DECISION:
1. Upon review of the Application submitted by the Applicant, JENNIFER FRAKER, the
Zoning Administrator determined, pursuant to Nantucket Zoning By-Law (the "By-law-)
§139-33.A(1)(b), that the proposed extension, alteration, and change to the pre-existing.
nonconforming structure lot will not increase the nonconforming nature of the structure and
will not create any new nonconformities.
2. The Applicant proposes to alter the pre-existing nonconforming structure by completing
alterations to the existing structure within the confines of the existing foundation.
Alternations include: removal of an entry deck, changes to the setback compliant decks on
the north side of the structure, creation of a 1.5 story mass on the north "wing" of the
structure, installation of dormers on the south "wing' of the structure. and alterations to the
portion of the roof connecting the north and south "wings".
3. Existing and Proposed conditions are shown on plans dated August 11. 2021. prepared by
gryphon architects, reduced copies of which are attached herewith as "Exhibit A" and
"Exhibit B". As shown thereon, Locus contains approximately 6.000 square feet in the
Village Residential (VR) district where a minimum lot size of 20.000 square feet is
required. The lot has 80 feet of frontage where required frontage is 100 feet.
4. The 1960's structure is validly pre-existing nonconforming as to setbacks. The structure
intrudes into the front yard setback, with the structure sited approximately 16.4 feet from
the lot line, where the minimum front yard setback in VR is 20 feet. The structure has an
existing ground cover of 1,400 square feet and the proposed changes will not result in an
increase.
5. Based upon the above-referenced information and the proposed conditions site plan. the
Zoning Administrator finds that the proposed work will not increase the nonconforming
nature of the structure upon the Locus and will not create any new nonconformities and
hereby issues the permit as requested.
6. This approval is subject to the following condition:
a. The proposed alterations shall be performed in substantial compliance with the
proposed conditions plan attached herewith as "Exhibit B".
