Gasbarro,Vice Chair Anthony G.Bouscaren Andrea N.Planzer Jeanette D.Topham AIRPORT COMMISSION MEETING September 8,2020 The meeting was called to order at 5:00 pm by Chairman Daniel Drake with the following Commissioners present: Jeanette Topham, Arthur Gasbarro, Andrea Planzer and Anthony Bouscaren. This meeting was conducted remotely by video conference via Zoom app and broadcasted on the Town of Nantucket YouTube Channel consistent with Governor Baker's Executive Order of March 12, 2020, due to the current State of Emergency in the Commonwealth and due to the outbreak of the"COVID-19 Virus". Airport employees present were: Tom Rafter, Airport Manager, Noah Karberg, Assistant Airport Manager, Katy Perales, Office Manager and Lillian Sylvia, Administrative Assistant. Also present was: Rich Lasdin, McFarland Johnson, Inc., Georgie Nugent, McFarland Johnson, Inc., Jim Soukup, Weston Solutions Inc.,Lisa Kammer, Weston Solutions Inc. and Dave Mackey, Anderson and Krieger. Mr. Drake read the Town's virtual meeting statement. Mr. Drake announced the meeting was being audio and video recorded. Mr. Drake asked for comments on the Agenda; hearing none,the Agenda was adopted. Mr. Gasbarro made a Motion to approve the 7/16/20, 7/29/20 and 8/11/20 draft minutes. Second by Mr. Bouscaren and Passed by the following roll call vote: Mr. Bouscaren-Aye Ms. Topham-Aye Ms. Planzer- Aye Mr. Gasbarro-Aye Mr. Drake-Aye Ms. Topham made a Motion to ratify the 8/19/20 Warrants. Second by Ms. Planzer and Passed by the following roll call vote: Mr. Bouscaren-Aye Ms. Topham-Aye Ms. Planzer-Aye Mr. Gasbarro-Aye Mr.Drake-Aye Mr.Walsh Supplement-to July 2,2029 No Trespass Order-Mr.Drake noted that it was decided to give Robert Walsh an opportunity to come before the Commission to discuss that order. When he was invited to attend this meeting, Mr. Walsh asked that his appearance be delayed to the October Commission meeting. Pending Leases/Contracts—Mr.Rafter presented for approval the following contracts: • CHA Consulting Inc.- Contract in the amount of$75,000 for the Fuel Farm Upgrades project for Owners Project Manager services. • ArchetypeSC- Contract in the amount of $51,300 for A2 Analytics development and support for a data collection program from terminal areas. This is a three-year contract. + McFarland Johnson Inc.-Task order MJ-PN-03 in the amount of$47,710 for continued PFAS Management and Mitigation Assistance for thetesting for ppssible PFAS leakage from the Airport Gas leasehold.investigation. + McFarland Johnson, Inc.- Task Order MJ-PN-04 in the amount of $525,743 for continued PFAS Management and Mitigation Assistance for the Nobadeer way study area. + McFarland Johnson, Inc.- Task Order MJ-EN-01 in the amount of $268,303 for continued PFAS Management and Mitigation Assistance for design, permitting and bid documents for the water line extension. The last two McFarland Johnson Inc. contracts as shown on Exhibit 1, task order MJ-PN-04 and task order MJ-EN-01 will be further discussed and voted on later in the agenda. Mr.Bouscaren made a Motion to approve the contract with CHA Consulting Inc.,the contract with ArchetypeSC and Task order MJ-PN-03 with McFarland Johnson Inc. Second by Mr. Planzer and Passed by the following roll call vote- Mr. Bouscaren-Aye Ms. Topham-Aye Ms.Planzer-Aye Mr. Gasbarro-Aye Mr.Drake-Aye Pending Matters—Mr. Rafter reported on: + 091019-01 Capital Approval Process/Home Rule Petition-Mr. Rafter reported that Article 94 in the warrant was passed at Annual Town Meeting(ATM). Will verify with the town clerk if it is has been sent to the Legislative Representatives. Provided Rich Atherton,member of the Government Study Committee with an update on the status and next steps. 071420-03 Per-an polyfluoroalkyl substances(PFAS)Investigation Update-Rich Lasdin, McFarland Johnson Inc.,reviewed a PFAS Investigation Status Report presentation,which provided an update on Madequecham Valley Road, West of Airport Properties,Nobadeer Way Study area,the next steps, as well as three different maps. Commissioners Comments: Ms. Planzer asked how many houses are going to be tested on Nobadeer Way. Mr. Lasdin explained that the original plan was to test twenty-two(22)homes,but they have discovered that seven(7)of these homes are already on town water,so they will not be tested. 