The minutes of November 19, 2008, the information meeting of December 4, 2008 and
the minutes of December 17, 2008 are approved unanimously.
Variance Requests
HO Ray tells the BOH that the three variances for tight tanks are all existing structures
located beyond the Wauwinet House and located between the sand/dune area and the
Nantucket Harbor/Atlantic Ocean on the other side. All recommendations are essentially
the same.
127 Wauwinet Rd -This is an existing three bedroom structure with a lack of
sufficient groundwater separation - a tight tank installation is recommended given
the property constraints as well. This variance will limit home to a six-month
occupancy, requires an annual pump out contract in perpetuity, anaudible/visual
alarm system must be put in place, and a sewer privilege fee will be assessed
when fee is determined, as well as final approval required by the DEP. HO Ray
recommends granting this variance.
Mr. Reinhard asks for the number of tight tanks currently on island. HO Ray says
there are approximately 7pre-existing tight tanks, 6 recently approved tight tanks,
and three tonight he's recommending for approval. Mr. Reinhard questions the
safety of tight tanks during storm surge, etc. HO Ray states that tanks are 2,000
gallon concrete tanks, and the houses are typically not occupied during the winter
storm season and should be pumped out at 3/5 capacity.

2. 116 Wauwinet Rd. -This is a five bedroom existing structure. HO Ray
recommends granting variance with the same stipulations as listed above.

3. 131 Wauwinet Rd. -This is a two bedroom existing dwelling. HO Ray
recommends granting variances with the same set of stipulations as apply to the
two previous properties.
BOH approves variance request unanimously.
Separate BOH Discussion
During Apri12008 Town Meeting the BOSBOH agreed to explore a separate BOH. HO
Ray has some research that shows of the 351 towns in Massachusetts, 336 have a separate
Board of Health and 15 have a BOSBOH configuration. Many have 3-5 member boards
with the majority being a 3 member board. All members attend MAHB one day training
course offered in November and have monthly informational meeting to discuss topics
and direction. HO Ray would recommend a five member board - 2 from the health care
field, 2 from the general public (or with 1 BOS member), and 1 from the
engineering/construction field. HO Ray would like to look towards the fall of 2009 for
inception. Ms. Rogeveen suggests current board member(s) take the training course and
meet with HO Ray monthly. Mr. Kopko asks about the regulatory aspect of a separate
BOH and should that power be transferred to the separate BOH? What would the
qualifications and mechanism be for implementation? With the Board's approval, HO
Ray states that he'll move forward with more investigation for a separate BOH for the
next meeting with the BOH recommendations for a five member board (one member
being a selectman), an appointed board and agrees to have standards for appointees.
Tick Borne Disease Committee update -Six individuals have submitted application, but
HO Ray would like a 9 person committee and would like to allow more time for
additional applicants to step forward. Of the six current applications, only three are year-
round residents. HO Ray states that the public education component will be started by
the Health Department in the spring. The BOH asks HO Ray to reconvene in two weeks
to see if more applicants come in.

1. Appointment of Tick Borne Disease Committee - HO Ray submits 11 names of
applicants for the Tick Borne Disease Committee for the Board's approval and
recommends that all 11 be appointed. BOH unanimously approves all 11
applicants' appointment. HO Ray will have astart-up meeting to discuss meeting
times and appointment to chair and vice-chair the committee. He will report the
information to the BOH at their next meeting.
2. Flu Season Update - HO Ray reminds the community that it's not too late to get a
flu shot from their doctor and to visit the Health Department's website to find flu
related information that has been downloaded.
There is also an EPA document (from the Weather Channel) called "After the
Storm Advisory" which is also available on our website regarding action that can
be taken by community members after a storm event.

The minutes of January 28, 2009 and February 11, 2009 are approved unanimously.
Discussion on separate Board of Health - HO Ray discusses the options available for
establishing a separate BOH, i.e., an elected Board of Health, use of a Home Rule
Petition for appointed BOH. The BOS/BOH prefers the Home Rule Petition option.
Town Counsel DeRensis discusses the options available.
Mr. Chadwick would like to spend more time on investigating a separate BOH.
Other board members feel comfortable moving forward with a separate BOH, and
Chairman Kopko asks town counsel to draft a motion in order to get information in the
public's hands for the warrant. HO Ray would like a five member board, with three
health care/environmental professionals, one BOS member and one member from the
general public if possible.
The BOH votes 4-1 (Mr. Chadwick opposing motion) to move forward on separate BOH.
Town Manager Gibson asks for a meeting to review information next week.

