Conference Room 2 Fairgrounds Road Trustees Present: Fernando Esteban, Linda Williams, Rick Atherton, Michael Kopko, and Charles Hughes Trustees Absent: Matthew MacEachern, Brian Chadwick, Patty Roggeveen and Whitey Willauer Staff present: Susan B. Witte I. Call to Order The meeting was called to order at 3:18 pm II. Establish Quorum A quorum was declared by Vice Chairman Esteban III. Approval of Agenda A motion was made by Ms Williams and duly seconded to approve the agenda a vote of 5-0 carried the motion IV. Approval of Minutes Ms Williams made a motion to approve the February 14, 2011 minutes and after being duly seconded the motion carried unanimously V. Public Comment There was no public comment VI. Action/Discussion 1. Old Business: a. 5 Monohansett-update The RFP to dispose of the parcel has been issued by the Town Procurement officer. Legal ads as well as announcements in Central Register have commenced. The due date for responses is 6/9/2011. Staff reported that pursuant to MGL Ch 30B requests for bids were solicited from local licensed contractors to build a viewing stand on the property to show 2nd floor water views and a building permit to construct said stand has been applied for. Staff further reported that once the stand is built the property will appear in the NAREB LINK (a multiple listing service for Nantucket RE licensees) to further make the availability of this parcel for sale known to wider audiences. Ms Witte advised the Trustees that she appropriately filed 2 separate 286A exemptions to the Town clerk detailing hat the bid to construct the viewing stand was won by a party related to a co-worker; and a second stating that Ms Witte while a RE licensee herself will in no way financially benefit from the listing and/or subsequent sale of the 5 Monohansett parcel. Town counsel, Ms Mc Knight approved of the content language of both submissions and suggested a third 268A form be filed explaining that the disposition decision for the parcel is in the hands of the AHTF and not Ms Witte as staff - the necessity of this 3rd filing is due to the fact that Ms Witte’s spouse is a RE licensee and might have the opportunity to produce a proposer to the RFP. This additional filing will make clear that Ms Witte has a non substantial interest in the AHTF and is not part of the disposition decision making process. A motion was made by Mr Kopko and duly seconded with a unanimous vote of 5-0 to have Ms Witte file an additional 268A exemption form as just described prior to 6/9/2011. b. 7 Surfside Rd- update Staff reported that the property is now occupied by a qualified tenant under a term lease of one year. Based on last month’s Trustee request and discussions to have staff devise a Tenant Selection Policy and Procedure- staff presented a draft policy, following discussion, and a minor modification Ms Williams made a motion to adopt the policy as amended – being duly seconded the motion carried unanimously 5-0. See policy attached to these minutes and posted on AHTF website. c. Re-visit the implementation section of the 2009 Housing Production Plan and discuss ideas for updating and revision –the 14 units anticipated by the HNSC development of the corner of Surfside Rd and Miacomet Rd remains delayed indefinitely due to lease terms not yet finalized by the HNSC group. The 60-80 unit development of a mix of both ownership (1/3) and rental (2/3) affordable housing at the 2 FGR site remains on hold. One primary issue needing to be resolved (by others) is the Natural Heritage MESA/MEPA outstanding permit restricting further development on the entire site until plant mitigation of shad bush is undertaken. Staff learned in discussion with a Natural Heritage biologist that there is a distinct possibility that by early calendar 2012 the nantucket shad bush (nsb) maybe de-listed. The mechanism by which de-listing could occur is a lengthy 3 step process involving the US Dept of Fish and Wildlife as well as public hearings and while there is some pressure externally to delist the nsb plant- biologists at Natural Heritage and US Fish and Wildlife cannot predict the outcome at this time. Mr Hughes raised some general questions whether the 2 FGR property was subjected to any environmental review prior to the Town’s purchase in 2003.His question was left unanswered. Staff will follow up d. 2011 ATM articles which impact affordable housing initiatives- discussion – Staff presented the direct benefits for the AHTF’s mission for the passage of Articles 29, 30, 63, and 78 and encouraged the Trustees positive participation in the unlikely event that any of these pro-affordable housing articles are “called” for discussion 2. New Business: a. Vice Chairman Esteban expressed his gratitude to staff for her hard work and dedication over the past year. b. Mr Kopko elaborated to the group his recent first hand experience as a housing seeker and reported a “state of the union” regarding rent pricing and availability. He wanted to reinforce that while 1 year rental opportunities may not be scarce and pricing for unrelated groups willing to form a housing household the lease price divided by number of occupants maybe not exorbitant, the lack of dedicated long term rentals for the affordable community remains an issue. VII. Adjournment At 4:45 pm a motion was made by Ms Williams and duly seconded to adjourn the meeting. The vote carried 5-0. __________________________________________________________________________________ The Mission of the Trust is to provide for the creation and presentation of affordable housing in the Town of Nantucket for the benefit of year-round low and moderate income households who would otherwise have difficulty, financial or otherwise, locating housing on Nantucket.