9/8/20 Airport Commission Meeting Page 2 of 7 { Ms. Topham asked what the response has been on the Point of Entry Treatment(POET)systems that have already been installed in some homes. Lisa Kammer, Weston Solutions Inc., explained that there are some situations where an unknown source of PFAS is being detected in some of the POET systems,but that the systems are acting as they should at the other locations. There has only been one complaint regarding the decrease in the flow of water. Ms. Kammer explained that overall there have not been many complaints. Mr. Gasbarro wanted to clarify that the contract for Nobadeer Way area included hooking up those houses to town water.Mr. Lasdin explained that the water line design contract includes adding a branch line down Nobadeer Way.Mr. Lasdin also explained that a meeting is scheduled with Mark Willet,Wannacomet Water Company,to discuss if he will need assistance from the Airport to make sure these houses are able to be hooked up to town water or if it's something the water company can complete on their own. Mr. Gasbarro asked if the proposed water line for Madequecham Valley would service other houses, such as those on Monahansett that have already been tested and meet exceedances.Mr. Lasdin explained that yes, if homes are found to need town water on Monahansett,a branch line would continue up Monahansett. Mr. Lasdin explained that the scope also includes the intersection of Evergreen Way and Nobadeer Way.Mr. Lasdin explained that the intent is to connect all households that need to be on town water as soon as possible, subject to the reolution that there has been challenges on Madequecham Valley road with right-of-way and environmental issues. Mr.Lasdin explained that the water line could be designed and installed in segments if necessary. Mr. Drake asked how long permitting would take for the waterline on Madequecham Valley Road. Mr. Lasdin explained that the permitting agencies estimate four to six months once an application is submitted. Ms. Planzer made a Motion to approve Task Order MJ-PN-04 with McFarland Johnson, Inc. in the amount of$525,743 for the Nobadeer way study area and Task Order MJ-EN-04 in the amount of$263,303 for the water line extension design,permitting and bid documents. Second by Mr.Bouscaren and Passed by the following roll call vote: Mr. Bouscaren-Aye Ms. Topham-Aye Ms. Planzer-Aye Mr. Gasbarro-Aye Mr. Drake-Aye Public Comment- Nicole Gross, at 8 Evergreen Way, asked when homes will be notified that are on the list to be tested.Ms. Kammer explained that homes have just been identified that will be included in that step out group and are working on notifications now.Notifications should go out within the next couple of days with the timing for the next sampling event. 9/8/20 Airport Commission Meeting Page 3 of 7 Finance-Mr. Rafter reported on: 071420-4 Lease Payment Abatement/Deferment Discussion-Continuing discussion with Crosswinds Restaurant operator and reviewing potential rent abatement or deferment associated with the COVID-19 pandemic. The Airport has submitted a proposal for Crosswinds to review and is waiting for response. 090820-1 4th Quarter Report FY20-Mr. Rafter reported revenuewas above budget but was down 5% over last year. Expenses were below budget and down 3%over last year.Mr. Rafter said the summary document prepared by the Town Finance Department did not reflect a budget transfer to operations, capital expense transfers and the initial PFAS mitigation from retained earnings. He estimated that net retained earnings at year end FY 2020 would be about $2,000,000. Manager's Report Project Updates—Mr. Rafter reported: • CIP Meeting- Meeting took place on August 28, 2020 with FAA and MassDOT. Mr. Rafter reviewed the Capital Improvements Plan(CIP)and the Capital Request handout. Mr. Gasbarro asked if this was a draft. Mr. Rafter explained that this is a draft that will be presented to Cap Comm for feedback and brought back to the October Commission meeting for Endorsement. Mr. Gasbarro commented on some missing points and mitigation for the South Apron Expansion and Ground Power Units(GPU). Mr. Rafter explained that the berm and other points that Mr.Gasbarro touched on are included in the projected overall cost for the South Apron. Mr. Drake asked Mr. Gasbarro to create a list of his concerns so that there is a record. + Security Project Phase I-Two TSA tests were performed,passing the first and failing the second. The situation was rectified immediately with the contractor and TSA is satisfied with the resolution. + Security Project Phase II-Waiting MassDOT approval for contract. • EA/EIS-Draft to be submitted in October and final expected for January 2021. + Fuel Farm Rehabilitation- Filed Sub-bids due September 