AGENDA
The minutes from the February 25, 2009 and March 4, 2009 BOH are approved
unanimously.
Chairman Kopko opens the Public Hearing relative to Regulation 67.05.
HO Ray states that the amendment to 67.05 -penalties of local regulation 67.00,
miscellaneous provision, intended to allow local Health Department to issue $300.00
fines within the Harbor Watershed Protection Distric~'to those who have not had their
septic system inspected within the prescribed inspection dates. This is a modification of
our penalty section of the code. The intent of the Health Department is to review, on a
monthly basis, properties who are in non-compliance and to issue a fine of $300.00 at the
beginning of each month until the third consecutive month and then to pursue court
action.
Chairman Kopko asks for public input. None noted. Public Hearing is closed.
Motion made and seconded to approve the amendment to 67.05. The BOH approves
amendment to local regulation 67.05 unanimously.
Variance Requests
1. 35 Massachusetts Avenue - HO Ray states that this is a two bedroom dwelling
found to be in septic failure. A composting toilet is proposed, a black water/grey
water facility which allows for a reduction in groundwater. HO Ray recommends
granting variance. The Health Department may hold septic permit until certain
questions are answered relative to zoning relief, well placement, and sideline
setbacks (repositioning of structure on lot).
The BOH approves the variance request unanimously.

2. 347 & 355 Madaket Rd and 4 Ames Ave - HO Ray states that these homes are
directly at the end of Madaket Rd where lots are getting smaller due to erosion.
This is a situation of three undersized properties abutting an actively eroding
shoreline. HO Ray recommends granting the variance with the provisions; an O &
M Agreement be put in place and submitted; a description of form of ownership; a
description of final long term O & M to both the Health Department and the DEP;
a copy of covenant and easement needs to be filed with the Health Department
and the DEP. This will be a single system for three homes. The mandates are
offered by DEP which the Health Department has taken under advisement and
both will require appropriate documentation.
The BOH approves the variance request unanimously.
3. 66 Arkansas Ave -This is a single unit from a townhouse configuration. The
septic repair puts the system a shorter distance to the property line and within
100' well setbacks. This is a maximum feasible compliance situation with an
easement to utilize the green space previously recorded. HO Ray recommends
granting variance.
The BOH approves the variance request unanimously.
4. Request for Relief from local Health Department Policy Statement - HO Ray
reads letter from Attorney William Hunter requesting relief from the Health
Department's policy on minimum oven size for a dwelling. HO Ray states that
his department has run into numerous situations where second dwellings have hot
plates, microwave ovens, wet bars, etc. creating a substandard kitchen facility.
The Health Department instituted a policy requiring no less than 3 cubic feet for
an oven that would suffice in preparing a family meal. This microwave/convec-
tion oven is 1.5 cubic feet.
Ms. Roggeveen makes a motion to grant relief from Health Department Policy
Statement on oven size. Motion seconded. The BOH unanimously grants relief
from the Policy Statement.
5. Appointment of BOH Representative to Nantucket Tick-Borne Disease
Committee - Ms. Roggeveen asks the BOH to appoint her to the committee. The
BOH unanimously approves Ms. Roggeveen's appointment to the committee.
HO Ray tells the BOH that he is still awaiting some paperwork from the
committee members, and that he hopes to have a meeting in early April.

