Assessor' s Map 79, Parcels 112 and 147
The Applicants seek a Special Permit under Nantucket Zoning By-
law (the "By-law") §§139-30 and 33 .A(1) (a) to alter, change, and
extend a preexisting nonconforming lot. In the alternative, the
Applicants seek a Variance or the modification of an existing
Variance under By-law §139-32 .
The Locus, Lot 2 on Land Court Plan No. 39913-A, is located in a
Limited Use 1 ("LUG-1") zoning district, which requires minimum
lot area of 40, 000 square feet and minimum frontage of 100 feet.
The Locus has been owned by the MacKay family since 1980. It
contains about 40, 000 square feet of land area and has frontage on
Monohansett Road of about 175 feet. It was originally a pre-
existing, nonconforming lot of record that became conforming as to
lot area and frontage when the zoning district that it is in was
changed from Limited Use 2 ("LUG-2") to Limited Use 1 ("LUG-1") in
2017 .
The Locus is improved by a primary and a secondary dwelling. The
primary dwelling was constructed by Peter and Allison MacKay
("Peter & Allison") in 1986, and the secondary dwelling was
constructed by David MacKay ("David & Anne") in 1989 and was the
subject of the variance in 1989, registered with Nantucket Registry
District as Document No. 48473 (the "Variance") that provided
relief from the required twelve-foot scalar separation between the
two dwellings .
Peter & Allison and David & Anne have resided in their respective
dwellings since they were constructed as their principal
residences and throughout this time have treated the dwellings
separately and for all intents and purposes as separate lots and
structures, and not as primary and secondary structures. Each
dwelling is served by its own driveway, a condition that is
preexisting nonconforming under the By-law. Both couples have
children for whom they hope to provide, and owning their homes
together is creating significant issues, unintended consequences,
and financial hardship for them. As a result, they would like to
separate out their properties for estate planning and other
purposes .
The Applicants recently acquired an adjacent, preexisting lot of
record that contains about 2, 500 square feet of land area and has
frontage of about 25 feet on Monohansett Road.
To accomplish their proposal, the Applicants seek a special permit
or, in the alternative, a variance or modification to the existing
variance to alter and extend the preexisting nonconforming lot to
encompass one of the dwellings and to subdivide the property into
two nonconforming lots of approximately equal land area, each
containing a dwelling. No additional dwellings are proposed, and
the Applicants propose to permanently restrict each lot to one
dwelling and no additional ground cover above that which would be
allowed now by right. In the alternative, the Applicants propose
relief to allow them to create a two-unit condominium or
cooperative. As precedent for their request, the Applicants cite
the relief granted by the Board in File No. 30-10, a copy of which
is attached. Given the use of the Locus over the past thirty years
and given the unusual relating to the shape of the Locus and the
structures thereon, and especially affecting the Locus but not
generally affecting lots in the same zoning district, a literal
application of the provisions of the By-law would result in a
substantial financial hardship to the applicants, and desirable
relief may be granted as requested by the Applicants without
derogating from the purpose and intent of the By- law
Evidence of owner' s title is registered as Certificate of Title
No. 17375 at Nantucket Registry District and recorded with
Nantucket Deeds in Book 1610, Page 268 and Book 1655, Page 103.
The Locus is located at 21 and 25 Monohansett Road, is shown on
Nantucket Tax Assessor' s Map 79 as Parcels 112 and 147, and is
located in Limited Use 1 ("LUG-1") Zoning District .

DECISION:
At a 'public hearing on Friday, August 18, 1989, at 1:00 p.m.
in the Town and County Building, Nantucket, on the application
(043-89) of David, PeterandAllison MacKay having an address of
25 Monohansett Road, Nantucket, Massachusetts 02554, the
Nantucket Zoning Board of Appeals made the following DECISION:
1 . Applicants ' seek a Variance from the ••1.2-foot froht•' to
rear spacing requirement of Zoning By-Law Section 139-7A(2) (b)
to validate the location of a two (2) story secondary dwelling
on the Lot without the required spacing from the existing
principal dwelling on the Lot.
2 . Thd premises are located at 25 Monohansett Road,
Assessor's Parcel 79-112, Lot 2 of Land Court Plan No. 39913-A
and zoned Limited Use General-2.
3 . Our findings are based upon the application papers
including site plan prepared by Milton Rowland, As-Built Plan,
Assessor' s Plan and representations and testimony received at
our hearing.
4 . The Applicants' lot has an area of approximately .92
acres and is non-conforming as to minimum lot size for the LUG-2

zoning district which requires a minimum size of 80,000 square
feet. • We specifically find, however, that the lot has been held
in ownership separate and apart from other adjoining land in
this zoning district from a time prior to the effective date of
the Nantucket Zoning By-Law to date and the lot is a
non-conforming, buildable lot of record. Of particular
significance is the shape of the lot; it is irregular in shape
and different in shape from other lots in this particular zoning
district. The significant topographical feature _o,f. 'the' Tot"is
the presence of a large group of pine trees in the southwest
corner of the lot.
5. At our hearing, Applicant David MacKay stated tbat' he
was not aware of the 12 foot spacing requirement when he sited
the secondary dwelling on the lot and he located the secondary
dwelling in its present location to preserve a large group of
pine trees in the southwesterly corner of the lot. Although we
construe th0 provisions for secondary dwellings strictly, we
specifically find that given the fact that the secondary
dwelling has already been constructed, the Applicants would
suffer 'a 'sinificant hard Tiip if the requested Variance relief
were not granted. The Applicants are unable to obtain a
Certificate of Occupancy ru.. the secondary,,,dwelling without the
requested relief. Moreover, we specifically find that given the
unique shape of the lot and its unique topographical features, a
grant of variance relief in these circumstances will not

substantially derogate from the intent and purpose of the
Nantucket Zoning By-Law. We note that the Nantucket Planning
Board voted a favorable rec¢9tnendation for the requested relief
and this Board received no opposition to the requested relief.
For the reasons given, we are able to make the findings
necessary for Variance relief. The hardship arises from the
unique shape of the lot. We hereby GRANT the Variance relief
requested by the Applicants by a vote of 4 in favor (Leichter,
O'Mara, Dooley and W1].iams anc _ • opposed (Sherman) .
