Affordable Housing Trust Fund – AHTF
Scheduled Meeting
Monday, October 5, 2009 2 o’clock P.M.
2 Fairgrounds Road, Conference Room

Members Present: Matt MacEachern (arrived 2:20), Fernando Esteban, Allen Reinhard,
Michael Kopko, Rick Atherton, Brian Chadwick, Linda Willaims,

I Call to Order- at 2:06 pm by Vice-Chair Esteban
II Establish Quorum- declared by Vice-Chair Esteban
III Approval of Agenda - The motion was made by Williams and seconded to approve
the agenda as presented
IV Approval of Minutes – The motion was made by Williams and seconded to approve
the AHTF minutes of August 31, 2009 as written
V Public Comment – none
VI Action/Discussion –
A. Continued from 08-31-09 meeting
1. In the event the AHTF requires a legal opinion to who should such services be
billed, Town Administration? –Clarification is pending a decision from Town
Administration
2. Question concerning tax restrictions which might apply to any gifts bequeathed to
the AHTF - A written request was filed on 9/3/09 to Town Administration to request
a legal opinion and the ATHF is still waiting for reply. In the interim the applicable
language from the existing By-Law in Section 5 Powers of the Trustees subsection
9:
The Trust is exempt from M.G.L. Chapter 59 and 62, and from any other
provisions concerning payment of taxes based upon or measured by property or
income imposed by the Commonwealth or any political subdivision thereof.
3. Seeking guidance regarding documenting Treasurer Procedures, including
review and approvals- written requests sent to Finance department on 8/28 and
9/25. A reply was given on 10/1 they are researching the questions and it is not high
on their priority list at this time.
B. Trustee Agreements - Town Counsel has provided a draft of the Trust Agreement
which was circulated to the Trust Members prior to the meeting. Some discussion
ensued and a question – are the Trust Members regarded as special municipal
employees? According to the governing By-laws yes According to Section 5 Powers
of the Trustees para #8:
The Trust is a public employer and the Trustees are public employees for the
purposes of M.G.L. Chapter 258. The Trust shall be deemed a municipal agency
and the Trustees special municipal employees for the purposes of M.G.L. Chapter
268A.
C. Approve meeting Calendar through FY2010 - the following dates have been
agreed upon for the 2010 meetings of the AHTF:
February 8, 2010
March 25, 2010
June 14, 2010
September 13, 2010
November 8, 2010
December 13, 2010
All meetings are scheduled for 3 o’clock pm at 2 Fairgrounds Rd Conference Room
VII Report Items –Williams made a motion, which was seconded, to accept the report of
the Housing Planner as written
VIII Other Business- None
IX Adjournment - Williams made a motion to adjourn, which was seconded, at 2:50 pm
The Mission of the Trust is to provide for the creation and presentation of affordable housing in the Town of
Nantucket for the benefit of year-round low and moderate income households who would otherwise have
difficulty, financial or otherwise, locating housing on Nantucket.