HO Ray -Water to Madaket is not a new issue - it has been discussed for 10-15 years.
Hither Creek is part of the Harbor Watershed Protection District and is an endangered
water body due to nutrient loading (small body of water with only one outlet). Madaket
buildout is at a status quo currently. There are salt water intrusion-water quality issues in
some areas of Madaket. Municipal water would relieve nitrogen sensitive labeling and
building could potentially explode. HO Ray proposes to approach BOH with public
hearings, etc. to limit one bedroom per 10,000 sf by way of a new regulation (even with
hookup to town water) due to potential over-nutrification of water bodies (marginal build
out of properties -this has already been done in wellhead recharge district).
Andrew Vorce -one of the group's polls said they did not want to see water in Madaket.
At the same time, it is recognized that development should be controlled by zoning
regulations. Questions are asked about second dwellings, additional build out, etc. If the
zoning goes to village residential (abetter match) it would reduce ground cover from 12
%z% to 10%.
Chairman Kopko asks for public comments/questions.
Mr. Whitcomb -Lots of information has been handed out. There is a big concern about
potential changes and not being able to view potential changes. Residents are very
concerned about something being stuffed down our throats and questions the need for
public water right now in Madaket. Perhaps it's only needed near Hither Creek and Long
Pond. It is almost wishful thinking to imagine we'd have state of the art fire protection in
Madaket - we can have all the hydrants in the world, but with no equipment or trained
personnel it's a little useless.
Another resident mentions meeting with the fire chief about his limited budget, but that
he had other ideas on how to get water in Madaket without running a water line. "What
are the other options on getting water to Madaket for fire protection?" Chairman Kopko
agrees to get that info for the next hearing.
Mr. Giles -lots of people feel water to Madaket is just a precursor to sewage. We
haven't seen anything scientific yet that points to septic being the major cause of issues in
the Harbor. Would the introduction of sewer open
development?
BOH INFORMATION SESSION -2- April 16, 2009
Mr. Willet - If and when sewer extension and wastewater treatment facility are brought
to Madaket, a zone change regulation must be done to preserve community as it is.
The landfill is not a contributor to degradation of Long Pond -dump does not discharge
the type of nutrient that causes algae bloom on the pond.
What is the timeline for water extension - if approved?
Mr. Gardner -Design will be done within amonth -extension by October.
Where is the funding coming from for this project?
Mr. Gardner - a homeowner assessment. The design is strictly for Madaket Road with
the exception of The Racquet Club. There is a process to extend water for the side
streets.
Mr. Whitcomb -Would it be possible to bring water to Madaket for exclusive use of
"fire protection?" No residential use at all? If water only goes to Madaket Road - it
won't help the creek side residents anyways. Lots of folks in Madaket have acceptable
drinking water.
Mr. Kopko says there is a legal issue involved with municipal water.
Mr. Vorce- the well water system proposed for The Racquet Club in Madaket is
acceptable to the Planning Board (town water service is not required -although one may
be recommended over the other).
Cormac Collier thanks the BOH for their input on new regulations.
Sara Oktay asks for numbers in change of use (town water vs. well water). We need to
measure both fertilizer use and septic runoff (nutrients) into water bodies of Hither Creek
and Madaket Harbor.
Mr. Giles reminds BOH that we are still awaiting the Madaket Harbor Watershed
Protection District results.
Mr. Kopko states that this is an information session and more public hearings will occur.
Ms. Roggeveen states that the Board will respect the area plan and residents' input.

Variance Requests
135 Wauwinet Road - HO Ray states that this is a failed septic system with a
property abutting Nantucket Harbor. The separation to groundwater is one foot.
A grey water system with a composting toilet is recommended in which a three
foot separation to groundwater would be allowed -year round use is also
permitted. HO Ray recommends granting variance. BOH approves variance
request unanimously.
2. 15 Hallowell Lane -This is an existing dwelling with acesspool - a cesspool
fails by definition on Nantucket. The proposed system will use a drip dispersal
system which allows for a five foot separation to groundwater. HO Ray
recommends granting variance. BOH approves variance request unanimously.
3. 36 Exeter Street -This is a 10,000 square foot lot in Tom Nevers with an existing
three bedroom dwelling and a failed leach pit. Due to property constraints, the
leach pit must be removed and replaced within the same location. HO Ray
recommends granting variance. BOH approves variance request unanimously.
4. 271 Polpis Rd. -This is a tight tank installation request for an existing three
bedroom dwelling with a cesspool. A conventional system is not feasible due to
wetland and high groundwater conditions. This property is also up gradient of
Polpis Harbor. HO Ray requests granting of variance for the tight tank (local)
approval with the stipulations that limits the property's use to six months a year,
there is an annual pump out agreement secured in perpetuity with a local pumping
contractor; that an alarm system be put in place; and sewer privilege fees, when
mandated, will be assessed. DEP application must follow local approval. BOH
approves variance request unanimously.

