PUBLIC COMMENTS – Any Member of the public may address the board at this time. 1. None II. APPROVAL OF MINUTES September 29, 2011 adopted by unanimous consent. III. VARIANCE REQUEST 7 I Street, Madaket Sitting MacNab, Cooper, Visco Recused None Documentation None Representing Ray - Located leach facility in most advantageous spot on property recommend accept what engineers have provided. Public None Discussion No comments. Action Motion to Approve. (Visco) seconded. Vote Carried Unanimously IV. UPDATE Concerning amendments to mandated sewer connections regulation Nr. 69 Sewer Situation in Madaket – Richard Ray There will be a rollout presentation for the Board of Supervisors. Have $1M to use to help residents repair failing systems. Applications are available. It will be a minimum of 7 to 10 years before any sewer system materializes for Madaket. A decision has to be made first for Monomoy. Roggeveen, Visco and Ray are working together on how to handle those people who have put in new septic systems when the town sewers go through. Visco – Sewer has been in place in Monomoy since 2004. People are still not hooked up. Ray – Letter will be going out soon to Monomoy residents with fee explanation. PUBLIC MEETING DATE Discussion with semi-public pool owners concerning potential mandates concerning lifeguards - November 10, 2011 VII. CONCERNS FROM THE BOARD 40 Macy Lane: Ray – A situation materialized in last 48 hours. After the 40 Macy Lane carbon build-up incident in the spring, the Health Department (HD) inspected property and found a basement apartment had been constructed with four bedrooms, living room, kitchen etc all without permit. HD partially condemned the basement area. When the owner vacated the bedrooms in the basement as well as all furniture, we removed condemnation and a new furnace was installed. Last week, after complaints from neighbors, HD re- inspected the property and found re-occupancy of the four-bedroom apartment. HD is proposing to hold a hearing with the property owner in attendance to issue a permanent condemnation to basement area property until appropriate work with permit is carried out on the basement area. There is a moisture problem, ventilation problems and only two means of egress which do not meet code. Do not know if licensed people did the work; owner pled ignorance. Violation is being pursued by BOH under Human Habitation Code. The hearing is to be held Nov. 3 at 4 p.m. at 4 Fairgrounds Road. Owner is being notified no later than Friday Oct. 14. Cooper – That property is zoned for duplex; however, the owner will need to get a duplex permit. Arthur D. Gasbarro – For your information, the Traffic Safety Workgroup has had issues about parking in that area and the Board of Supervisors has determined there shall be no parking on the west side of the road. In regards to Chapter 391881 any change that increases parking requires permits as if it were a new building. There is a carrying capacity of these lots directly related to occupation and parking. Tick-borne disease Ray – Have not been able to talk to Dr. T. Lepore. MacNab – I knew more people that had these diseases than for which the hospital accounted; thus the actual number of cases are higher than reported. Need to talk to Lepore about a school education program similar to one in place in Barnstable. Another education program is columns in the paper about the diseases and mitigation through landscaping.
