Sconset Old Historic ("ROH") ZA Decision No. 03-19
nFCIMON.
1. Upon review of the Application submitted by the Applicant, Marcia J. Browne & Jeffrey-
W. Clark, the Zoning Administrator determined pursuant to Nantucket Zoning By-LaXV
(the `By-law") §139-33.A(1)(b) that the proposed extension, alteration, and change to the
pre-existing, nonconforming structure upon a pre-existing, nonconforming lot will not
increase the nonconforming nature of the structure or the locus and will not create any
new nonconformities.
2. The Applicant proposes to alter the existing two-story, wood -frame dwelling by building
a one hundred forty-five (145) square foot addition. Specifically, said alteration consists
of enclosing and expanding an existing porch on the northeast elevation of the dwelling,
all in accordance with Certificate of Appropriateness No. 72702 issued by the Nantucket
Historic District Commission ("HDC"), as the same may be modified and amended from
time to time.
3. The Locus, located in the Sconset Old Historic ("SOH") zoning district, is shown on plan
entitled, "Zoning Administrator Plan of Land in Nantucket, Ma.", dated August 7, 20197
and prepared by Michael Connolly & Associates, Inc., a reduced copy of which is
attached herewith as "Exhibit A". The lot, a corner lot having double frontage onto both
Ocean Avenue to the east and Pochick Street to the south, is an undersized lot of record
containing 3,773 sq. ft. where minimum lot area is 5,000 sq. ft. The Dwelling, an historic
structure having been constructed circa 1875, is pre-existing, nonconforming as to side
yard setback, being sited as close as 0.6 feet from the northerly lot line. The dwelling has
a ground cover of 1,123 sq. ft., equivalent to a ground cover ratio ("GCR") of 29.8%
where 50% is the maximum allowed.
4. As shown on plan entitled, "Zoning Administrator Plan of Land in Nantucket, Ma.".
dated August 7, 2019, and prepared by Michael Connolly & Associates, Inc., a reduced
copy of which is attached herewith as "Exhibit B", the Applicant proposes to enclose the
north side of an existing porch and extend the porch into the side yard by roughly four (4)
feet, three (3) inches. The resulting single -story addition will be no closer to the lot line

than existing and will add one hundred forty-five (145) sq. ft. of ground cover. The
resulting total ground cover will be 1,268 sq. ft. for a GCR of 33.6%.
5. Based upon the elevations prepared by Angus McLeod Designs and approved in
connection with the above -referenced HDC approval, and the proposed conditions plan
attached herewith as "Exhibit B", the Zoning Administrator finds that the proposed work
will not increase the nonconforming nature of the structure and will not create any new
nonconformities and hereby issues the permit as requested. Following its renovation and
expansion, the Locus will continue to be conforming as to use, parking, and all other
dimensional requirements of the By-law, except as to the lot size and side yard setback,
as to which it is validly pre-existing, nonconforming; the nonconforming setback distance
will not become more nonconforming; and no new nonconformities will be created. This
approval is subject to the following conditions:
a. There shall be no exterior construction between Memorial Day and Labor Day of
any given year relative to the construction contemplated under this decision; and
b. The proposed alterations shall be performed in substantial accordance with HDC
Certificate of Appropriateness No. 72702, as the same may be amended from time
to time.
C. The proposed alterations shall be performed in substantial compliance with the
proposed conditions plan attached herewith as "Exhibit B".
