Call to Order: Chairman Toole called the meeting to order at 1:05 PM. II. Approval of the Agenda: A motion was made (Koseatac) and duly seconded to approve the agenda as written. The vote was 5-0 in favor. III. Approval of the Minutes: A motion was made (Koseatac) and duly seconded to approve the minutes of the July 8, 2010 ZBA meeting. The vote was 5-0 in favor. IV. Other Business  Approval of 2010 ZBA Annual Town Report Staff explained to the Board that this report is a brief overview of the actions the Zoning Board of Appeals has taken during FY 2010. A motion was made (O’Mara) and duly seconded to endorse the report. The vote was 5-0 in favor.  Release of funds in Nantucket Homes for People, Inc. escrow account Staff explained to the Board that money had been left in the Nantucket Homes For People, Inc. escrow account from their comprehensive permit in 1999. Staff recommended that the Board release the funds to the developer as the original permit had been closed out. A motion was made (Koseatac) and duly seconded to release said funds. The vote was 5-0 in favor. V. The Applicant requested that this matter be heard in conjunction with application No. 044-10.  032-10 Barrett 21 Somerset Road Cohen C Action Deadline February 11, 2011. Continued to September 9, 2010.  039-10 Abrem Quary Homeowners Assoc. So. Shore Rd. Hunter C Action Deadline September 8, 2010. Continued to September 9, 2010. VI. New Business  044-10 Hall, Trustee 33 Vesper Lane Self Action Deadline October 29, 2010. Brenda Lee Hall represented herself. Ms. Hall explained to the Board that she had been before the Board with application no. 008-10 and that as one of the Board members on that application had resigned, she brought forward this new application. Additionally, she had supplemented the original application with new architectural plans illustrating the exact location of the proposed steps located in the side yard setback. The Board members suggested that Ms. Hall make sure that the construction is done exactly to the plan and to make sure the site is well surveyed prior to any building. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 4-1 in favor (Toole opposed). Accordingly, the Applicant requested that application 008-10 be withdrawn without prejudice. A motion was made (Koseatac) and duly seconded to approve the requested withdrawal. The vote was 5-0 in favor. Attorney Sarah Alger represented the Applicant. Attorney Alger explained the Board the history of the parcel and how the parcel is nonconforming as to ground cover. Attorney Alger also stated that the proposed change will conform to the setbacks; but, will still be nonconforming as to ground cover ratio. Attorney Alger also confirmed that the applicant had received HDC approval for the proposed reconfiguration of the structure. Mr. Hillger wondered whether or not the structure was conforming as to front yard setback and indicated that he believed the house was to move only 10 feet, not the proposed 30 feet. Mr. Hillger wanted it noted in the record that the structure could be left where it is and conform to setbacks and that while he does not agree with the moving of the structure, he nonetheless supports the application because of the ideals of the applicant. Lisa Botticelli asked why the structure was being relocated. Lucy Dillon, the Applicant, stated that she wanted to cure the setback violation and that the structure, as presently sited, is too close to the road. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Attorney Bill Hunter represented the Applicants. Attorney Hunter informed the Board that this is a similar application to the one submitted by the Applicant two years ago. There is a slight change in the amount of the cottage that will be left on the locus; but, it is otherwise identical. Attorney Whit Gifford asked where exactly the structure was to be relocated. A motion was made (Poor) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Attorney Whit Gifford represented the Applicant. Attorney Gifford gave the history of the lot to the Board and why Special Permit relief is appropriate for this matter. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Mr. Maceachern stated that the Applicant is proposing to raise the structure and place a foundation beneath it. This foundation raise will result in a maximum change in height of 8 inches. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor.
