Mosquito Control Advisory Committee (discussed by BOS 8/3/11)

Charge:
The committee will prepare draft special legislation for the BOS/BOH to review and include on
the 2012 ATM warrant by December 31, 2011. The committee will also develop a draft plan to
control mosquitoes on Nantucket, including equipment, staffing, professional services, supplies,
other necessary components and associated estimated costs for a program to be implemented for
FY 2013, using up to $100,000 (approved at the June 14, 2011 special election). The committee
will determine if future estimated costs exceed that amount and include this information in its
final report. The committee will work to identify mosquito “hot spots” on both public and private
property in sufficient time so that the public property can be treated in time for the 2012 season;
and, to seek the possibility of treating private property with the permission of the owner(s) if
special legislation has not been secured by then. The committee will consider and evaluate
various treatment applications and the criteria under which to apply specific applications.

The Board of Selectmen of the town of Nantucket hereby approves an amendment to the Home
Rule Petition authorizing the Nantucket Islands Land Bank to convey certain land in the town,
House Bill 569, proposed by the General Court.
The amendment strikes out section 2 and inserts in place thereof the following 2 sections:
“SECTION 2. In consideration for and as a condition of the conveyance of the parcel of land
authorized in section 1, the Nantucket Islands Land Bank shall place any proceeds from the sale
of this property into an individual escrow account and said proceeds shall be used for the
exclusive purpose of acquisition of land not previously under conservation ownership, and said
land shall be ecologically significant land and of equal or greater value than the land sold. In the
event that this property is exchanged for other land, said land shall be ecologically significant,
not already under conservation ownership, and shall be of equal or greater value based on the
town of Nantucket assessor’s then current assessed values.
SECTION 3. This act shall take effect upon its passage.”

QUITCLAIM DEED
THE TOWN OF NANTUCKET, a Massachusetts municipal corporation, acting
by and through its Board of Selectmen, having an address of Nantucket Town & County
Building, 16 Broad Street, Nantucket, Massachusetts 02554 (“Grantor”) for consideration
of One Dollar ($1.00) hereby grants with quitclaim covenants, pursuant to the Town
Meeting Vote under Article 25 of the 2009 Special Town Meeting, a certified copy of
which is attached hereto, to the NANTUCKET CONSERVATION FOUNDATION,
INC., a Massachusetts non-profit corporation organized under Chapter 180 of the
Massachusetts General laws with a place of business at 118 Cliff Road, Nantucket,
Massachusetts 02554 (“Grantee”) the following parcels of land to be used for open space
purposes:
Three certain parcels of land in, Nantucket, Massachusetts shown as Road Lot 9,
Road Lot 10 and Road Lot 11 on a plan of land entitled “Subdivision Plan of land in
Nantucket, MA., prepared for: Town of Nantucket, 1” = 200’, May 20, 2011”, (the
“Plan”), prepared by Blackwell & Associates, Inc. and recorded with the Nantucket
County Registry of Deeds as Plan No. 2011-40.
Said Road Lot 9contains 11,943 square feet, more or less; Road Lot 10 contains
2.183 acres, more or less; and Road Lot 11 contains 24,528 square feet, more or less
according to said Plan.
Said Road Lot 10 is conveyed subject to a twenty (20) foot wide easement for the
purpose of access on foot or by vehicle to Lots 4 and 5 as shown on said Plan. The
location of the easement is a strip of land twenty (20) feet wide bounded by the southerly
border of Road Lot 10, the easterly border of Road Lot 7, Road Lot 10, and the westerly
border of Russell’s Way.
For Grantor’s title see Order of Taking adopted August 17, 2011 recorded with
said Deeds in Book 1290, Page 2.
No deed stamps are due on this conveyance pursuant to G.L. c.64D, § 1.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is forthwith to authorize the conveyance
of a certain parcel of land by the county of Nantucket, therefore it is hereby declared to be an emergency law, necessary for
the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as
follows:
SECTION 1. The county of Nantucket may convey a parcel of land containing approximately 18,400 square feet to the town
of Nantucket. The parcel is a portion of Nonantum avenue acquired by the county in an order of taking dated October 30,
1974 for the laying out of Nonantum avenue and recorded at the Nantucket registry of deeds in Book 147, Page 289. It is
shown on a plan entitled “Plan For Discontinuance of a Portion of Nonantum Avenue Prepared for the Town of Nantucket in
Nantucket, MA,” dated July 20, 2009, prepared by Nantucket Surveyors, LLC, and recorded as Plan No. 2009-39. The parcel
is bounded by the easterly sideline of Nonantum avenue; northerly by the southerly lot line of parcel 49 on assessors map
88; the southerly sideline of a portion of former Clifford street and the southerly lot line of parcels 50 and 51 of assessors
map 88; the eastern sideline of former Harriet street, formerly known as Prospect street, and southerly by the northerly lot
line of parcel 47 of assessors map 88; the northern sideline of a portion of Clifford street between former Nonantum avenue
and the Atlantic Ocean and parcel 48 of assessors map 88, owned by the county.
SECTION 2. A majority of the voters at an annual or special town meeting of the town of Nantucket shall approve
acceptance of the transfer authorized in section 1, before the effective date of the conveyance.
SECTION 3. Chapter 30B of the General Laws and any rights of first refusal in the commonwealth under section 14 of
chapter 34 of the General Laws shall not be applicable to the conveyance authorized by this act.

