Section 1.~ No. person shall take from the Waters of Nantucket, Clams, Quahogs, Oysters,, Eels, or Scallops, without a permit issued ~' '~ by the Selectmen as Public Wel- fare may require. ' ~ Section 2. The Selectmen shall' ' issue permits as directed in Article · ' 130. of the General Laws of the ~ Commonwealth of Massachusetts. .... Section 3A. The Selectmen shall ..~ ' allow the takin~ of legal, scallops ~-'for' commercial purposes during ~ the period from November 1st to · March 31st, inclusive. ~ · S~ction 3B. ,Scallops shall 'be (':' taken by hand only for family use and' not over one bushel per person . ~ per' week, and not for commercial :., purposes during the month of Oc- ..: tober. ~'~. S~ctio'n 3C. The use of dredges between the hours of Sunset and · F. Sunrise, and on Sunday, is pro- ~..hibited during the legal scallop · . season, nor shall scallops be taken ~ on' Sunday by hand for commer- {' eial punposes. ' - : ~ Section 3D. No scallops shall :~ be tmken under this ~permit unless .... they shall have a well defined · raised annual growth line, ~s pro- '.,,.' vided by Section 70 of Chapter 130 , of the General Laws, Annotated. , ,~ Section 4. T. he use of two or more dredge~ connected together by an iron bar or any similar de- vice is prohibited. No dredge or dredges of greater width than twenty-eight inches across the ~nouth will be permitted. Power hoisting of dredges is authorized provided no dredge is more than twenty-eight inches wide, seven · ings deep, the bar on dredge is not over eighteen mesh long and the complete dredge does not ex- ceed fifty lbs. in weight. Section 5. Not over four standard 1964 type bags (provided by the Town) of scallops shall be taken per man per day, including shells, 'and not over eight standard 1964 .. · type bags of scallops including · .shells shall be taken per boat per ";'. . day. This limit of four and eight shall be interpreted as including scallops taken under this commer- cial permit and any family permit. Bags will nor have to be tied at the t~p bfit may be filled even (not crowned) :with the top of the bag.. Section 6. No clams, quahbgs oysters, or scallops shall be taken by hand or otherwise from such seed areas as are now set off or closed by action of the Selectmen or from such areas as may be set off or closed by the 'Se~etmen during the period these regula- tions remain in 2oree. Clam~ must ' measure 2~ inches or moire and quahogs must measure 2 inches or. more. Section 7A. A first violation of any of the sections two to six in- ;-, clusive shall be punishable by re-. vocation of license for not more, than thirty (30) days from the date of the Board's action .revok- ing said license. If said penalty should carry over the end of the season, the balance o£ the penalty remaininl~ shall be carried over and be effective in the next scallop season. Section 7B. 'A second violation of any of the sections two to six inclusive shall be punishable by revocation of license for one year -' from the date of the Board's ac- tion revoking said. license. ~ .. Section 8. The fee for license to operate under the above regu- lations shall be $5.00. Section 9. As may seem neces- sary, and at any time, the above regulations may be altered, or new regulations put in force by the .. Selectmen.
