SHELLFISH REGULATIONS
COMMI::RCIAL.
For the Tow~ of N'antucket, adopted by .the Selectmen under
authority delegated by the Annual Town .Meeting.
Section 1 No person shall take
from the waters of Nantucket,
Clams, Quahogs, Oysters, Eels, or
Scallops, without a permit issued
by the Selectmen as Public Wel-
fare may require. Whoever shall
take from the waters of Nantuck-
et, Clams, Quahogs, Oysters, Eels
or Scallops without a permit issued
by the Selectmen, or after said
permit has been revoked by the
Selectmen, or whoever for the pur-
pose of proeurring a license falsely
makes any representation or state-
ment required shall be punished by
a fine of fifty ($50.00) dollars for
each offense.
Section 2. The Selectmen shall
issue permits as directed in Arti-
cle 130 of the General Laws of the
Commomvealth of ~assaehusetts.
Section 3A. The Selectmen shall
allow the taking of legal seallops
for commercial purposes during
the period from November 1st to
March 81st, inclusive.
Section 3B. Seal!ops shall be
taken by hand only for family use
and not over one and one-half
bushels per person per week, and
not for commercial purposes dur-
in~ the month of October.
Section 3C. The use of dredges
be~veen the hours of ~unset and
Sunrise, and on Sunday, is prohib-
ited during the legal scallop sea-
son, nor shall scallops be taken on
Sunday by hand for commercial
purposes.
Section 4. The use of two or
more dredges connected together
by an iron bar or any similar de-
vice requiring the use of power-
hoisting devices to handle-dredge
or dredges is prohibited. No dredge
or dredges other than those hand-
led by hand or of greater width
than t~venty-eight inches across
the mouth will be permitted. No
part of the foregoing section shall
be construed to prohibit the use of
power in towing such dredges as
~peeified.
[ Section 5. Not over four stan-
i dard bags (provided by the Town)
j of scallops shall be taken per man
per day, including shells, and not
over eight'bags of scallops includ-
lng shells shall be taken per boat
per day. This limit of ~our and
eight shall be interpreted as in-
cluding scallops taken under this
commercial permit and any~family
permit. Ail bags shall be tied se-
cutely in such manner that the
top is completely closed.
Section $. No clams, quahogs,
oysters, or scallops shall be taken
by hand or otherwise from such
seed areas as are now set off or
closed by action of the Selectmen
or from such areas as may be set
off or closed by the Selectmen dur-
ing the period these regulations
remain in force. Clams must mea-
sure 2~ inches or more and qua-
hogs must measure 2 inches or
more.
Section 7A. A first violation of
any of the sections t~vo to six in-
clusive shall be punishable by re-
vocation of license for thirty (80)
days from the date of the Board's
action revoking said license. If said
thirty (30) days should carry over
the end. of the season, the balance
of the thirty (30) days shall be
carried over and be effective in
the next scallop season.
Section 7B. A second violation
of any of the sections two to six
inclusive shall be punishable by
revocation of license for one year
from the date of the Board's action
revoking said license.
Section 8. The £ee for license
to operate under the above regu-
lations shall be 155.00.
Section 9. As may seem nec-
essary, and at any time, the abo~Ye
regulations may be altered, or new
regulations put in force by the
SeIectmen.
