Upon review of the Application submitted by the Applicant. EUGENE H CLAPP, III, TRUSTEE OF THE 42 CLIFF ROAD NOMINEE TRUST, the Zoning Administrator determined, pursuant to Nantucket Zoning By-Law (the "By-law") §139-33.A(1)(b), that the proposed extension, alteration, and change to the pre-existing. nonconforming structure lot will not increase the nonconforming nature of the structure and will not create any new nonconformities. 2. The Applicant proposes to alter the pre-existing nonconforming structure by extending the rear/side line of the dwelling, which lies approximately 3.8 feet from the rear/side lot line where the minimum rear/side yard setback is 5 feet. Exterior stairs and areaway will be constructed adjacent to the addition, also not being less than approximately 3.8 feet from the lot line. The structure is also nonconforming as to the southeasterly side yard setback. being 2.7 feet from the lot line where 5 feet is required. No changes are proposed that portion of the structure. 3. Both Proposed and Existing conditions are shown on plan dated July 2, 2021. prepared by Bracken Engineering, Inc., a reduced copy of which is attached herewith as "Exhibit A". As shown thereon, Locus contains approximately 2.977 square feet in the Residential Old Historic (ROH) district where minimum lot size is 5,000 sq. ft. The lot has 17.33 feet of frontage where required frontage is 50 feet. 4. The historic structure is a validly pre-existing, nonconforming structure as to setbacks. The structure intrudes into the southeasterly side yard setback, being sited as close as 2.7 feet from side yard lot line. Also, the structure intrudes into the southwesterly rear/side yard setback, being sited as close as 3.8 feet from rear/side yard lot line. The minimum side and rear yard setback in ROH is 5 feet. The structure has an existing ground cover of 21% and the proposed changes will result in an increase to 25.3%. where 40% is allowed. 5. Based upon the above-referenced information and the proposed conditions site plan. the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the structure upon the Locus and will not create any new nonconformities and hereby issues the permit as requested. 6. This approval is subject to the following condition: a.
