Board, Town Counsel Sanguinetti, M~. Har~y Schaub and M~. F~anci.
Holdgate .
The purpose of ~e meeting was to ~old~a hearing un, er Chapter
140 Sec. 157 oi' U~e Gen. Laws on ~he written complaint of
Schaub as to a dog nuisance existing at the proper~y oi' one
01ga Duce.

and that they had stated~that she did not have to come to work
as early as she did.
The Tovm counsel was ~asked if the Board could issue a limited
kennel license and he advised that we could not.
Mr. Holdgate s~ated that the idea as suggested by M~. Schaub
would only correct the condition for the summer a~d that he
lived in the ~rea all year round and was bothe~e~.
T~e Town counsel on question advised that ~nder ~he statute~
140 sec~15V we could make reasonable ~,egulations under the -
nu.~sance complaint.
Mr. Schaub and ~. Holdgate testified that~ t~e nuisance c~nsiste
of dogs of Mrs 01ga Duce barking at early hourxs ~in the morning
namely before 8AM and that because of this. the sleep and rest
of Mr. Schaub Mr. Holdgate and their friends and guests was
disturbed and that this has been going 'on for some~ttme and is
still going on.
Mr. Burgess asked ~L~. Schaub if his agreement as regards a
complaint made in the district court by Mr. Schaub, was that
he would withdraw his complaint ~if M~s Du~e would not put her
dogs out till· 8AM and take them in by ~PM. He M~ Schaub said
yes' if the board could mae this a legal
Town counsel stated Board could mak~ ~eas0nable orders.
Afte~ some furthe~ discussion it was on motion made a~d
voted: That Mrs Duce be ordered under the statute (Ch.~40Sec157
not to allow he~ dogs out of her house before 8AM in the morning
no~ to remain out after 9PM.
M~. Pease was opposed~.to this~ on the principal that Mrs~ Duce
not comply. M~. Burgess stated that ~she had promised him that
she would and further that she would allow Dr. Jones to spay
the female dog she has which is the breeder.