Tick Update
HO Ray updates the BOH on the Tick Borne Disease Committee. There are 11
individuals on the committee -five are year round residents. As such, a consensus from
the committee on when to meet has been difficult so HO Ray has chosen May 15th as a
date for the first meeting. He hopes to have the committee's recommendations to the
BOH in mid to late fall. HO Ray reminds the public to check themselves and their
families daily for ticks as we had a somewhat mild winter.

Variance Requests
1. 68 Arkansas Ave. -This is a replacement of a failed septic system from a HWS
inspection. They are requesting sideline setbacks and relocation of the system.
HO Ray recommends granting variance - it meets maximum feasible compliance.
The variance request is approved unanimously.
2. 7 S. Cambridge St. -This is for the proposed racquet club and is a composting
toilet proposal as well as sideline setback variance request (sideline setbacks are
routine, in-house approval). This system has been approved by DEP and will
have no reserve area setback due to property constraints. It will have minimal
impact on groundwater due to composting toilets. HO Ray recommends granting
variance. The BOH approves the variance request unanimously.
3. 347 & 355 Madaket Rd. & 4 Ames Ave. - HO Ray has a document requiring
BOH signature for three structures directly at the end of Madaket Road. This is
for a shared septic system which replaces anon-code compliant system. The
shared septic system will have less disturbance than a traditional system and fits
all criteria as mandated by DEP and Nantucket Board of Health. The document
needs BOH signatures and HO Ray recommends signing it -this grants
permission to utilize a shared system and monitoring will be required. BOH
unanimously approves signing of document.
4. Request of Waiver of Penalty to Star of the Sea Youth Hostel - HO Ray states
that this is the third year in a row that the youth hostel has opened without benefit
of a permit. The new manager (Jenna Dubois?) states that she is trying to comply,
but as this is her first year, she didn't realize she had to get a lodging/dorm permit.
She had the water tested and got her building/fire inspections, just not her health

inspection and was unclear as to how to maneuver the system as management has
changed frequently over the past several years. Mr. Reinhard recommends making
the fine $200.00. Mr. Chadwick and Ms. Roggeveen can't support a waiver of the
fine. The BOH votes 4-1 to deny waiver of penalty request.
BOH Update
HO Ray has proposed regulations for Madaket with regard to wastewater reduction in
Madaket. He would like to set a hearing date for Madaket regulations at the Admiralty
Club on August 24th at 4:00 p.m. The BOH agrees to this request.
Tick-Borne Disease Committee - HO Ray tells the BOH that the committee is meeting
frequently, has a defined schedule and work plan, is looking at all aspects of the disease
and will make their recommendation to the BOH sometime this fall.
Also, Miacomet Pond will be closed for swimming due to high bacteria levels and will be
resample next Tuesday. Warren's Landing is being retested tomorrow, as high bacterial
levels were found there as well.

2. Public Hearing -Regulation 54.00 -Septic Flow Limitations Within Madaket
HO Ray gives a short presentation on the recent past in terms of our water bodies,
nutrient loading issues, and inspection programs started to address these issues
and to mandate repairs when necessary. HO Ray discusses state and local
regulations dealing with nitrogen sensitive properties. With the arrival of town
water in Madaket, the nitrogen sensitive label would be removed (any increase in
bedrooms will be an increase in nitrogen loading and will impact cleaning up of
Madaket Harbor and Hither Creek). Regulation 54.00 protects Madaket by
limiting properties to one bedroom for every 10,000 square feet of property even
if town water is utilized - it will keep Madaket basically the same as it is today.
HO Ray then discusses the definitions and the regulation specifically.
Chairman Kopko asks for questions from the Board. None noted.

