14 June, 1967
The Selectmen's Meeting came to order at 8:00 P.M., all members
be{ng present.
Warrant No. 25, totaling $100,175.58, was presented by Town
Accountant Barmett and was checked and approved by theBoard.
The minutes of the previous meeting were read and approved.
Mr. Carlton West was present and stated that he had information
to the effect that certain taxi operators were charging in
excess of the rates established by the Board of Selectmen
and inquired whether or not the Board had made any recent.
changes in the regulations governing taxis as regards rates
to be charged. It was determined that no changes had been
made in the taxi rates since 1961 and the Board felt they
should go over same and bring them up to date. Mr. West
also stated that he understood a group of taxi operators
circulating a petition to have the Taxi Stand re-established
on Federal Street, and that he desired to state that if this
were approved by the Board that it should be with~the under-
standing that the public was not compelled to take the first
cab in line but could select any cab ~m operator of their
choice.
Mr. Robert Leske was present and stated he desired to bring up
the question of interference with public.rights over Dock
Street and Straight Wharf, and stated that he believed the
area was being.encroached upon, and that the matter should
be looked into by the Selectmen.
Mr. Walter Beinecke, Jr. was pres.ent and stated that sherburn
Associates had done considerable research on this matter and
felt it was an abutter's way not open to the public.
It was voted t° refer this matter to the Town Counsel for
an~opinion.
The following licenses and permits were granted and approved:
.Seddon Legg, Sr.', special police officer for duty at the
White Elephant; First National Stores,~oleo, milk and'ice
cream; Robinson's 5 & 10, permit to remain open on the 4th
of July; John Arno, common victualler and ice cream; Vincent
Arno, common victualler and recorded music; George Hatch,
Taxi Permit; Dreamland Theatre, Inc.,- sound motion pictures
for Sundays, June 25 through Sept. 3rd; John Kimmett dba The
Pines, organ and recorded music for'Sundays and weekdays;
White Elephant, piano and recorded music for weekdays and
Sundays; Harbor House, guitarist-ballad singer and recorded
music for weekdays and Sundays; Frank Burr dba The Snooty
piano and recordedcmusic for weekdays and Sundays.

An application was received from Robert Carfagnt r~qUesting a
permit for a restaurant at No. 7 India Street and same was
taken under advisement. ,~ ~ ~,~.'.- . .
Roger A. Young wrote requesting~a b~ick~sidewalk at' his'property
on Broad Street and was calling attention to the fact that
the existing cement walk was in need of some~patching. This
matter was referred to the Dept. of Public Works.
The application of Kenneth N. Pease for a permit to store gasoline
in an underground tank of 500-gallon capacity at premises on
Monomoy Road was before the Board, a public hearing having
been held this date at 10:00 A.M. and no objection having
been received. It was voted that same be approved limited
-~ to personal business use. ..
Mr, Harold Gaillard of the Opera House, ~Inc. was~present and
discussed with.the Board the various,regUlations that had
been established governing restaurants. He stated he had
not'been given sufficient notice, that he had been advised
that the second-floor dining room could not be used unless
'an additional exit and stairway was provided, and that no
cooking .or preparation of food would be allowed in an
unscreened area of~the patio. .He stated that he had used
the.upstairs~dtning room for a number of years and that he
had also prepared bmelets and salads on the patio, and he
saw no reason why this mode of operation-should now be change
This matter was discussed at some length wi h Mr. aillard,
Fire Chief Bartlett, Gas Inspector-Reed and Sanitation
Inspector Lamb and was tabled. ~Later~in the meeting~it was
voted that Mr.~Gaillard be advised that the second-floor
dining room could not be Used until he~had~provided an
exterior door with Stairway leading doWn onto his own pro'
,~ perry, proper exit signs at'the doors and an emergency light.
'That on the patio, no food preparation could~be done until
the area was properly screened. Other~than~these items,~it
was voted to approve Mr. Gaillard's~license.subject~ to.these
conditions~
There being no further business, the Board went into ~xecutive- ~-' Session and adjourned at 10:30 P.~
