Mr.~Russell then Proceeded to read extracts from thee Option of ~
'sale signed by Mr. Royal and the Board. · .~
He~ S~tated that he 'did not interpret ~the option to include the ~
Night Club~ The Chairman informed~Mr. Russell that the Board bed
no intention of~ purchasing, oEing or operating a night Clvb, that
they~did not consider the same a club, merely a portion of the
bath houses. ~ ~ -~ ~
It W~ voted ~ that ~ the hearin~ be adjourned until 2 o'clock in the

Chief Mooney 0f ~the~Police Department~ was ~p~esent and stated his

siderable debate, during which Mr.. Gardner W.' Russell,- counsel for
Mr.~Hoyal,'stated he.did not believe the'Tovm~csuld legally, pur-
chase the club, .the Board an~their~counsel did not agree with Mr.
~sselI on this po~nt.:.'~ They maintained that the sozcalled, club is
only a portion of the building; that'-it wasj~not~a club-at the time
the option 'was signed; that ithad been Operated as a .restaurant.
