I think it is to their credit they have taken ~ the step they did. It is surprising what a difference,a littl~ time will make.fSomewhere~around'19301the tenant of this~ beach was perfectly willing to pay $15,000,.to Franklin E. Smith for this beach. In a few years you understand Mr. Smiththas no interest whatever in this beach. What has ed in those few years? 'What intrigues may be in this whole controversy. Wh~ should Mr. Kimball be'suddenly interested in the common people of Nantucket..The. Sportsmen of'this tovm wanted to have access to'fish and fun on the north head of Hummock. This is on Mr. Kimball~s property. Mr. Kimball was the'first one to remonstrate when the Commonwealth wanted to lay out a road to the pond. ' ~ Mr. Kimball: I did not. want fishing and shooting on ~north'head of Hummock. and did not want shots a 6 otclock in' the morning. Question: It has been moved that the recommendations of the Finance Committee be~adopted and Article 3. Mr..A.B.Hagner: . · I am sorry to say there has to be a change made in the article. Our idea of rental and~ leasing was~so we~could get the W.P.A. to make a real first class airport in Nantucket. We now ifnd that the W.P.A. can- not spend money on a project unless it is ovmed by a munici- pality. I will have.ct deed the airport to the town so that they will have a deed to it. ~Article 4 will.have_to read, to see if~the town will accept~a.deed from Alexander B.Hagner of land which will be'actually u6ed as an airport. Then the to~m can have work done by W.P.A. proJect.~Says he will be glad to deed land to tovm if they want to'make a first class airport. ~ . Service of boats to mainland not sufficient. His district covers six New England States.Town of Hyannis voted to purchase an~airport and have'it done by a W.P.A. pro~ect. Spent $80,000. to $~0,000. for a municipal pier,but had more airplanes than boats. Maine caters to summer people. Twelve ~ airports under construction. The entire transaction was illegal. Illegal in every way..The Laws of the Commonwealth are tha~ no town shall bsy land for any purpose without~consent of legislature. There has been no consent of legislature.~In~.' · 903 there was a~law whereby the town'could acquire land of bathing beach. This law was for twooyears.only. The Finance' Committee in February said.....~ as'real purpose of proposed appropriation is to purchase.land or an interest~in land, and 'as such purchase is outside scope of article 31, we cannot~recommend this appropriation. .... The fact that they later on approva~ the transfer of funds from the reserve,whereby the Selectmen could'pay this money, does not make it lagal. We cannot pay money without act of legislature. Read a-copy of a letter ~rom Judge Poland to Atty. James E.Smith. Then read Mr.. Smith's ~nswer to ~udge Poland. From these letters Mr. Kimball.seemed ~o think that Judge Poland and Mr. Smith thought it best for t ~he Town to wait for passage.of needed legislation before tarrying out. these, reco~ enda~i~s, / .~. ~ ~ I ' Dr. Charles Congdon. The town purchased land last · ~ear to make turn of road in Siasconset. Various things ~ou can buy land for without an act of Legislature. Says he knows°matter is illegal,but the Finance Committee was willing o get sued or go to Jail for benefit of town. Judge Poland dvtsed Finance Co~.Jmittee to settle with Franklin E. Smith .and he met with Finance Committee and the Selectmen. Franklin ~.Smith had deeds to two pieces of land at bathing beach. !Judge Corbet said beach could not go th~oughLand Court until ~own got two deeAs from Franklin E.gmith. The Town got~two · ~eeds and it was put through Land Court. Have $2,000. in · raasury from rental they would not have had, and'$1,B00.~in ~mprovements. Must give FranElin E. Smith back two~ deeds and ~4500. if we fight the case.~ Have ~ot more than half our money ~ack already. Had a hearing before Finance Committee and we asked ~r. Kimball his objection to this. He had two objections,~ ~irst that it is about time_we fought Frankline E. Smith, never mind what it costs. A poor man',cannot fight, but now · he town has~pleanty, of money, letit~ftght h~m. Second,misuse~ ~f town.funds. Judge~Poland advised us to settle this case.