Scott White -asks about further inspections after initial one.
HO Ray -none will be required for the town.
Ken Giles -asks about exceptions to the rules.
HO Ray states that exceptions (variances) will have to come in front of BOH, and
he favors replacement of what is in the ground. HO Ray does not favor variances
for additional flow/new construction. However, BOH makes fmal decision (by
simple majority).
Woman -asks about composting toilets and alternative technologies.
HO Ray -Massachusetts is strict when approving I/A's (not all composting toilets
are approved in Massachusetts) and alternative technology belongs on properties
that can't meet the regulations. There are many I/A technologies available and
the decision on which to use should be made with an engineer on a case-by-case
basis.
BOH-PUBLIC HEARING -2- AUGUST 24, 2009
Woman - Is funding available?
HO Ray states that local and state funding is available -some with financial
criteria restrictions.
Regulation 54.00 is endorsed by Madaket Homeowners Assoc., Long
Pond/Tristram's Homeowners Association, the Madaket Land Trust and the
Nantucket Land Council.
Woman -asks about expansion of homes/grandfathering.
HO Ray -states that expansion may not be possible. It depends on room count
and bedroom count and is controlled by the building permit process.
Leslie Forest(?) -asks about Long Pond.
HO Ray -states that Long Pond is also a concern, although phosphorous
reduction is needed near ponds. There are I/A systems that reduce phosphorous.
Fertilizers are discussed and are a contributing factor to our water bodies.
HO Ray states Zone A inspections should be done by 12/14/09 and Zone B by
6/14/10. Hydraulic failure must be fixed immediately -technical failure of
between 5 and 6 feet will be evaluated and addressed approximately 18 months
after all results are in. Violators will be ticketed $300.00.
Chairman Kopko closes the public hearing.
The BOH unanimously approves Regulation 54.00.

Variance Request
9 E Street -Two existing structures (2 bedrooms in each dwelling) that are in septic
failure per the HWS inspection. The septic system has been relocated away from the
coastal dune and Hither Creek. The homeowner is asking for relief from sideline setback
and the 150 foot well separation requirement. They will utilize the Presby leach facility
for nutrient reduction (the fibrous mat offers substantial reduction of nutrient loading).
Presby is approved for repair use and offers a reduction in the size of the system or a
reduction in separation of distance to groundwater (2 ft.). HO Ray recommends granting
variance. The BOH approves the variance request unanimously.
Status Report on Nantucket Harbor Watershed Protection District - HO Ray presents the
most updated map to the BOH showing inspections done in this harbor district. Of a total
of 602 systems, 554 have been inspected and 48 are not yet inspected. Some lots are now
on sewer and will be removed from our list. A number of fines (tickets) have been issued
and paid. Over the next 3-4 months, we will look at the data for recommendations.
Mr. Reinhard asks about the estuaries report and the TMDL number and whether we'll
have to lower what is being discharged into the harbor. HO Ray states that we will have
to lower the discharge, but probably not by much. We are already ahead of the state by
performing septic inspections and upgrading systems in failure. The Health Department
and the DPW are working together on this project. Mr. Reinhard asks about the Madaket
Harbor results. HO Ray states that Madaket `will be harder to reach due to the shallow
harbor, Hither Creek, greater concentration of homes near water bodies on smaller lots,
etc., but again with the septic systems being inspectedlrepaired, it will help us. Mr.
Reinhard asks about fertilizer reduction to help us achieve our goal and that is something
HO Ray agrees to look at in the planning.

Hummock Pond Association Watershed Protection District -The Hummock Pond
Association brought some concerns to the BOH (via UMass Field Station) about the state
of Hummock Pond. At UMass's advice, we closed the pond due to the toxic blue/green
algae bloom. The Health Department sat down with the Hummock Pond Association
along with Mr. Atherton to look at approaches to remediation. An unanswered question
is what is the limiting nutrient in Hummock Pond? In repairing septic systems around
any water body, improvement in both nutrient and phosphorous will be seen. We want to
create a zone around the pond, while researching the water, to inspect and upgrade septic
systems if necessary. HO Ray shows a tentative map of this protection zone which will
probably change over time and with research. Some time next spring, HO Ray expects to
have another map designating this zone. After research is done regarding the pond's
chemistry, we will work on an inspection protocol similar to what is currently being done
in Nantucket and Madaket Harbors.
Dave Fronzuto of the Marine Department states that sampling has been done by the
Marine Department since 1993 and data has been given to the estuaries people.
Nantucket has been given a reduction in costs associated with this project due to the data
that has already been compiled by the town. "We are not starting from ground zero on
any of these water bodies -Hummock Pond has also been sampled."
H1N1 Flu Vaccine Update - HO Ray tells the BOH that on Saturday, we vaccinated
about 44 pregnant women and a number of direct care health care workers at a clinic for
H1N1. No cases of H1N1 have been diagnosed to date on island. HO Ray states his
frustration with the CDC for not having vaccines available as promised. The CDC is
advising towns to cancel local clinics until production can be met (the middle of
December or so). Vaccines for H1N1 are coming in very small numbers and are given to
doctors' offices for distribution. Since H1N1 is affecting those 25 and under at a greater
rate, the distribution of vaccine should go to pregnant women and health care workers,
children under 10, elementary, high school and college kids, then adults 25-45, and lastly
50 and over (taking into consideration those of any age with underlying health issues).
He also states that guidelines are being instituted for employees and their children with
regard to staying home from work if you have the flu, to remind folks about frequent
hand washing, coughing/sneezing into their arm, and checking in with their family
doctor.
Ms. Roggeveen states that in a discussion with Chairman MacNab of the Tick-Borne
Disease Committee, a final recommendation will be available for the BOS within several
weeks and that a working committee should continue after their final recommendation.
She also thanks HO Ray and the committee for their hard work.

