A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at
1:00 P.M., FRIDAY, JANUARY 9, 2004, in the Conference Room, Town Annex
Building, 3 7 Washington Street, Nantucket, Massachusetts, on the Application of the
following:
JAMES W. PIERSON AND NANCY H. PIERSON
BOARD OF APPEALS FILE NO. 003-04
Applicants are seeking relief by VARIANCE under Nantucket Zoning By-law
Sections 139-16A (Intensity regulations - front yard setback). Applicants propose to
move the existing single-family dwelling upon the Locus, constructed in 1973, to a
location in the northeasterly comer of the Lot, about 12 feet from the front yard lot line
along New Hampshire Avenue (30 feet being the minimum front yard setback in the R-2
zoning district), due to the rapid erosion of the coastal bank located along the
southwesterly portion of the Lot. The structure is presently sited as close as about 15 feet
from the front yard lot line. The structure is sited as close as about 20.5 feet from the top
of the bank. The Applicants propose no additional ground cover, but propose changes in
dormers, windows and doors within the existing configuration of the existing structure.

The applicant requests relief by Variance from the provisions of Nantucket

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, January 9, 2004, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of JAMES W. PIERSON and NANCY H.
PIERSON, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 003-04:
2. The applicants are seeking relief by VARIANCE from the
provisions of Nantucket Zoning By-law ~139-16.A (Intensity
regulations front yard setback). The applicants propose to
move the existing single-family dwelling upon the locus,
constructed in 1973, to a location in the northeasterly corner of
the locus, about 12 feet from the front yard lot line along New
Hampshire Avenue (30 feet being the minimum front yard setback in
the Residential-2 zoning district), due to the rapid erosion of
the coastal bank which runs across the southwesterly portion of
the locus. The dwelling is presently sited as close as about 15
feet from the front yard lot line, and as close as about 20.5
feet from the top of the coastal bank. The applicants propose no
additional ground cover, but propose changes in dormers, windows
and doors within the existing configuration of the structure.
The locus is situated at 30 NEW HAMPSHIRE AVENUE, MADAKET,
Assessor's Map 60.3.1, Parcels 204 to 213 (inclusive), is shown
on Land Court Plan 2408-0, Block 25, as Lots 7 to 16 (inclusive),
and is situated in a Residential-2 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was that no matters of planning concern were
presented. One letter in support was received from a neighbor,
subject to the condition that the site be properly restored after
relocation of the dwelling. Except for the presentation by the
applicants and their legal representative, there was no other
support nor opposition presented at the public hearing.
4. Applicants, through counsel, represented that the locus
is situated in an area of rapid erosion of the coastal bank,
which cuts through the southerly portion of the locus. As a
result of this erosion, the deck which surrounds the dwelling is
now at its closest point about 20.5 feet from the top of the
bank, with the dwelling itself being sited about 33.4 feet from
the top of the bank. The applicants propose to move the dwelling
to a position in the northeasterly corner of the locus, nearly as
far from the coastal bank as possible, as shown upon the Site
Plan by Nantucket Surveyors Inc. dated December 1, 2003, a
reduced copy of which is attached hereto as Exhibit A. If
relocated as proposed, the deck would be about 113 feet from the
top of the bank, with the nearest corner of the house itself
being about 127 feet from the top of the bank. The deck would be
situated about 15 feet from New Hampshire Avenue, while steps
from the deck would extend to a position about 12 feet from New
Hampshire Avenue. The dwelling would not be altered in its
footprint, but the applicant proposes changes in windows and
doors. The relocation of the dwelling had been approved by the
Nantucket Historic District Commission ("HDC") under Certificate
of Appropriateness No. 42,870, and the window and door changes
have been approved by the HDC under Certificate of
Appropriateness No. 42,915.
5. Therefore, based upon the foregoing, the Board of
Appeals accordingly, by UNANIMOUS vote, makes the finding that,
subject to the conditions herein set forth, the relocation and
alteration of the dwelling as shown upon the Exhibit A plan and
as approved by the HDC, owing to circumstances relating to the
soil conditions, shape and topography of the locus (specifically,
the proximity of the eroding coastal bank) and especially
affecting the locus but not affecting generally the zoning
district in which the locus is situated, a literal enforcement of
the provisions of the By-law would involve substantial hardship
to the applicants, and that desirable relief may be granted
without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose
of the By-law. Accordingly, by UNANIMOUS vote, the Board GRANTS
the requested relief by VARIANCE from the provisions of Nantucket
Zoning By-law s139-16.A, to permit the relocation and alteration
of the dwelling upon the locus as proposed by the applicants,
subject to the following conditions:
(a) The relocation and alterations shall be conducted
in substantial conformity with the plan attached
hereto as Exhibit A;
(b) The relocation shall be done in substantial
conformity with Certificates of Appropriateness
Nos. 42,870 and 42,915, issued by the HDC, as may
be amended; and
(c) The applicants shall, after relocation of the
dwelling, restore the surface of the ground in
such manner as to replace plant cover in the
disturbed areas and prevent the wind erosion of
sandy areas.

