Conference Room 2 Fairgrounds Road Trustees Present: Matthew MacEachern Fernando Esteban, Linda Williams, Rick Atherton, Michael Kopko (arrived at 3:25), and Charles Hughes Trustees Absent: Bob DeCosta, Patty Roggeveen and Whitey Willauer Staff present: Susan B. Witte I. Call to Order The meeting was called to order at 3:20 II. Establish Quorum A quorum was declared by Chairman MacEachern III. Approval of Agenda Ms Williams made the motion to approve the agenda which was duly seconded and carried 5-0 IV. Approval of Minutes Ms Williams made the motion to approve the March 14, 2011 minutes which was duly seconded and carried 5-0 V. Public Comment There was no public comment VI. Action/Discussion 1. Ongoing Business: a. 5 Monohansett-update Staff reported that to date there have been over 55 individual requests through the procurement officer to receive the RFP packet, reminder that the RFP’s will be opened on 6/9/11. A perimeter plan and survey have been completed on the property and concrete boundary markers have been placed by Sullivan and Earle. The survey revealed a driveway encroachment on the southern boundary by an abutter, NHA Properties, INC d/b/a Housing Nantucket. Staff met with abutter, Ms. Anne Kuszpa, Exec. Dir. at Housing Nantucket who indicated her agreement to move the encroachment. Ms Kuszpa stated her organization had no funding for such an expense until after 7/1/11. Verbal agreement between Ms Witte and Ms Kuszpa was made the encroachment would be resolved by 7/1/11 by Housing Nantucket. (Mr. Kopko arrived.) b. 7 Surfside Rd- update Staff reported that landscape maintenance and hydro-seeding was completed at the property. The design contest deadline was 4/29 the Jury members individually reviewed the submissions and recommended to the Trustees that Colin Carr be awarded the 1st prize and that Ben Normand be honored as runner- up. Ms. Williams made the motion which was duly seconded and the vote passed unanimously 6-0. Chairman MacEachern reinforced that he goal of the design competition had been to help the Trustees understand what the potentials are in terms of the size and the scale of the future development of the property. The 1st prize winner and runner up did an outstanding job of demonstrating exactly that, and took the task to a fairly developed level of site analysis. The Chairman asked staff to send a letter to the applicants selected thanking them for their efforts and acknowledging the time, thought, and talents involved in presenting their submissions. 2. New Business: a. Programs in Development for FY 2013 Staff asked the Trustees for input concerning which housing programs they wish to promote both in FY 2012 and when applying for CPC funding in FY 2013. The staff advised that CPC applications will most likely be due in early September. There is no FY 2013 information posted yet on the CPC website. Chairman MacEachern suggested that the Trustees direct staff to concentrate the FY 13 application on 4 general areas for Program Development in the FY 13 CPC application, in addition to the generalized recitation of programs in prior applications (Gap financing, buy-downs, etc.). There was general agreement that currently the areas of specific concentration should be: i. Development of 7 Surfside Road either new construction or small house relocations - in perpetuity ii. House moves in general- in perpetuity iii. Creation of accessory units- 15 year deed restriction iv. Home Owner Renovation (HOR) program- 15 year deed restrictions Staff pointed out that Article 86 of ATM allows for the creation of affordable housing at 42R Sparks Ave a 0.51 Acre parcel zoned R10 at the end of Cow Pond. Ms Witte suggest asking the BOS to begin discussions of deeding the parcel to the AHTF for development of affordable housing, since the lots of Ticcoma Way and the large lease lot site at 2 Fairgrounds remain unavailable for development due to Mesa Mepa permitting issues which continue to be unresolved. Ms Witte told of her conversation with the chief Biologist at Natural Heritage who explained that even if their ongoing public hearing process does result in de-listing the Nantucket shad bush Natural Heritage will still require any active permits ( 2FGR included) to complete promised mitigation. Ms. Witte recommends broaching the subject of alternative locations for immediate projects, such as 42R Sparks Ave with the BOS. Following 2011 ATM decision to allow “in perpetuity” requirements to be discretionary, the program long proposed by Mr. Hughes to expand the eligibility of the residential exemption to non owner occupied home owners who meet the test of renting at an affordable rate to affordably qualified year round tenants is finally within the realm of the AHTF. Mr Kopko directed staff to inquire of legal counsel to determine the process and mechanisms needed make that program a reality. Discussions regarding the payment of RE taxes on both residential exemption properties and non-profits who are exempt from the payment of RE taxes and what additional burdens any re-classifications may unintentionally create as burdens on the Town Assessor’s were postponed until staff gathered more information from the Assessor’s office. VII. Adjournment At 3:55 pm a motion to adjourn was made by Ms Williams, duly seconded and passed unanimously 6-0. The next regularly scheduled meeting will be held on 6/13/11 at 3pm __________________________________________________________________________________ The Mission of the Trust is to provide for the creation and presentation of affordable housing in the Town of Nantucket for the benefit of year-round low and moderate income households who would otherwise have difficulty, financial or otherwise, locating housing on Nantucket. These are posted as Open Meetings held at 3 o’clock pm in the 2 Fairgrounds Road Conference Room on the following dates: January 10, 2011; February 14, 2011; March 14, 2011; May 9, 2011, June 13, 2011; August 8, 2011; September 12, 2011; November 14, 2011; December 12, 2011
