O’Mara, Dale Waine, Michael Angelastro, Kerim Koseatac, Lisa Botticelli, Mark Poor, and Susan McCarthy. Staff: John Brescher I. Call to Order: Chairman Toole called the meeting to order at 1:03 PM. II. Approval of the Agenda: A motion was made (O’Mara) and duly seconded to approve the agenda as written. The vote was 5-0 in favor. III. Approval of the Minutes: A motion was made (O’Mara) and duly seconded to approve the minutes of the June 11, 2011 ZBA meeting. The vote was 5-0 in favor. IV. Elections: A motion was made (Waine) and duly seconded to retain the same officers as last year. These officers are: Ed Toole as Chairman; Dale Waine as Vice Chairman; Lisa Botticelli as Clerk. The vote was unanimous. V. Old Business  085-06 Reis 80 Miacomet Avenue Reade C Action Deadline, October 26, 2011. Continued to October 13, 2011 VI. New Business  020-11 White 2 Hussey Street Alger Action Deadline December 8, 2011. The Applicant intends to convert the structure to one single-family dwelling and lift the structure in order to put a foundation with a full basement in its existing location. Attorney Alger stated to the Board that the Applicant is requesting relief in order to lift the house and relocate it in order to conform with all applicable setback requirements. A motion was made (Waine) and duly seconded to approve the relief as requested. The vote was 5-0 in favor. Attorney Marianne Hanley represented the Applicant. Attorney Hanley explained t the Board that the Applicant is requesting a Special Permit in order to waive the necessary parking in order to construct an apartment above an existing first floor commercial structure. A motion was made (Angelastro) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Leslie Snell, Senior Planner for the Town of Nantucket, helped explain the history of these parcels and the various votes at Town Meeting. A motion was made (Waine) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Attorney Richard Glidden represented the Applicant. Attorney Glidden explained to the Board that the Applicant is requesting relief in order to alter the preexisting nonconforming structure. Attorney Arthur Reade, representing Mary Margaret Holmes, spoke against the application, arguing that the proposed construction would negatively impact his client. Ms. Holmes, also spoke against the application at the hearing. A motion was made (Waine) and duly seconded to continue the matter to the August 8th ZBA hearing. The vote was 5-0 in favor.  039-11 Mayhew, Trustee 6 Daisy Way Fitzgerald Action Deadline October 12, 2011. Attorney Julie Fitzgerald represented the Applicant. Attorney Fitzgerald explained to the Board that the Applicant is requesting a minor modification to the plan attached to the existing decision. A motion was made (Koseatac) and duly seconded. Attorney Julie Fitzgerald and Melissa Philbrick represented the Applicant. Attorney Fitzgerald and Ms. Philbrick explained to the Board that the matter before them was whether or not there are specific and material changes from the previous application that warrant the Board rehearing this application. The Board asked if there was a change in the parking and Ms. Philbrick explained that the parking requirement had been decreased because of the decrease in proposed occupancy. Bethany Oliver, Deborah Pelem, Dr. Tichinou, Pauline Proch, and Molly Glazor all spoke in favor of the application and urged the Board to rehear the application because of the specific and material changes to the application. Marguerite Wettereau, Dr. John West, Ann Balas, John Wagley, and Sue Lingaman all urged the Board to deny the application on the basis that there are not specific and material changes to the application. A motion was made (O’Mara) and duly seconded to approve the relief requested. The vote was 4-1 in favor (Koseatac opposed). A second motion was made (O’Mara) and duly seconded to continue the matter to the August 11th ZBA hearing. The vote was 5-0 in favor. Attorney Arthur Reade represented the Applicant. Attorney Reade explained to the Board that the Nantucket Yacht Club is requesting relief in order to upgrade and renovate their existing structure. A motion was made (Angelastro) and duly seconded to approve the requested relief. The vote was 5-0 in favor. A motion was made (Waine) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Attorney Cohen explained to the Board that the Applicant is requesting a Special Permit in order to alter the preexisting nonconforming structure without being any closer to the setbacks than what presently exists. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor.  046-11 Nancyn as Applicant 4 Salros Road Wilson Action Deadline October 12, 2011. Kenneth Turgeon represented himself as the owner of the locus. Mr. Turgeon explained that the Applicant is requesting a change of use to the property in order to operate a livery/taxicab business. A motion was made (Koseatac) and duly seconded to approve the requested relief. The vote was 5-0 in favor. VII. Adjournment A motion was made (Koseatac) and duly seconded to adjourn the hearing at 4:00 pm.
