Upon review of the Application submitted by the Applicant, HUGH O. DAVIS, the Zoning Administrator determined, pursuant to Nantucket Zoning By-Law (the "By-law") §139-33.A(1)(b), that the proposed extension, alteration, and change to the pre-existing, nonconforming structure lot will not increase the nonconforming nature of the structure and will not create any new nonconformities. 2. The Applicant proposes to alter the pre-existing nonconforming structure by removing approximately 42.8 square feet from the southeast portion of the rear of the structure and by adding approximately 40.1 square feet to the southwest portion of the rear of the structure. The addition as proposed will be no closer to the westerly lot line than the existing structure. The proposed alterations have been granted Historic District Commission approval by virtue of Certificate of Appropriateness No. HDC 2021-05-3721. 3. Both Proposed and Existing conditions are shown on plan dated July 19, 2021, prepared by Michael Connelly & Associates, Inc., a reduced copy of which is attached herewith as "Exhibit A". As shown thereon, Locus contains approximately 6,357 square feet in the Residential Old Historic District where minimum lot size is 5,000 sq. ft. The lot has 41.82 feet of frontage where required frontage is fifty (50) feet. 4. The historic dwelling, said to have been built circa 1820, is a validly pre-existing, nonconforming structure as to setbacks. The structure intrudes into the westerly side yard setback, being sited as close as 1.0 feet from the westerly side yard lot line. The minimum side and rear yard setback in ROH is five (5) feet. The structure has an existing ground cover 1,922 square feet and the proposal will result in a reduction to 1,919 square feet. The site, which also contains a studio and an additional dwelling, has a pre-existing nonconforming ground cover of approximately 2,597 sq. ft. for a ground cover ratio of 40.8%where maximum ground cover allowed is 40%. 5. Based upon the above-referenced information and the proposed conditions site plan, the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the structure upon the Locus and will not create any new nonconformities and hereby issues the peiuuit as requested. 2 6. This approval is subject to the following condition: a.