Nantucket Tick-Borne Disease Committee Report - HO Ray introduces Committee
Chair, Dr. Malcolm MacNab, who discusses the committee's report. Chairman MacNab
outlines the problem, the transmission of diseases, and the solutions. He also summarizes
six recommendations: to manage the deer herd (10 per sq. mi.); manage habitat; the use
of pesticides; the use of 4 posters, public education; and personal protection. This must be
a continuing, long-term community message.
The BOH asks about funding and resources (shared?) (a sense of dollars coming from the
town itself'?) and states that costs will depend on the approaches the town takes to limit
diseases (civic group involvement?).
Chairman MacNab gives BOH a general idea of costs associated with various
recommendations.
BOH asks the committee to continue with their work and ask that reporting of disease be
a priority. Ms. Roggeveen asks the committee to focus on special implementation
actions, to work on the wording of the non-binding referendum questions, and structuring
the financial mechanism (data tracking and education).
Chairman Kopko asks for public comments.
Mrs. McLaughlin thinks that the "February hunt" repeat is a bad idea. Mr. Willauer
suggests the possibility of individual civic associations funding their own 4 posters. Ms.
Dunton agrees that deer numbers have to be reduced to control diseases. HO Ray
indicates that the entire Tick-Borne Disease Committee Report is available on the Town's
website.
Update of H1N1 - HO Ray announces that on December 10, 2009, from 5-7 p.m., at the
Nantucket Cottage Hospital, there will be a flu clinic (nasal spray), for those ages 10-24
years old.

The minutes from October 21, 2009 are approved unanimously.
HO Ray gives the BOH a document required by DEP (as part of their
approval process) to be signed by BOH fora 15 lot subdivision (one septic
system servicing homes at Bartlett Rd. and Somerset Rd.) which allows
BOH to enter onto property to ascertain that the unit is functioning
appropriately, to mandate repairs, etc.
BOH unanimously approves signage of the shared system document.
HO Ray notifies BOH that of the 474 systems in Madaket that need to be
inspected, 257 have been inspected, 178 have passed and 79 have failed
inspection. We have reached the end of the two-year time frame for
inspections to be done and with the limited number of inspectors on island;
HO Ray would like to extend the time frame for inspections in Madaket by
12 months (the same as was done in the Nantucket Harbor Zones). HO Ray
will bring his proposal to the Board in the form of a public hearing perhaps
in February or so. The Estuaries Report is not yet complete for Madaket.
H1N1 Update - At this time we have administered 2,000+ H1N1 vaccines
on island as per MDPH guidelines. Communities are now approved to
conduct open flu clinics. HO Ray announces what maybe the last flu clinic
put on by the Health Department and the Hospital and will take place on
January 9, 2010 at NES from 9:00 to approximately 12:00 p.m. This clinic
is open to all ages. For those who can't make the January 9th clinic, HO Ray
advises phoning your doctor or local pharmacy for an appointment.

Non binding referendum question for April election -The Deer Tick
Advisory Committee is offering verbiage for BOH approval to be added
onto the April ballot. This will be added to get a sense of how the voters
feel and then the BOS will be asked to approach Department of Fisheries
and Wildlife to discuss on the town's behalf what avenues should be taken
for the 2010-2011 deer hunt. This is amulti-faceted approach to the tick
issue. The Tick Advisory Committee's report is on our website.
BOH will take this under advisement.