ADDENDUM TO APPEAL OF ROSALIE T. MALONEY
This lS an appeal under Nantucket Zoning By-law 5139-
31. A (1), from the issuance by the Zoning Enforcement Officer
("ZEO") of a letter dated November 8, 2003, purporting to deny
the application of the appellant for a change of use permit for
the conversion of certain space formerly used as a part of the
appellant's lodging house business to use as retail space. This
change of use was authorized by a Special Permit issued by this
Board of Appeals by decision issued on January 6, 1997, in File
No. 067-96, duly recorded with the Nantucket Registry of Deeds on
January 29, 1997, in Book 526, Page 314. The Special Permit was
exercised by the appellant in 1997, within the two-year period
for commencement of a substantial use of special permit relief
under By-law 5139-30.1, by the rental and occupancy of the space
described in the decision by a retail tenant in the 1997 summer
season.
The ZEO contends that the Special Permit issued In File No.
067-96 has expired, on the basis that no building permit was
applied for by the appellant during the two-year period following
its issuance. This ignores the plain language of the By-law,
which merely requires the commencement of a substantial use of
the relief. In this instance, no construction was performed by
the appellant, and accordingly no building permit was applied
for.
As a result of a letter daceG 20, 2003, from che ZEO,
which incorrectly stated that the Sgecial Permit had lapsed, the
appellant recently applied for a c of use permit to reflect
the change authorized by the Spe ial Permit, and it lS chis
application which the ZEO has purported co deny.
In addition, and without preJuG~ce to the appellant's rights
under this appeal and in further proceedings co enforce her
rights under the Special Permit and for relief against the ZEC
for his unlawful actions in this .cc'~t'=l", the:: appellant fUl"chC::L
requests the Board of Appeals to reissue the relief by Special
Permit under By-law 5139-18.B(3) (Parking Requirements) and 5139-
20. C (Loading Area Requirements), for the conversion of any or
all of the second level of the appellant's building from use as
part of the lodging house to use as a single retail
establishment.

This office has received a complaint pertaining to a violation of the Nantucket Zoning Code on
your property at 34 Center St. (Map# 42.3.1, Parccl# 120). The complaint concerns construction
without the necessary permits.
You were permitted under Zoning Board of Appeals special permit no 067-96 to convert the so-
called second level from one apartment and three guest bedrooms to aIle retail enterprise and two
rental units. Special pcnnits are good fOf two years from the date of ismancc. As no Building
Permit was obtained to do the work allowed, the special permit lapsed as of January 6, 1999, and
is no longer valid relief. The last active permit issued by the ZBA was file no. 080-95 which
allowed the conversion of the first-level (basement) to a retail use.
