HomeMy WebLinkAbout1957-10-10:Seiectmens Meeting 10 October 1957 The meeting came to Order at 8.17 PM'as County Commissioners and later convened as Selectmen, all members being present except Mr. Hardy. Minutes of the previous meeting were read and approved. Warrant No. 41 totalling $19,824.66 was presented by Town Acct. Barrett and checked and approved by the Board. Mr. Arthur Desrocher was present and conferred with thy Board relative to the position of C.D. director and on motion made and seconded it was voted that Mr. Desrocher be app- ointed to this position. Mr. Matthew Jaeckle Supt. of streets was present and requested that a transfer of $2,000 be made.to his dept. for the ~aintenance of the Broad Creek Crossing which had been damaged by recent storms. This matter was discussed and as it appeared that our.Reserve Fund was low it was~sa- ggested that rather than request a transfer at this time the Supt. use whatever funds he had available to maintain this road and if at the end of the year because of same he found himself running short we could at that time auth- orize an overdraft. Mr. Chs. Davis, Pres. of the Sportsmans Club and Mr. Howard Jelleme reported on the use of the underwater weed cutter and ponttoon purchased by the town to cut the reeds in the ponds, they stated that while the machine worked OK it was a tremendous.job , they felt that some kind of a spray could be used to kill the cattails to better ad- vantage, this matter was disucssed and it was suggested thai the club obtain information from the manufacturers of said chemical sprays and advise the board of their findings. It Was felt that any joy of this nature should be done with a town appropriation rather than by voulenteers. Mr. Nestor Richards of the Fishermens Asso. was present and in behalf of the association requested that the Board set the fee and limits for the Commercial Scallop Season the same as last year, and it was so Voted. Mr. Merwin Blount, Harbor master conferred with the Board re- lative, to setting speed limits in the harbor, stated that~ in his opinion same were unnecessary. A leter also of the same opinion was received from Robert N. Hart, a summer resident of Cliff rd. and placed on file. The Board.approve joint pole locations on W. York Lane, notices having been sent the abutters and no one objecting. A letter_was received from the sewer Commission requesting.a transfer from the Reserve fund of $3,920.00 made necessary b¥.the-.large number of breaks-which have occurred in the , force main. This matter was referred to the Finance Committe with the suggestion that the Commissioners should take some positive action to determine the dause of these breaks with a view to some legal action if it is discovered that same are caused by a faulty product. An application was received from Emmerson Sylvaro for the positi(n of Deputy Shellfish Warden, the application of Elwyn Francis Sr. being on file. The Board discussed this matter in executJ session and Voted to table the appointment of any deputy un- til it was determined that same was actually necessary. A letter was received from Justin McCarthy Co. advising that the lengths of hose which had been returned to him had been re- paired and returned to the Dept. and was placed on file. It was voted'to check with the Supt. Of streets relative to progress being made in cutting back various hedges as requested last'summer, and also'to request 1that the hedge at the Town lot on Cliff Rd. be cut back.' REGULATIONS COMMERCIAL USE For the Town of Nantucket, adopted by the Selectmen under ,.,, .authority delegated by the Annual Town Meeting. Section 1. No pbrso~ shall t ~-enty-eight inches wide, seven rings deep, the bar on dredge is not over eighteen mesh long arkd the complete dredge does not ex- ceed fifw lbs. in xveight. Scclion 5. Not over four stand- take from the xvaters of NanCuck- et, Clams, Quahogs, Oysters, Eels, I or Scallops, ~vithout a pemnit is- sued by the Selectmen as Public Welfare may require. Whoever shall bake t~rom the waters of Nantucket, Clams, Quahogs, Oys- ters, Eels or Scallops without a permit issued by the Selectmen, or after said permi% .has been revoked by the Selectmen, or who- ever for the purpose of procur- ing a license falsely makes any repl~esentation or statement re- quired shall be punisked by fine of fifty ($50.00) dollars for each offense. ~ Section 2. The Selectme~ shall issue permits as directed in Ar- ticle 130 of the General Laxvs of the Commonwealth of .Massachu- setts. c Section 3A. The Selec~rnen shall alloxv the taking of legal scallops for commercial purposes during the period from November 1st to March 31st, inclusive. Section 3B. Scallops shall taken by hand only for family use and not over one bushel per person per week, and not. for com- mercial purposes during the month of October. ~ Section 3C. The use of .dredges. between the hours of Sunset and Sunrise, and on Sunday, is pro- 'hi~b~be,d during the legal scallop season, nor shall scallops be taker~ on Sunday by hand for commer- cial purposes. · ~ Section 3D. No scallops shall be taken under this permit unless they shall have a well defined raised an- nual groxvth line. as provided by ' Section 70 of Chapter 130 of the , General Laws, Annotated. Section 4. The use of two or more dredges ~onnected together by an iron bar or any similar de- vice is prohibited. No dredge or dredges of greater width than ~venty-eight inches across the mouth will be permit~d. Power hoisting of dredges is authorized provided no dredge is more than ard bags (proxqded by the Toxvn) of scallops shall be taken per man per day. including shells, and not ever eight bags of scallops in- cluding shells shall be taken per boat per day. This limit of four and eight shall be interpreted as in- cluding scallops taken under this commercial permit anfl any family permi.t. All bags shall be tied se- cra.ely in such manner that the top is complet)ely closed. Section 6. No clams, quahogs, oysters, or scallops shall be taken by hand or other~vise from such seed areas as are now set off or closed by action of the Selectmen or from such areas as may be set off or closed by the Selectmen dur- ing the period these re.gulations remain i,~ force. ~ Clam~ must measure 2~/~ inches or more and quahogs must measure 2 inches o.r more. '. Section 7A. A first violation of any of the sections txvo to six in- clusive shall be punishable by re- vocation of license for not more than thirty (30) days from the date of the Board's action revoking said license. If said penalty should carry over the end of the season, the balance of the penalty remain- ~ng shall be carried over and be effective in the next scallop sea- son. ~ Section 7B. A second v[o]ation of any of the sections two to slx in- clusive shall be punishable by voc~¢ion of license for one year from the date of the Board's action revoking said license. · Section 8. The fee for license ~o operate under the above regu- lations shall be $5.00. Section 9. As may seem neces- sary, and at any time. the &bore re~ulati'ons may'be altered, or new regula~Aons put in force by the Selectmen.
