Dear Sir- Upon request of Clifford Tnrner who is handling Al Silvas aooounts I am enolosing bill for repair work done last summer on dis- triots nurse oar as a result of aocident ooourring at junction of Iul- berry and Union street This bill was sent Miss Platt but she refused to plaoe same before the board of seleotmen olaiming she was not at fault !bether or 1 not this is 80 has no bearing on this bill as the wor~ was done and 1s payable by the town and not Miss Platt To turthur enlighten your board of seleotmen, the aocident was in August with a oar insured thru this agenoy belong to Anna Ca1lwits I had an adjuster come down to see lHss Platt but she assumed the idea that she was entitled to a sum of money that exceeded all reason Therefore we oould not obtain a release from the town for the enclosed Rlatt was unwilling to sign off. JJ.as-evh Q! ~,enn.ev 20 MERCH NTS e BL NEW BEDF"ORD MASS Dece~ber al, 1933 I I J Board of Selectmen, J -"S- I does not cut off ltS ne1ghbo~s access to hiSJhouse and land, n that is it does not isolate the neighbor's land sO that he would not be able to get to it Of course if the beach is owned by a private owner the town would have to proceed in the usual manner in which private rights are concerned If the rights of a private o~mer are interfered with otherwise, those taking part in said interference would be llatae and if they were agents of the town as distinguished from public officers the town itself if it bad authorized their acts would probably be liable As far as a committee of four being appointed I am of the opinion that the town has the ryower to aupoint said co~mittee provlded it is for a purpose w~ich dops not come within the powers of the Selectmen As a practical matter the Selectmen should be able to take all steps necessary to accomplish the object uesired, but the questlon is for the Town to decide Resnectfully submltted, JDK/B I ~"1l.3) '\ .....- I' .
