HomeMy WebLinkAbout1958-10-23Sele~tmens Meeti~g,'23 Oct. 1958 The meeting came to Order at 7.3b PM ali members of the Board being present except Mr. Blair and'Mr. Meilbye ~Min~ates of the previous'meeting wer~ read and approved. Warrant No. 43 totalling $17,451.96'was presented by_town acct~ Barrett and checked and approvedl by the Board. The Board signed the warrant for the State election on Tues 4 Nov. 1958 and set the hours for th~ polls to be ope~ as from 7 AM to 5 PM. An invitation was received from the American Legion to'attend the Veterans day services and placed on file. The Board approved the shellfish regulations for the taking of Scallops for Commercial use for'the 1958 1959 season as attachedhereto and made a part.of' these minutes. Mr' Roger King'submitted an applicationn f~r a.peddlers license from the state and the Board approved same as to his char- acter and citizenship. The application Of Clinton andi'Agnes Murray for a c~ange of location of their package goods store licenses from 29 Main street to 23 Main street having been advertised and no objections having been received was approved. An application was r~ceiv~d from ~Zlan J. R~yal for the positon of deputy shellfish warden and placed on file at this time. A letter was received f~om the State Health Dept. advising that their tests on the sewer force main pipe indicated that the probable cause of the breaks was a chemical action betwe m the sulpher bearing calking compound and the~salt water whic!t 'deterioted the strength of the' pipe. Thgy advised that the cast iron research bureau had been requested by them to look at the ~ipe sample and the states tests and see if they "could give us a recommendation as to rehabilitating the pipe and ,that they would advise. ' Tmvn counsel Sanguinetti, advised that he was in receipt of a telegram from Arty Dodge stating that the Supreme Court had refused to rule on the appeal on the authority question on the basis that their was no federal consitutional question. envolved. Gli"ddemT--sefiyj' 'B6ara Of  -i~ Selectmen SHELLFISH REGULATIONS COMMERCIAL USE For the Town of Nantucket, adopted by the Selectmen under authority delegated by the Annual Town Meeting. Section 1. No person shall take from %he waters of Nantuc- ket, Clams, Quahogs, Oysters, Eels, or Scallops, without a permit is- sued by the Selectmen as Public Welfare may require. Whoever shall take from the waters of Nantucket, Clams, Quahogs, Oy~- tots, Eels or Scallops without ~ permit issued ~by the Selectmen, or after sa~d permdt has ,been .: revoked by the Selectmen, or who- ever for the purpose of procur- ing a license falsely makes any · ' representation or statement re- ' quired shalI be .punished ,by a fine of fifty ($50.00) dollars for each offense. ' Section 2. The ,Select;men shall issue permits as directed in Ar- ticle 1~30 of %he General Laws of the Commonwealth of Massachu- setts. Section 3A. The ,Selectmen s!~all allow the tal~ing of legal scallops . for commercial purposes du~ing the period from November 1st . to March 31st, inclusive. Section 3B. ,Scallops shall be taken by hand only for family use and not over one bushel per person per week, and not for com- mercial purposes during the month of October. Section 3C. The use of dredges between the hours of Sunset ~nd Sunrise, and on Sunday, is pro- h~bited during the legal scallop '.~eason, nor shall scallops 'be taken 'on Sunday ,by hand for commer- cial purposes. ' Section 3.D. No scallops shall be taken under this permit unless they shall have a well defined raised an-' nual growth line, as provided by Section 70 of Chapter 130 of the General Laws, Annotated. '~ ~: Section 4. The use of ~o or more dredges connected together by an iron ,bar or any similar de- vice is prohibited. No dredge or dredges of freater xvidth than twenty-eight inches across the mouth will be ,permitted. Power hoisting of dredges is authorized provided no dredge is more than t~venty-eight inches wide, seven rings deep, the bar on dredge is not over eighteen mesh long and the complete dredge does not ex- ceed fifty lbs. in weight. Section 5. Not over four stand- ard bags (provided 'by the Town) of scallops shall be taken per man per day, including shells, and not over eight bags of scallops in- cluding shells shall be taken per boat per day. This limit of four and eight shall be interpreted as in- cluding scallops taken under this commercial permit and any family permit. All bags shall be tied se- cutely in such manner that the top is completely closed. Section 6. No clams, quahog, s, oysters, or scallops shall be taken by hand er otherwise from such seed areas as are now set off or closed '.by action of the Selectmen or from such areas as may be set off or closed 'by the Selectmen dur- ing the .podded these regulations remain m force. Clams must measure 2~ inches or more and quahogs must measure 2 inches or more. · - ,. Section 7A. ~ first violation of any of the sections two to six in- clusive shall be punishable by rev- ocation of license for not more than thirty (30) days from the date of the Board's act:.on revoking said license. If said penalty should carry over the end of the season, the balance of the penalty remain- lng shall be carried over and be effective in the hext scallop sea- son. / ,. ~. Section 7B..A_ second violation of any'of the sections ~vo to six inclusive shall 'be punisha`ble by revocation of license for one year from the date of the Bor. rd's action revoking said license. . Section 8. The fee for license to operate under the above regu- lations shall be $5.00. Section 9. As may seem neces- sary, and at any time, the above regulations may be altered, or new regulations put in force by the Selectmen.
