Motion seconded-Voted that further nominations be dispensed with. Question: Vote, Yes,for Mr. Swain as Moderator..· Article2- To redeive report~ from committees which Shal~ come before this meeting~ ...... Dr. Congdon~Chairman of F~nance Committee-;~ was away when Finance Committee's Report was ~rawn'up, so I know no~hing abou it. Said he had telephoned G~orge Jones to bring r~port. ..... The Moderator declared a'sho~t recess. . Motion made to receive report of Finance Committee. Motion adopted. ~ -. Mr. Ea~le Cook makes motion that articles be taken up in their order. Vote: Motion adopted. Dr.~Congdon: Speaks on transfers. Said he went to the Selectmen's meeting, also met with Town' Accountant and talked over carefully as to what was necessary. Met with Selectmen - on Thursday evening,left next mo~ning, at 6:45 on boat and did not retur~ until sometime after meeting of Finance Committee.. $400.00 to last until, end of year. Snow and Sand overdrawn by $~9.01. We w~nt to take care of ~verdraft. Assessors overdrawn by $200.00.~Every third year have to make a'certif~e cepy of the valuation books. This is the~ third year. That expense was not. taken care of at Town Meeting. We are not ~, ~aising money simply a transfer. Town has $8600. in excess and deficiency £un~ whic~ is available to u~ an~ ~oes not mean' increasing taxes, just means transfering from that fun~ to whatever place where it is needed. ~ Article 3- (e) To see if'the tov~ will vote-to raise and, ~ appropriate the sum of three hundred dollar~ to 01d Age Administration; ~The Finance 0ommittee recommends the sum of three hun~red~dollars be appropriated to 01~ Age Admini~tratio~ Vote- Aye, that the Finance Committees report be adopted.~ Dr.~C?ngdon- Moves that wherever the word "appropriate" appears mn Finance Committee's Report,the word "Transfer" be substituted., ~ ~,~ - , .... , ~ ~ Vote: Aye ~ Article 3- (a) To see if the town will vote to raise~and appropriate the sum of one thousand fifty dollars to the ~a~ ~epartment. - ..... ~ " ~. To pay attorney's Mr, E~rle Cook: I call attention to lavryers bill $i05 to clean up Beach Situation. Bill was to clean us up. Mr. Backus: We had a law suit on our hands and we settled it. as that is the Selectmen's privilege. ~. Mr. Kimball: Was there a deed given? . Mr. Backus: I do not'know,must ask Tov~ Council. Mr.. Mr.'Backus:~About three or foUr'weeks before this transaction took place Judge P~land appeared before Finance Committee, thought bill would go through legislature,advised us to come to settlement. · Mr. Sanguinetti: Let Mr. Gardner Russell talk instead of Mr. Eimball. Mr. Kimball: Why was me,ting secret and why were members asked not to divulge what ha~ Ltaken place? Dr. Congdon: Was notified by Selectmen they were to have a meeting with F.E.Smith to see where they stood.'Judge Corbett would not close the case for the Town until c~rtain de.eds the~ bathing beach were turned over. Wanted matter settled and something must pass between, them.~Town must have deeds or co~l~ not get title. When we found out certain circumstances and conditions we voted unanimously. F.E.Smith said you must settl~ or go to court. Judge Corbe~t said this cannot go through unt~! you get deeds to two parcels of land to bathing beach. We aske~ F.E.Smith all sorts of questions. F.E.Smith by withdrawing obi ections could put .thing through, and-the only way we could do i~ was to buy him off. Judge Corbett signed decree when two deeds came up. E.E.Smith would not leave matter open,take it n now or ~o to court. Said did not trust Town of Nantucket. Mr.I~mbEll: V~y was meeting secret? Dr. Congdon: So proposition would not ~c0me'out'and other h~irs come forth. Everything was done in ~one night. Mr. Kimball : Why was the secrecy for two~ or three days? Mr. Backus: Nothing liven out until we~got decree, Mr. Kimball~ou~d not yield~floor to any one else. Asked Judge Poland about adverse possession. · ~ Judge Poland: I did not inten~ to volunteer on this matter.' Was ~ot~consulted about this settlement. Selectmen did not seel fit to let ~e in on it. Mr. Backus said he phoned me,but I not think he did'as~I was never away from~y~phone more than a half hour a~ a time. I would have stopped it. The whole 'trans- action ~as illegal and taking from reserve fund was illegal.. Judge Corbett said Town could have had verdict by adverse ~ possession. Think we should have gone to'Jury trial. 'I did think settlemgnt advisable. I said $2000. for Mr. Smith, I did not approve $~500. for this land. "' Mr.~ Russell: Do you think Town ~can recove~ this~money. ~ · Ju~ge~Polan~: I think Mr. Smith is liable to ~ay back this $4500. I think Selectmen should institute such a pMoceeding.
