Article 31- Mt. Swain stated voters have not been
warned that land is to be purchased.
, , Mr. Sanguinette- For the past year I have lived
with the bathing beach, so mueh~so that the more I thi~k about
it the more I go around in circles. I~come back to the same point
at which I started. I would like to refresh your memory to about
a year ago at which time at the Annual Town Meeting, the.meeting
offered to leave the question'of the bathing beach entirely
in the hands of the Selectmen. About ten months ago the tenant,
or rather the lessee;of the.bathing beach flatly refused to
pay one cent of rent.'The only reason being that the land was
not owned by the Town,and that the land was.owned by Franklin
E-Smith. With these facts the Selectmen had numerous conferences,
spent days until the end of the Spring and the approach of
Summer. The lessee refused to open the place-and refused to
pay rent.
This Island in the past for years had derived its sole
source of income as a summer colony and who.can conceive a summer
colony without a bathing beach. The Members of the Finance
Committee were called in ~nd at an open disc'.-ssion of I do
not know how many hours,it was finally deemed best to accept
the offer of Mr. Franklin E.Smith to proceed with the registration
of the bathing beach for the sum of $6.000.00,at which time
$500.00 was paid, leaving a,balance of ~5,500.00.At that time your
Board of SelSctmen were confrunted.with the following situation:
1-There would be no bathing beach for the use of
the people of Nantucket.'~ 1~ ~ ~
2-Your lessee refused to pay rent. '
3-You.had the question of who owned the beach.
Unde~ these considerations and those conditions they
made their vote. At that time I thought it best rather than
g~mble with what the'costs might-be,to pay it and clear it up and
forget about it~ Since then, through, the astuteness of M~.:,~.'~3
Gardner RuSsell, who represents the respondent in the bathing
beach case,he has mangged to obtain certain'statements made in
open ouurt by Franklin E.Smith'that he never o~ned ~hyland do~m there
and that he would forget he.mmed any l~d.The situation sill
remains as it was with these additions~
I looked up an awful lot of law and the main part that
made me form my opinion that it was cheeper to pay the $6,000.00
tha~°have~a law suit with untold expenses,and if you were
unsuccessfUl a large damage suit,was the case Sf the'ToE. ,-
of Nantucket vs Mitch&ll,whtch was in Mass.Sup. Court,Vol.2?l.
This'case was in 1@92. Mr. Sanguinetti also quoted'a New Yo~k
case. He thinks it is to. the'advantage of the Town whether
right or wrong to pay the $6,000;00 ~md not be engaged in any '
litigation, which might host $75,000.00jbefore'w~'were~'thr0ugh.

Mr. Earle Cook- Said Town'leas~d bathing beach
to. Clifford Folger with the tight'to use the water.Mr..Folger
used property and rights to shore, and f6r 20 years Town' ~,, ~
collected rent.Then it was leased t6 Mr.Royal. f0r 15 years- ! i'
with privilege of renewal at $3,~00.00 per year. Used land
up to present time,guaran~A~d his rights-no one disputed our
rights. During that time we. collected over $40,000.00 from the
two tenants.After 33 years we arrive at the conclusion that
Mr. Franklin E.Smith has a'claim to the~bathtng beach. This
Franklin E.Smith is a bluff.

Mt. Gardner Russell: Said he' Was speaking as represent-
ing Leon Royal,a'tax payer-of'Nantucket.- He Came into the case
some time ago.My. Royal received-a citation from Land Court that
Mr~F.E. Smith was trying to register land in Land'C°u~t.' Said
~one half of land belonged to him~but wanted to register it'
for the Town. No one at Land Co, mt'to-represent interests'of
the Town.~Ftled'interrogatories. Mr.~Smith'tried to sell
same to Town Of Nantucket. At hearing the Judge told Mr. Smith
that petition waB'inconststent.'He~filed paper in Land Court
saying To~vn owned bathing beach. Mr. Russell could not con-
ceive of a lawyer cha~ging $6,000,00 for registering any
property on Nantucket.Feels that Mr. Smith has earned nothing
In 1922 when Hayden Bath Houses went through Land Court,at
that time the Proprietors gave.a deed to Franklin Smithof
their interest to'the F~aker property;in the deed of the
proprietors to Mm. Smith, the Proprietors ~ bounded by the Town
of Nantucket,which Mm. Smith says is his.Proprietors admitted
land was Town's. i~en Mr. smith deeded to Mr. Lowell he
boun~d by Town's land. Mrs. Dyer bounded by Town. Law of
commonwealth is such where buildings have been on property fo
more than 20 years Town holds title to tract. In 1903 when
Town bought bathing beach it carried to low water.'Seems as
if voters should pay no further money to Mr. Smith. Cannot se
what claim he has to the land, thinks it is all b~u~.

they were ~dequately paid, as the Town well knew of my owner-
ship to the same a~d I have always felt the Town should
eventually ~wn it". Asked voters if they'own&d~a piece of lan~ and
that land was bringing in a rental of~$3,300.00 would they
sell it for $6,000.00?

opinion that the buildings should remain on the land pending