~ '.Judge Poland said he would settle his services for whatever ~electmen thought ~ he was worth. Finance Committee met ~ith Franklin E.Smith. He.said tov~ has gone against me once, and I will fight this until ~ die. .~ ~ ~ Mr. charles Kimball:'Says Chairman~of Finance' Committee said Judge Poland recommended compromise. Says ~udge Poland in his latter to Mr. Kimball says it shoul~ be reco~ended by the Town. We could get deeds~by.a Jury trial. Co~onwealth of Massachusetts has registered land,and i£~ Franklin E.Smith thinks ha has a case he must fight.the ~' ~ettled all right.~But probabl~ it.would not come before a~ , Nantucket Jury. Muskeget case cost the town $$,000. The case at Oak Bluffs.... they tried to Sake a little piece of land ~ud did not get it,and finally went into court and tried to find out value of piece of land. ~ury assessed them $~,000.~ ~ ~r $80,000. If we have acquired this title illegally maybe~ Franklin E. Smith would get it back. Joseph McNalley spoke on beach question. ~. Mr. R°y ~anguinetti: I do not really feel that this ~ransaction was illegal just Because Judge Poland says so.~It s a part of law that a town.or city has a perfect right to~ ettle any suit when sued. A town has rights as any individual. ~here was a law suit actually pending inLand Court,and~v~..~ ~herefore~tt was within.the rights,in my opinion, of the Selecbmen )fothis tov~ to settle this suit. They did not do what they did )n their own responsibility. On your-Finance Committee you have hine upright citizens,you also have five perfectly respectable ~electmen,and if fourteen respectable men of this town,~ in every facilities for air travel. They can get back and forth for week ends;.In order, to make this field possible under W.P.A. regulations must be owned outright by town. An airport must be used for airport purposes at all times. To do this we have1 figured out on plans three runways 500 feet wide. Under W.P. A~ set-up they are willing to enter into a p'roJect'with the to;m to pay for all labor. Th~ town to pay ~or equiptment.~' You can rent some'equlptment. You have twenty-two'or more men available for this work. , · ~' Mr, Topham: If zamways are latd'0ut,as you say, will they be acceptable to Government in case of eme?gency? Mr. Law; Yes. Mrs. Chapel: If the town accepts this matter from Mr. Hagner can all fliers use this field. Mr. I~w: To make this a W.P.A. Project this air- port-must be a m~niciple airport.It must be public. Mr. Frank Ram~dell: Does Mr. Hagner intend to deed to the town entire tract or keep part in reservation. Mr. Law: Runways alone deeded to the tova~ other part kept as private property. You have to accept strips to get it done by W.P.A. project. ~Mr. Hagner. Will give town land to build a hanger. If he builds a hanger he thinks he should have it. ~ Mr. Ram~dell: Thanks Mr. HaEner. Mr~ A.L.B.Fisher: Does Mr. Hagner mean to.give land f~ee out and out to Town? '~ Mr. Hagner:~Land will be give~ to town which is to be used as an airport. There cannot be any strings attached to it~ The only reason I bought'the airport was because I bought a new airplane and have no place to put it. I will rent airport and pay taxes and no expense to the town. Mr. A.L.B.Fisher:,I think the'gentleman is very generous~ , Jack Driscoll: If and'when town let~ Mr. Hagner run airport,can any other line land there? Mr. Law: The airport znanways must be open to the Mr. Holdgate: If this air,port goes through~can~ anyone fly out of their commercially? 1.~ Mr. Law: That is ~or the.town to work out.If town gives Mr. Hagner an operating agreement,it takes maintenance expense off town. If an operator pays a commission he can fly out of the field. Mr. A.L.B.Fisher: Have the Selectmen got a cop~ of proPOSed lease they want us to accept here ,tonight? Mr. R.Backus: No lease drawn now but will be and presented at next town me~ting.~'~ Mr. Law: It is not necessary at this~time to own'~ land'to submit a~W.P.A, project. Can state that the'to~ will' own property'before any W.P.A. money is spent; In order to get this proJect.th~ough~Selectmen can submit pro~ect and.say they will own~property before funds are ex~ended.
