Dear Sir-
Upon request of Clifford Tnrner who is handling Al Silvas
aooounts I am enolosing bill for repair work done last summer on dis-
triots nurse oar as a result of aocident ooourring at junction of Iul-
berry and Union street
This bill was sent Miss Platt but she refused to plaoe same
before the board of seleotmen olaiming she was not at fault !bether or 1
not this is 80 has no bearing on this bill as the wor~ was done and 1s
payable by the town and not Miss Platt
To turthur enlighten your board of seleotmen, the aocident was
in August with a oar insured thru this agenoy belong to Anna Ca1lwits
I had an adjuster come down to see lHss Platt but she assumed the idea
that she was entitled to a sum of money that exceeded all reason
Therefore we oould not obtain a release from the town for the enclosed
Rlatt was unwilling to sign off.

At the present time Miss Platt has served notice of a law suit in
the amount of two thousand dollars, upon what ground this is based is
bard to state possibly shaterred nerves or nerve
Regardless of her aotion in this oase it appears reasonable that the
enolosed bill is direoted against the town and in view of her refusal
to inolude same in her requesitions, we ask your board to take the
matter up with the aooouatant as respeots payment of this bill.

Gentlemen
I am requested to give an opini0n regard-
ing Articles 3, 6 and 7 contained in the ~a~~an+ nf
the special town meeti~g callen for December 22, 1933,
and respectfully submit the following
First Article 3 - this relates to authority
to Selectmen to sell the Dronerty theTein des~gnated,
for the sum of $17,500 00

In ~eference therrto I quote the following
"A to'l"'1. may rold 'teal esta"- e for the public use", e +c
"ann may convey the samp by a deed of its Selectmen
duly authorized 0'1' by a deed of a committee or agent
thereto duly authorized' General Laws,Chapter 40,

This clearly gives the Town the ryower to
authorize the sale by its SelectMen, who, if a vote js
C&TTied, and the Federal government assente to the
purchase, B~ould give de~d in the corporate name of the
Town and execute the same ~n the manner as ~s usually
done by any corporation in salee of real estate
A cruestion ~h1ch may arise is whether if vote
is carried a Board of Selectmen elected hereafter could
act undPT the vote In my opinion the vote as it stands
would only apply to the preeent boar d during ~ t s uresent
term of office
As far as ezecution of deeds is conoerned by
Selectmen,I am of the opinion t~atthe powe l' to sell
authorizes the Selectmen to use all means essential
to make a pTopeT conveyanoe

I Bee no objeotion to the form of the vote
As it authorizes the sale of the whole 01' part fOT the
same gum the +O~ _~ n~+ in1u~pn if nnly ~ ~~rt is sold
Second Article 6 - I see no obejction to
this article ~Toviding, of course, that all the laws
relating to applying funds for sewer uurposes are com-
plied with and providing the town is able to obtain fTom
the admin1stration the loa~ desired
Third, Article 7 This refers to author1zing
Selectmen to take immectiate act10n to cut an opening
through the beach, etc
As far aR concerns th1s article, I have no
cr1.ticism ezcept that part t')f it ?'hich says 1I10cat ion
+0 be approved by Upi'ted states engineers II I do !'lot
unQerstand whether this means in their official capaci-
ty as ag~nts of the United States government or vhether
it is to be auproved by tpem as experts As I understand
the law the Un1~ed States government 1.6 interested in the
~aters of the State only to the extent co~cerning 1nter-
state and foreign ~v1gation Therefore unless the
waters effected by the ouening in the beach would 1nter-
feTe in any way with either interstate or foreign nav1.ga-
tion, I am of the opinion the ~ited stateq government
has no interept i~ the matter ,on the othPT hand if the
opinion of an expert or experts is necessa:y I pTesume
the Town has a Tight to employ the same
Also to be considered 18 the question of publ1.c
and urivate ~ights in the beach As to pub11C rights I
understand that the State claims no interest in this
matter Therefore the queqtion is reduced to private
ownership and the extent to which it is effected by o-her
portions of the uublic If the town owns the part of the
beach in question it may make any improvements it de-
sires between hiGh and 101'1 wat er mark as~um1ng the ""al"ke

and land, n that is it does not isolate the neighbor's
land sO that he would not be able to get to it Of
course if the beach is owned by a private owner the
town would have to proceed in the usual manner in which
private rights are concerned If the rights of a
private o~mer are interfered with otherwise, those
taking part in said interference would be llatae and
if they were agents of the town as distinguished from
public officers the town itself if it bad authorized
their acts would probably be liable
As far as a committee of four being appointed
I am of the opinion that the town has the ryower to
aupoint said co~mittee provlded it is for a purpose
w~ich dops not come within the powers of the Selectmen
As a practical matter the Selectmen should be able
to take all steps necessary to accomplish the object
uesired, but the questlon is for the Town to decide
