I. Call to Order:
Chairman O’Mara called the meeting to order at 1:10 PM.
II. Approval of the Agenda:
A motion was made (Toole) and duly seconded to approve the agenda as written. The vote was 5-
0 in favor.
III. Approval of the Minutes:
A motion was made (Toole) and duly seconded to approve the minutes of the June 10, 2010 ZBA
meeting. The vote was 5-0 in favor.
IV. Other Business
Extension Request for 48 South Cambridge Street, McAlinden – File No. 032-09
Marianne Hanley represented the Applicant.
Attorney Hanley explained that the Applicants are requesting a six month extension for the
Variance.
A motion was made (Toole) and duly seconded to approve the requested extension. The vote was
5-0 in favor.

VI. New Business
032-10 Barrett 21 Somerset Road Cohen
Action Deadline August 11, 2010.
Steven Cohen represented the Applicants.
Attorney Cohen explained the history of the Application and how the proposed conditions
are a compromise between the Applicants and the abutters.
Attorney Sarah Alger spoke to this matter representing some of the abutters in opposition
to the application.
There were concerns expressed by Board members regarding the proposed paving of the
road, the timeliness of the documents, a dust mitigation plan, and the hours of operation
for the business. There were also concerns regarding the other proposed conditions
presented by the Applicants.
Trevor Barrett spoke to the car crushing on site.
John Stanton, an abutter, spoke to the issues regarding the increase in growth.
Marianne Stanton, an abutter, spoke to the noise of the 18-wheelers.
It was suggested that the Applicant continue to revise the proposed conditions and submit
them to the Board for the next hearing. A motion was made (Toole) to continue the
Application to the August 12th hearing and duly seconded. The vote was 5-0 in favor.

VII. Election of Officers:
Lisa Botticelli nominated Edward Toole as Chairman. The vote was 3 in favor, 2 opposed.
Edward Toole nominated Dale Waine as Vice-Chairman. The vote was 5 in favor, none opposed.
Kerim Koseatac nominated Lisa Botticelli as Clerk. The vote was 5 in favor, none opposed.
VIII. New Business Continued:

Attorney Arthur Reade represented the Applicants
Attorney Reade stated that the there would be a minor change in the ground cover due to
the renovations proposed. Attorney Reade also explained that the locus had become
nonconforming as to ground cover due to coastal erosion.

A motion was made (Waine) and duly seconded to approve the requested relief. The vote
was 4-0 in favor with O’Mara abstaining.

Don Bracken represented the Applicant.
Mr. Bracken stated that the Applicant was requesting to construct a structure to be used
for storage and warehousing. Accordingly, the structure would need to be constructed so
that it did not trigger the Major Commercial Development regulations in the Bylaw.
A motion was made (Angelastro) and duly seconded to approve the requested relief. The
vote was 5-0 in favor.

Attorney Kevin Dale represented the Applicant.
Attorney Dale explained the scope of renovation proposed to be done to the main
structure and the bunkhouse. Attorney Dale also noted the numerical error on the
submitted site plan.
A motion was made (Angelastro) and duly seconded to approve the relief requested. The
vote was 4-1 in favor (Koseatac opposed).

Attorney Jeff Stetina represented the Applicant.
Attorney Stetina explained the proposed renovations and how they would not be
substantially more detrimental to the neighborhood than the existing nonconformities.
A motion was made (Waine) and duly seconded to grant the requested relief. The vote
was 5-0 in favor.

Attorney Bill Hunter and Tracy MacDonald represented the Applicants.
John Brescher relayed his conversations with DHCD regarding the proper venue for a
request such as this. Town Manager Libby Gibson and Town Counsel Paul DeRensis
explained why the matter was currently before the Board of Appeals.
Attorney Hunter submitted the information from the previous decisions the Board was
interested in receiving.
A motion was made (Waine) and duly seconded to continue the matter to August 12, 2010.
The vote was 3-2 in favor (Toole and O’Mara opposed).