24, 2020 and General Contracting bids are due October 1,2020. + Taxiway E-Held a preconstruction meeting on September 2nd.Lawrence Lynch will begin storing material on airport property. A gate has been installed along Monahansett road at the South end of the apron.The laydown area has been identified and looking into potential other locations for transplanting some plants that need to be moved.Weston Solutions Inc. will be conducting PFAS testing on soil. Construction to begin on September 14th. + Drainage Plan-Field work has been completed and anticipate a report shortly. + ALP Geometry- Need to add items to the draft scope and then will schedule a meeting with FAA to review. • Watermain Installation- McFarland Johnson, Inc., Wannacomet Water Company and Mr. Karberg performed a site visit and developed a conceptual layout for the waterline. Town council is reviewing the agreement that was developed by Anderson and Krieger. RFP/IFB Bid Status—Mr.Rafter reported on: 9/8/20 Airport Commission Meeting Page 4 of 7 + Request for Expression of Interest-Hangar Development-Legal has developed a draft lease for review. + Fuel Farm Rehabilitation- Information for Bids (IFB) went out September 3`d and filed sub-bids are due September 24, 2020 and General Contracting bids are due October 1, 2020. + POET Systems-Had discussion with Town Finance on how to move forward with POET installations. + Bunker Road Land-Working on Request for Proposal(RFP)for additional land located on Bunker Road due to interest.Will be conducting a survey and appraisal of the land.Met with the PLUS department on a GIS resolution. + Car Rental Agreements- Leases expire December 31, 2020. Developing an RFP for car rental services. Operations—Mr. Rafter reported: + Fuel sales were down 27% or $865,432. Commercial service made up 13% of total Jet Gallons sold in July and 14% in August of this year. + Labor Day weekend sales were down 44% or$282,000. '* Safety Action Plan for upcoming projects and looked at ways to improve safety and working closely with the Tower. + Working with legal on a response for the Part 13 complaint filed by Mr. Walsh as well as the Hertz Bankruptcy. + Southern Airways started new service to New Bedford on September 3`1. Representatives from New Bedford Chamber of Commerce and their town council flew in and were greeted by Nantucket Business Representatives. + FAA Certification Inspection has been postponed till further notice. Statistics—Mr. Rafter reviewed the July 2020 statistics: Mr. Rafter noted that because of the reduced hours in the Air Traffic Control Tower statistics may not be completely comparable to previous years. + Operations are down 44.31%from July 2019. • Enplanements are down 65.96%from July 2019. + Jet A Gallons are down 14.22%from July 2019. + Jet A Gallons are down 19.66%from August 2019. AvGas Gallons are down 34.51%from July 2019. • AvGas Gallons are down 30.66%from August 2019. + Freight is up 8.31%from July 2019. + 44 Noise complaints were filed for July 2020 compared to 57 in July 2019. Personnel Report-Mr. Rafter reported: + Received resignation from the FBO Supervisor and a Customer Service Representative in the FBO. Working on replacing those positions. + The National Airports Conference in Savannah, GA has been converted to a virtual conference, rendering void,the previously approved travel request for Mr.Rafter to attend in person. Commissioners Comments- Mr. Drake commented and thanked Airport staff for working through the large workload with the added difficulty of the COVID-19 Pandemic. 9/8/20 Airport Commission Meeting Page 5 of 7 Public Comment- None. Having no further business for Open Session, Ms. Topham made a Motion to go into Executive Session,under G.L. Chapter 30A, Section 21A,not to return to Open Session,to review Executive Session Minutes as enumerated on the Agenda; Clause 3: To discuss strategy with respect to the litigation regarding the Gatto claim,where the Chair has determined that an open session may have detrimental effect on the litigating position of the Airport Commission.; Clause 3: To discuss strategy with respect to the litigation regarding Walsh,where the Chair has determined that an open session may have detrimental effect on the litigating position of the Airport Commission; Clause 3: To Discuss Strategy with Respect to Pursuing Legal Claims against Manufacturer of Polyfluoroalkyl Substances (PFAS), where the Chair has Determined that an Open Meeting May have a Detrimental Effect on the Litigating Position of the Airport Commission.
