M~eting Fr.! 25 April-1958 Presnt all board members except Mr. P~ase Finance Committee. .', ,. ,~-. -- Subject: Appeal Of Mass court ruling On validity' 0'f act making it mandatory that' the authority run daily ferry type trips 'to New Bedford and construct a.ferry sllp there. ...,. ., This matter was discussed at length, it appearing that the Vineyard had already voted to participate in the cost of this appeal, the total cost was estimated at $7,500.00 by Arty Dodge who had represented the 'Authority, he had 'advised the authority~that it was not proper.for them to appeal the matter further inasmuch as they were'a.body, created by the legislature, so that the matter boiled down to either-the bondholders or the islands and the town of -' Falmouth taking this matter further. The Bondholders felt that their rights were. secured by the commonwelath and the' towns and~.that they could not expend funds for this .appeal. It was reported that Mr. Luce of the ~Vineyard County Co~m. had advised that their group had voted to participate in this appeal to the amount of $2500.00 and that it was hoped that Falmouth would alos join, but if they did not, interest on the Vineyard felt that a substantial sum could be raised by public subscription. Both the B0~rd and the Finance Committee felt'that this matter was of the greatest importance to the Town inasmuch as if no appeal was taken the 'act would immidiately go into effect upsetting the already published shedules for this yea and serioudly effecting our program for the 300th anniversay ne~t summer 1959. It was the sense of the meeting that we should participate ' :~ in this matter to the 'same extent ,as the Vineyard namely'. $2500.00 and on motion duly made and seconded it was voted by the Board to instuct the town counsel to this 'effect and have him contact Atty. Dodge on this matter. There b~ing no further business the meeting adj. at 8.30 PM after discussing various other matters of genera! interest to the'two groups, present. . . ', James K. All members of the Board present. ~ This matter, was discusoed at length, it appearing that the Boated members had information to the effect tha~t Mr. Cuttle.since submitting his bid had made a committment to manage Cliff side beach for the season his bid was not Considered. The Board discussed the bids of William Miko and Sidney Killen and had a letter at hand from Mr. A. Preston Manchester in which he advised that he had turned the specifications~he had taken over to Mr. Miko and had offered to help him in any way he could and stating by implication that he was not backing Mr.,Miko in this matter. This matter was gone over by the Board not from the amounts of money actually,envolved but from the standpoint that the Mgr. of the beach is a public eelations contact by the town with the Gen. visiting public and that it was more important that we havethe best possible person operating the beach rather than deciding the issue on the' amounts of money
