O’Mara, Dale Waine, Ed Toole, Lisa Botticelli, Kerim Koseatac, Mark Poor Staff: John Brescher and Venessa Moore I. Call to Order: Chairman O’Mara called the meeting to order at 1:06 PM. II. Approval of the Agenda: A motion was made (Toole) and duly seconded to approve the agenda as written. The vote was 5- 0 in favor. III. Approval of the Minutes: A motion was made (Toole) and duly seconded to approve the minutes of the January 14, 2010 ZBA meeting. The vote was 5-0 in favor. IV. Other Business: V. Old Business ƒ 085-06 Reis 80 Miacomet Avenue Reade C Action Deadline September 26, 2009. Continued to December 10, 2009 ƒ 030-07 Burnham 12½ Sherburne Turnpike Reade C Action Deadline September 26, 2009. Continued to December 10, 2009 VI. New Business ƒ 003-10 Fairjack, LP 8 Towaddy Lane Remick Action Deadline May 12, 2010 No representative was present; therefore, the Board continued the application without opening to the March 11, 2010 ZBA meeting. 2 Fairgrounds Road Nantucket Massachusetts 02554 508-228-7215 telephone 508-228-7298 facsimile ƒ 004-10 Dasilva 4 Newtown Road Glidden Action Deadline May 5, 2010 Attorney Richard Glidden represented the Applicant. Attorney Glidden explained to the Board that there was an error in the previously written decision because it did not correctly describe the size of the lots that were being created. The Applicant, therefore, is asking the Board to attach a revised plot plan that correctly describes the size and dimensions of the lots in question. A motion was made (Waine) and duly seconded to approve the relief as requested. The vote was 5-0 in favor. ƒ 005-10 NIR Retail, LLC Zero Main Street Hunter Action Deadline May 12, 2010 Attorney Bill Hunter represented the Applicants. Attorney Hunter presented information to the Board asking them to ratify and waive the parking for the first floor of the locus in question. Acting Chairman Waine suggested that the Applicant modify the application and return with a more comprehensive analysis of the parking required for the entire building, not just the first floor. A motion was made to accept the requested withdrawal from the Applicant (Botticelli) and duly seconded. The vote was 5-0 in favor. ƒ 006-10 Oberting 38 Wanoma Way D’Elia Action Deadline May 12, 2010 Attorney Lori D’Elia represented the Applicant. Attorney D’Elia stated that the Applicant is requesting relief for an unintentional setback intrusion for a step sited in the setback. The Zoning Enforcement Officer added that as the ten year statute is in effect, this matter is more of a housekeeping issue. A motion was made (Waine) and duly seconded to approve the requested relief. The vote was 5-0 in favor. VII.