QUITCLAIM DEED

The TOWN OF NANTUCKET, a Massachusetts municipal corporation having a
principal place of business at 16 Broad Street, Nantucket, Nantucket County, Massachusetts
acting by and through its Board of Selectmen (the “Grantor”), in consideration of Five Thousand
and 00/100 Dollars ($5,000.00), receipt of which is hereby acknowledged, pursuant to the
authority of Article 97 voted upon at 2009 Annual Town Meeting held on April 7, 2009, a
certified copy of which is attached hereto, grants to James E. Dawson, Trustee of the Double 07
Nominee Trust under a Declaration of Trust dated June 23, 2011 recorded with Nantucket
County Registry of Deeds in Book 1284, Page 90 of Nutter, McClennan & Fish, LLP 155
Seaport Boulevard, Boston, Massachusetts 02110 (the “Grantee”), with QUITCLAIM
COVENANTS, that certain plot of land shown as Parcel A, Laurel Street, shown on a plan of
land entitled “Plan to Acquire Land for General Municipal Purposes, Laurel Street in Nantucket,
Massachusetts, Prepared for: Town of Nantucket, Scale: 1” = 30’, Date: August 13, 2010,”
prepared by Nantucket Surveyors, LLC recorded with Nantucket County Registry of Deeds as
Plan No. 2010-49. The premises hereby conveyed is a portion of Laurel Street in Nantucket,
Massachusetts, and contains approximately 10,000 square feet of vacant land (the “Parcel”).
The Grantor’s conveyance of this Parcel is based in part on the Grantee’s warranty and
representation to the Grantor that such Parcel shall be used for residential purposes only and
shall, for all intents and purposes, be combined with and considered as one parcel with the
abutting lot shown on Town Assessor’s Map 80 as Parcel 102.1 previously acquired by Grantee
pursuant to Deed recorded with said Deeds in Book 1285, Page 112 (collectively with the
Parcel, the “Combined Premises”), and that no part of such Parcel or the Combined Premises
shall hereafter be used for non-residential purposes nor divided, subdivided or conveyed as a
separate parcel or parcels. Accordingly, the Parcel hereby granted to the Grantee is conveyed
subject to permanent restrictions coupled with a reversionary interest hereby reserved to and held
by the Grantor, forever restricting the Parcel and Combined Premises to residential use,
prohibiting the division or subdivision of any portion of the Combined Premises, and prohibiting
the conveyance or use of any portion of the Combined Premises apart from another portion of the
Combined Premises, and automatically effectuating a reversion of the Parcel to the Grantor, if
within twenty-four (24) months of the date of this Deed, the Parcel has not been merged with the
Grantee’s existing property in accordance with the Town of Nantucket By-Laws and statutes.
These restrictions shall run with the title to the Combined Premises, and no part of the Combined
Premises shall be hereafter used, conveyed, divided or subdivided in a manner inconsistent with
these restrictions unless the Grantor, in addition to any other permission required by law, grants
to the Grantee or to all their successors, heirs and assigns, such Grantor’s prior written release for
such use, conveyance, division or subdivision and recorded with said Deeds.
By accepting and recording this Quitclaim Deed, the Grantee expressly agrees to the
Grantor’s reservation of, and otherwise grants to the Grantor, such restrictions on the use of the
Combined Premises. These restrictions shall be enforceable for a term of 200 years from the date
hereof, and all of the agreements, restrictions, rights and covenants contained herein shall be
deemed to be “other restrictions held by any governmental body,” pursuant to G.L. c. 184, §26,
such that the restrictions contained herein shall be enforceable for the term of 200 years and not
be limited in duration by any contrary rule or operation of law. Nevertheless, if recording of a
notice is ever needed to extend the time period for enforceability of these restrictions, the
Grantee hereby appoints the Grantor as its agent and attorney in fact to execute and record such
notice and further agrees that the Grantee shall execute and record such notice upon request.
The undersigned certifies that there has been full compliance with the provisions of G. L.
c. 44 §63A.

