be taken pursuant to Nantucket Zoning Bylaw Section 139-29.C. (3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139-29.C. (6)

DECISION:
1. Upon review of the Application submitted by the Applicants, BACK 41 LLC (105 Tom
Nevers Road) and 4170 AND DOWN LLC and TELLIE LLC (107 Tom Nevers
Road), the Zoning Administrator determined, pursuant to Nantucket Zoning By-Law (the
"By-law") §139-33.A(3), that the alteration to the pre-existing nonconforming lots will not
increase the nonconformity (lot size) and will not create any new nonconformities. The
Zoning Administrator further deteuiiined that the alteration to the lots will not be
substantially more detrimental to the neighborhood than the existing nonconformity (lot
size).
2. The Applicants propose to alter the pre-existing nonconforming lots by creating Parcel A
within Lot 653 to be conveyed to and combined with Lot 652 and by creating Parcel B
within Lot 652 to conveyed to and combined with Lot 653. Both conveyance parcels total
approximately 1,373.66 square feet of area.
3. Existing and proposed conditions are shown on plans entitled "Plot Plan of 105 and 107
Tom Nevers Rd. in Nantucket. Massachusetts" prepared by Earle & Sullivan; Inc. dated
May 28, 2021 and attached herewith as "Exhibit A . Lot 653 contains approximately
25,700 square feet of area and Lot 652 contains approximately 22,400 square feet of area in
the Limited Use General 3 (LUG-3) district where a minimum lot size of 120.000 square
feet is required. Lot 653 has approximately 50 feet of frontage and Lot 652 has
approximately 200 feet of frontage where required frontage is 150 feet. Both lots currently
meet and will continue to meet the Regularity Factor requirement.
4. Based upon the above-referenced information and the existing and proposed conditions site
plan, the Zoning Administrator finds that the alteration to the pre-existing nonconforming
lots will not increase the nonconformity (lot area) and will not create any new
nonconfoiniities. The Zoning Administrator further determined that the alteration to the
lots will not be substantially more detrimental to the neighborhood than the existing
nonconformity.

5. This approval is subject to the following condition:
a. The proposed lot alterations shall be performed in substantial compliance with the
plans attached herewith as "Exhibit A".
