I. Call to Order:
Chairman O’Mara called the meeting to order at 1:00 PM.
II. Approval of the Agenda:
A motion was made (Koseatac) and duly seconded to approve the agenda as written. The vote
was 5-0 in favor.
III. Approval of the Minutes:
A motion was made (Koseatac) and duly seconded to approve the minutes of the May 13, 2010
ZBA meeting. The vote was 5-0 in favor.
IV. Other Business
Abrem Quary Driveway Modification – 8B Folger Ave – Ray
A motion was made (Waine) and duly seconded to approve the requested driveway modification.
The vote was 5-0 in favor.
V. Old Business
085-06 Reis 80 Miacomet Avenue Reade C
Action Deadline, October 26, 2010. Continued to October 14, 2010
008-10 Hall, Trustee 33 Vesper Lane Self
Action Deadline December 9, 2010.
Brenda Lee Hall represented herself at the hearing.
Ms. Hall presented the Board the approved HDC plans from when the structure was
relocated on the property. The board explained that if Ms. Hall would like to add a step,

she should consult a designer or an architect and have them draw up some plans before
they can approve any setback intrusion.
A motion was made (Botticelli) and duly seconded to continue the matter to the July 8,
2010 hearing. The vote was 5-0 in favor.
010-10 Arakelian, Trustee 11 Tetawkimmo Drive Self
Action Deadline December 9, 2010.
Michael Touchette represented the Applicant.
Mr. Touchette submitted the original building department plans and an updated site plan
to the Board.
A motion was made (Koseatac) and duly seconded to grant the requested relief. The vote
was 4-1 in favor (Poor opposed).
VI. New Business
032-10 Barrett 21 Somerset Road Cohen
Action Deadline August 11, 2010.
The applicants requested the application be continued without opening to July 10, 2010.

The applicants requested the application be continued without opening to July 10, 2010.
034-10 Rhoboid Properties, LLC 63 Surfside Road Glidden

Richard Glidden represented the Applicants.
Attorney Glidden explained that his client was purchasing the structure and wanted to put
in a soft-serve ice cream takeout business.
Bob Burnham, an abutter, spoke at the hearing and questioned whether or not the
Applicant and the abutter would have adequate access.
Attorney Glidden requested that the hearing be temporarily suspended so that he could go
to the Registry of Deeds to check on the recorded easements for the locus.
A motion was made (Poor) to approve the requested relief with the conditions regarding
the number of parking spaces waived and the seats available for patrons and duly
seconded. The vote was 5-0 in favor.

Bryan Ryder and Brooke Meerbergen represented the Applicant.
Mr. Ryder explained that he was requesting a structure to hold light fixtures and wires and
a spot to store the delivered materials.
Art Gasbaro, an abutter, requested that there be evergreens planted in order to screen the
parking area.
A motion was made (Waine) and duly seconded to approve the relief requested. The vote
was 5-0 in favor.

Attorney Sarah Alger represented the Applicant.
Attorney Alger explained that the Applicants are requesting a special permit in order to
make alterations to a preexisting, nonconforming structure.
Attorney Julie Fitzgerald, representing the Youngs, informed the Board that her clients
have no objections to the application.
A motion was made (Koseatac) and duly seconded to approve the requested relief. The
vote was 5-0 in favor.
A separate motion was made (Koseatac) and duly seconded for minor site plan approval.
The vote was 5-0 in favor.
037-10 Hunter, Trustee of 1908 RT 47 Monomoy Road Hunter
Action Deadline August 29, 2010
Attorney Bill Hunter represented the Applicant.
Attorney Hunter informed the Board that the Applicant is requesting to transport the
primary dwelling and garage from his property on Baxter Road to a vacant lot on
Monomoy Road. In order to relocate both the house and the garage, the Applicant will
require variance relief as the structures will be over the allowable ground cover.
A motion was made (Toole) and duly seconded to approve the requested relief. The vote
was 1-4 in favor (O’Mara, Koseatac, Toole, McCarthy opposed).
038-10 Darby 39 Millbrook Road (AKA Paradise Dr) Hunter

Attorney Bill Hunter represented the Applicants.
Attorney Hunter explained that the Applicants wish to remove the existing greenhouse
and place a structure in its place.

A motion was made (Toole) and duly seconded to approve the requested relief. The vote
was 5-0 in favor.
039-10 Abrem Quary Homeowners Assoc. So. Shore Rd. Hunter
Action Deadline September 8, 2010
Attorney Bill Hunter and Tracy MacDonald represented the Applicants.
Attorney Hunter explained the procedural history of the matter before the Board,
including the history of the permits and the other 40B applications on Nantucket, as well
as this particular group’s efforts to have the fee waived by the Selectmen earlier this year.
Ed Toole questioned if the Applicants were attempting to distinguish themselves from
everyone else who lives on Nantucket year-round by requesting this waiver.
Peter Brace of the Nantucket Independent asked if the Board felt a responsibility to
enforce the past decisions, even if none of the present Board members were sitting on that
particular application.
Sarah Brooks of Abrem Quary expressed her support for the application.
The Board members directed Staff to compile additional information and check to ensure
that the ZBA is the proper waiver granting authority for this matter.
A motion was made (Waine) and duly seconded to continue the matter to July 8th, 2010.
VII. Other Business
Approval of CLURPA
A motion was made (Toole) and duly seconded to endorse the proposed legislation. The vote was
8-0.
VIII. Adjournment
A motion was made (Toole) and duly seconded to adjourn the hearing at 3:45. The vote was 5-0
in favor.
