The parcel acquired by the Owners is shown as Parcel E upon a plan recorded with Nantucket Deeds as Plan No. 2017-79. Prior to the acquisition of Parcel E, the area of the Owners' land was 14,792± square feet; the inclusion of Parcel E increased the area of the Owners' land to 16,384± square feet. Minimum lot area in this SR -20 zoning district is 20,000 square feet. Accordingly, the Owners request the Board of Appeals to grant relief by Variance, in order that their land remaining after the proposed conveyance, containing 14,792± square feet as had been the case prior to the acquisition of Parcel E, shall continue to be considered for zoning purposes as a pre-existing, nonconforming lot of record. This relief would be conditioned upon the conveyance of Parcel E being made to the Applicant and the obligation of the Applicant to merge Parcel E with their land known and numbered as 1 Low Beach Road and now containing 18,693± square feet; the addition of Parcel E, containing 1,591± square feet, would increase the area of the Applicant's property to 20,383± square feet and thus render it conforming with all applicable dimensional zoning requirements. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, August 8, 2019, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of ROBERT GLENN ELMER, JAMES DAVID ELMER, JONATHAN EUGENR ELMER, PETER GOODWIN, W. DAVID GOODWIN and KRISTINA GOODWIN, c/o Julie A. Fitzgerald, 3 Nobska Way, Post Office Box 2257, Nantucket, Massachusetts 02584, as Owners, and SEVENTEEN BR PROPERTY, LLC, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, as Applicant, File No. 17-19: 2. The Owners wish to sell to the Applicant the land within a former unnamed Way off Low Beach Road, which was located between the land of the Owners and the land of the Applicant, which the Owners acquired from the Town of Nantucket on February 23, 2018, pursuant to the "yard sale" program. The parcel acquired by the Owners is shown as Parcel E upon a plan recorded with Nantucket Deeds as Plan No. 2017-79. Prior to the acquisition of Parcel E, the area of the Owners' land was 14,792± square feet; the inclusion of Parcel E increased the area of the Owners' land to 16,384± square feet. Minimum lot area in this SR -20 zoning district is 20,000 square feet. Accordingly, the Owners request the Board of Appeals to grant relief by Variance, in order that their land remaining after the proposed conveyance, containing 14,792± square feet as had been the case prior to the acquisition of Parcel E, shall continue to be considered for zoning purposes as a pre-existing, nonconforming lot of record. This relief would be conditioned upon the conveyance of Parcel E being made to the Applicant and the obligation of the Applicant to merge Parcel E with their land known and numbered as 1 Low Beach Road and now containing 18,693± square feet; the addition of Parcel E, containing 1,591± square feet, would increase the area of the Applicant's property to 20,383± square feet and thus render it conforming with all applicable dimensional zoning requirements. See Existing Conditions Site Plan (attached herewith as "Exhibit A") and Proposed Conditions Site Plan (attached herewith as "Exhibit B"), each prepared by Blackwell & Associates, Inc., each dated May 29, 2019, (attached herewith as "Exhibit A") and Plan No. 2018-42 depicting the Applicant's property, each attached hereto. The subject property of the Owners consists of several adjacent parcels of unregistered land, being Plan Book 2, Page 28, Lots 1 and 2; Plan No. 2017-79, Parcel E; and additional land with no plan of record, situated at 51 Morey Lane, Sisaconset (Assessor's Parcel 73.3.2-34), and is situated in the SR -20 zoning district 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation. Except for the presentation on behalf of the Applicant, there was no support nor opposition received at the public hearing. 4. Based upon the Applicant's presentation and matters of record, the Owners have no need for Parcel E, which they acquired through the yard sale process, and wish to be allowed to transfer it to the Applicant. Variance relief is technically required because the effect of the Owners' acquisition of Parcel E, if merged with their adjacent land, would render their undersized lot less nonconforming. However, the effect of the conveyance of Parcel E to the Applicant and its merger with the Applicant's adjacent land would result in the Applicant having a conforming lot, containing in excess of the minimum lot area of 20,000 square feet, while the Owners' lot would be exactly the same as its historic boundaries prior to the yard sale. Thus, instead of there being two adjacent undersized lots, there will be one conforming lot and one lot exactly the same as it was before the yard sale, resulting in an overall increase in zoning conformity. 5. By unanimous vote, the Board of Appeals made the finding that variance relief was justified in that owing to circumstances relating to the shape and topography of the Owners' land and especially affecting that land but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Owners, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. Accordingly, by the same unanimous vote, the Board of Appeals granted the requested relief by Variance, allowing the conveyance of Parcel E from the Owners to the Applicant and confirming the validity of the Owners' remaining land as a valid pre-existing, nonconforming lot of record, as it was prior to the conveyance of Parcel E to the Owners by the Town, subject to the following conditions that: a) Upon conveyance of Parcel E by the Owners to the Applicant, the Applicant shall take action to legally merge Parcel E with the Applicant's adjacent land shown on Plan 2018-42 for all purposes relating to building and zoning laws, by-laws, rules and regulations; and b) The Applicant shall obtain permission from the Select Board to allow the conveyance of Parcel E, conveyed to the Applicant by the Town of Nantucket in Deed recorded at Book 1635, Page 63, as explained and conditioned above.