Subject: Comments on Great Point
At our special meeting on September 27, 2011, the Board discussed the Comprehensive
Conservation Plan (CCP) proposed by the Fish and Wildlife Service for the Great Point National
Wildlife Refuge. We voted unanimously to advise you to work to maintain the present
management arrangement (Option A) and to forward the following comments:
1. The Refuge is only a miniscule part of the Great Point/Coatue complex. The whole area is
currently managed in a working, cooperative arrangement by local organizations to protect the
Marine Mammals, Endangered Species, and wildlife in the whole complex, yet still maintains
recreational and fishing access to the Point to the greatest extent possible. We believe that this
arrangement is working well, and worry that the addition of a third, active partner has the
potential to disrupt the current good relationships. Moreover, we would hate to see more
restrictive management practices on a small refuge dictate the practices for the entire
Great/Point/Coatue complex.
2. For the long term it is vital that unrestricted access be maintained to Coskata Pond for
aquaculture and recreational fishing uses. We worry that the long term plans for federal
acquisition of more land (listed in CCP options B and C) could restrict this access.
3. We note that in the memory of one of our members, the ponds on Great Point were open to
Nantucket Sound in the 1980’s and supported a commercially viable Bay Scallop fishery from
time to time. Since the physical structure of the Point changes over time, new ponds could form
in the future which would provide excellent, clean-water, Bay Scallop habitat – which Nantucket
fishermen could make use of. This prospective use should be protected under all three Options in
the CCP.
4. We applaud the CCP’s emphasis on maintain and promote fishing within the Refuge. We
express our concern that access not be diminished in the future. We believe fishing must be
maintained at the present level, not only for Nantucket residents, but also for the many tourists
and visitors who view Nantucket as a fishing destination. We believe that the problem with seals
will diminish with time, and that Grey Seals may even be removed from the “rare” classification
in the near future, leaving Great Point as one of the finer beach fishing areas along the whole east
coast. As one visitor was overheard to say, “The difference between fishing on Great Point and
the Outer Banks is that on Great Point you actually catch fish.”
5. We do not think that further land acquisition should be part of Option B. We see no
demonstrated benefit to the Great Point Refuge for Fish and Wildlife Service to acquire land
elsewhere on Nantucket. Nor do we see a need for them to help manage the Town land on
Muskeget. This seems to have nothing to do with the Great Point Refuge.
