O’Mara, Ed Toole, Lisa Botticelli, Kerim Koseatac, Mark Poor, Carol Cross Staff: John Brescher and Venessa Moore I. Call to Order: Chairman Toole called the meeting to order at 1:00 PM. II. Approval of the Agenda: A motion was made (Cross) and duly seconded to approve the agenda as written. The vote was 4- 0 in favor. III. Approval of the Minutes: A motion was made (Cross) and duly seconded to approve the minutes of the February 11, 2010 ZBA meeting. The vote was 4-0 in favor. IV. New Business ƒ 007-10 Brooks 103 Orange Street Ranney Action Deadline June 9, 2010 Attorney Jamie Ranney represented the Applicant. Attorney Ranney stated that the Applicant is requesting a modification of the existing special permit. The Applicant’s proposed modification will result in the parking to be less nonconforming by adding a separate parking access on the property. Attorney Ranney also indicated that the Applicant will be presenting a similar application to the Planning Board for the second driveway access. A motion was made (Poor) and duly seconded to approve the requested relief. Suspension A motion was made (Cross) and duly seconded to suspend the hearing until 3:00 pm. The vote was 4-0 in favor. VI. Resumption Chairman O’Mara resumed the hearing at 3:00 pm. VII. Other Business: Attorney Steven Cohen updated the Board regarding Reis and Burnham. Attorney Cohen stated that the Burnham matter is now moot and would be requesting a withdrawal from the Board. Regarding the Reis matter, Attorney Cohen stated the difficulty is that there needs to be a land swap with the Land Bank and this is taking longer than expected do to issues with legislation. VIII. Old Business ƒ 085-06 Reis 80 Miacomet Avenue Reade C Action Deadline September 26, 2009. Continued to April 8, 2010 ƒ 030-07 Burnham 12½ Sherburne Turnpike Reade C Action Deadline September 26, 2009. Attorney Cohen requested that the matter be withdrawn. A motion was made (Koseatac) and duly seconded to approve the requested withdrawal. The vote was 5-0 in favor. IX. New Business ƒ 003-10 Fairjack, LP 8 Towaddy Lane Remick Action Deadline May 12, 2010 Steven Beatty represented the Applicant. Mr. Beatty explained that the Applicant would like to site the Air Conditioner unit in the setback. The Board examined the letters in opposition to the requested variance by the abutters and indicated that the Applicant may want to reconsider the location and application. Mr. Beatty requested the Board allow him to withdraw the application without prejudice. A motion was made (Koseatac) and duly seconded to allow the requested withdrawal. The vote was 5-0 in favor. ƒ 008-10 Hall, Trustee 33 Vesper Lane Self Action Deadline June 9, 2010 Brenda Lee Hall represented herself. Ms. Hall explained to the Board that the discrepancy between what was proposed and what exists stems from an error from the surveyor in re-siting the house. Mark Poor suggested that Ms. Hall bring the HDC plans to the next meeting so the Board can ascertain exactly how much relief the Applicant will need in order to have her steps properly sited. 2 Fairgrounds Road Nantucket Massachusetts 02554 508-228-7215 telephone 508-228-7298 facsimile A motion was made (Koseatac) and duly seconded to continue the matter to the April 8, 2010 meeting. The vote was 5-0 in favor. ƒ 009-10 Killen as Owner 81 Hinsdale Road Glidden Action Deadline June 9, 2010 Attorney Richard Glidden represented the Applicants. Attorney Glidden stated that the Applicants would like to modify the uses of the property so that there will be one wood shop use and one landscaping use present. Additionally, with the new landscaping business, there will be no loam or mulch stored outside. Further, the Applicants propose to clean the brush and install the evergreen screening that was part of the original permit. An abutter, Greg Stone, spoke at the hearing and requested some clarification regarding the number of uses, the number of uses, and that there shall only be access from Hinsdale Road. A motion was made (Botticelli) and duly seconded to approve the requested modification. The vote was 5-0 in favor. ƒ 010-10 Arakelian, Trustee 11 Tetawkimmo Drive Self Action Deadline June 9, 2010 Charles Arakelian represented himself. Mr. Arakelian explained to the Board that the gunite pool was rotated by the contractor and subsequently improperly sited, being two feet into the setback. Mark Poor suggested that the neighborhood association write a letter of support of the application. Further, Michael O’Mara recommended the Applicant get a better survey to ascertain exactly how close the wall of the pool is to the setback. A motion was made (Koseatac) and duly seconded to continue the matter to the April 8, 2010 hearing. The vote was 5-0 in favor. ƒ 013-10 NIR Retail, LLC Zero Main Street Hunter Action Deadline June 9, 2010 Attorney Bill Hunter represented the Applicant. Attorney Hunter brought a parking clarification for the property at Zero Main Street in order to establish a baseline. Attorney Hunter requested that there be 36 parking spaces required for the uses at Zero Main Street and that these parking spaces are effectively grandfathered. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 4-1 in favor (Koseatac opposed). ƒ 011-10 Tilton, Trustee 5 Windy Way Hunter Action Deadline June 9, 2010 Attorney Bill Hunter represented the Applicant. 2 Fairgrounds Road Nantucket Massachusetts 02554 508-228-7215 telephone 508-228-7298 facsimile Attorney Hunter requested a modification of the decision to allow office space in the basement to be leased separately so long as there is no increase in parking. After the hearing was opened, Mark Poor, Ed Toole, and Lisa Botticelli opined whether or not they had a conflict of interest as they do business with Nantucket Surveyors, the business of the Applicant. In order to alleviate the Board members, Attorney Hunter offered to withdraw the application so the Board members who thought they may have a possible conflict had time to consult the ethics board. A motion was made (Koseatac) and duly seconded to allow the Applicant to withdraw the application without prejudice. The vote was 5-0 in favor. ƒ 012-10 Seigel 56 Goldfinch Drive Hanley Action Deadline June 9, 2010 Attorney Marianne Hanley represented the Applicant. Attorney Hanley stated that due to a zoning change, the Applicants are requesting that their side yard setback be reduced from ten feet to five feet. The Applicants lots would merge if not for this reduction in the setback. A motion was made (Koseatac) and duly seconded to approve the requested relief. The vote was 5-0 in favor. X. Adjournment A motion was made (Koseatac) and duly seconded to adjourn the meeting at 5:00 pm.
