following:
. Apply for Planning Board approval of the secondary curb cut,
· Failing Planning Board approval~ the secondary drive must be
permanently closed to use.
Failure to address this notice will result in fines of up to $100.00 per each day the

Dear Mr. Dussault:
Your request for a Building permit for work at 42 South Shore Rd. {Map# 80, Parcel#
/17), has been denied for the following reason(s):
The secondary curb cut you have constructed at so-called 42A South Shore Rd. without
permit, and for which you have already been cited for by this office on May 15,2001, has
been reopened and is in use. Please see the attached "Violations Notice" for further
details.
In addition, it appears you are operating a plumbing business on your property. Such a
use is only permitted in your z.oning district under the title "Home Occupation," as
described in ~ 139-7 of the LAming Code. Home Occupations are restricted in terms of
size and intensity and a use permit is required to be issued by the Building
Commissioner. More information is needed regarding this use before approval of your
request for work can be issued.
Your application materials will be held in the Building Department, in the file for 42
South Shore Rd., and will be kept for a limited time. If you have any questions regarding
this notice please call, fax or visit.

This is an appeal under Nantucket Zoning By-law ~139-31, from two notices issued by
the Zoning Enforcement Officer on December 16, 2003 (the date of mailing chereot,
although both notices were dated December 8, 2003), copies of which are filed
herewith. One such notice is a Violation Notice, alleging that the existence of a
second "curb cut" is in violation of Zoning By-law ~ 13 9 - 2 0 . 1 _ B (1). In fact, both
driveway entrances upon the locus pre-exist t.he 1 99 adoption of ~139-20. 1. The
other notice denied a request for a building permit for work upon che locus on che
basis of (a) the alleged violation of the second driveway access and (b) the
operation of a plumbing business upon the locus. The plumbing business is operated
by the appellant, without anyon-site employees, and occupies an area of under 800
square feet in the barn upon the locus; accordingly, it is in compliance with the
provisions of ~139-7.A(4) of the Zoning By-law for customary home occupations.

Dear Me Dussault:
This office has filed a complaint pertaining to a violation of the Nantucket Zoning Code
on your property at 42 South Shore Rd. (Map# 80, Parcel# 117). The complaint concerns
conformance with the driveway and parking provisions of S 139-20.1.
A secondary curb cut continues to be in use without the benefit of Planning Board
approval, as required in S139-20.IB(l). This is the second time you have been cited for
use of this curb cut.
You are hereby found in violation of S 139-20.1 of the Zoning Code, and are given
thirty (30) days to comply with the following:
. Apply for Planning Board approval of the secondary ~urb ~ut,
. Failing Planning Board approval, the secondary drive must be
permanently closed to use.
Failure to address this notice will result in fines of up to $100,00 per each day the
violation continues, as allowed in S139-25C(1) of the Zoning Code,

Your request for a Building permit for work at 42 South Shore Rd. (Map# 80, Parcel#
/17), has been denied for the following reason(s):
The secondary curb cut you have constructed at so-called 42A South Shore Rd. without
permit, and for which you have already been cited for by this office on May 15, 2001, has
been reopened and is in use. Please see the attached "Violations Notice" for further
details.
In addition, it appears you are operating a plumbing business on your property. Such a
use is only permitted in your zoning district under the title "Home Occupation," as
described in ~ 139-7 of the Zoning Code. Home Occupations are restricted in terms of
size and intensity and a use permit is required to be issued by the Building
Commissioner. More information is needed regarding this use before approval of your
request for work can be issued.
Your application materials will be held in the Building Department, in the file for 42
South Shore Rd., and will be kept for a limited time. If you have any questions regarding
this notice please call, fax or visit.
