RED RIBBON WEEK PROCLAMATION 2011
WHEREAS alcohol, tobacco and drug abuse in the United States prevents millions of people
from reaching their full potential in school, in the workplace, and in their
communities; and
WHEREAS research indicates that young people who avoid the early use of alcohol, tobacco
and marijuana are five times less likely to engage in violence, risky sexual
behavior, poor academic performance, additional drug use and other harmful
behaviors; and
WHEREAS founded by Congress in 1988 in honor of undercover Drug Enforcement Agent
Enrique “Kiki” Camarena who was kidnapped, tortured and murdered by
members of a drug gang in Mexico on February 7, 1985, National Red Ribbon
week is designed to raise awareness of the dangers of the underage use and
adult abuse of alcohol, tobacco, and other drugs; and
WHEREAS the 2011 annual observance of Red Ribbon Week provides Nantucket residents
the opportunity to demonstrate their commitment to healthy lifestyles and to
celebrate the safe, healthy choices that MOST young people and adults make
every day on Nantucket by wearing and displaying red ribbons and sharing
information; and so
NOW THEREFORE, be it resolved that the Nantucket Board of Selectmen do hereby proclaim
October 24‐30, 2011 as NANTUCKET RED RIBBON WEEK, and encourage
all citizens, businesses and private agencies, media, religious and educational
institutions to support and promote activities that raise awareness and
encourage prevention of underage substance use and adult substance abuse. As
well, we call on all Nantucket residents and visitors to wear a red ribbon, button,
sticker or bracelet throughout the week in recognition of their commitment to a
healthy lifestyle, free of substance abuse, for residents of all ages in our
Nantucket community.

Each October, Nantucket joins the rest of the country
in observing National Drug Prevention Week, better
known as Red Ribbon Week. Activities will be taking
place at island schools and other locations. You are
invited to be a part of the campaign!
Red Ribbon Week Events
Monday, October 24 • “Wear Something Red” Day and “Human Red
Ribbon” Photo at Nantucket Elementary School
Saturday, October 29 • FREE “Red Ribbon Skate Day” at Nantucket Ice
6:30 p.m. - 8 p.m.
Throughout the week, look for special Red Ribbon Week shopping bags at Stop
& Shop, decorated by Nantucket Elementary School art students.

The TOWN OF NANTUCKET, a Massachusetts municipal corporation having a
principal place of business at 16 Broad Street, Nantucket, Nantucket County, Massachusetts
acting by and through its Board of Selectmen (the “Grantor”), in consideration of Two Thousand
Six Hundred and 00/100 Dollars ($2,600.00), receipt of which is hereby acknowledged, pursuant
to the authority of Article 97 voted upon at 2009 Annual Town Meeting held on April 7, 2009, a
certified copy of which is attached hereto, grants to W. Craig Strehlow and Marcia Estee
Strehlow as joint tenants with the right of survivorship, of P.O. Box 9616, Fargo, North Dakota
58106 (the “Grantee”), with QUITCLAIM COVENANTS, that certain plot of land shown as
Parcel B, Laurel Street, shown on a plan of land entitled “Plan to Acquire Land for General
Municipal Purposes, Laurel Street in Nantucket, Massachusetts, Prepared for: Town of
Nantucket, Scale: 1” = 30’, Date: August 13, 2010,” prepared by Nantucket Surveyors, LLC
recorded with Nantucket County Registry of Deeds as Plan No. 2010-49. The premises hereby
conveyed is a portion of Laurel Street in Nantucket, Massachusetts, and contains approximately
4,000 square feet of vacant land (the “Parcel”).
The Grantor’s conveyance of this Parcel is based in part on the Grantee’s warranty and
representation to the Grantor that such Parcel shall be used for residential purposes only and
shall, for all intents and purposes, be combined with and considered as one parcel with the
abutting lot shown on Town Assessor’s Map 80 as Parcel 100 previously acquired by Grantee
pursuant to Deed recorded with said Deeds in Book 6567, Page 15 (collectively with the Parcel,
the “Combined Premises”), and that no part of such Parcel or the Combined Premises shall
hereafter be used for non-residential purposes nor divided, subdivided or conveyed as a separate
parcel or parcels. Accordingly, the Parcel hereby granted to the Grantee is conveyed subject to
permanent restrictions coupled with a reversionary interest hereby reserved to and held by the
Grantor, forever restricting the Parcel and Combined Premises to residential use, prohibiting the
division or subdivision of any portion of the Combined Premises, and prohibiting the conveyance
or use of any portion of the Combined Premises apart from another portion of the Combined
Premises, and automatically effectuating a reversion of the Parcel to the Grantor, if within
twenty-four (24) months of the date of this Deed, the Parcel has not been merged with the
Grantee’s existing property in accordance with the Town of Nantucket By-Laws and statutes.
These restrictions shall run with the title to the Combined Premises, and no part of the Combined
Premises shall be hereafter used, conveyed, divided or subdivided in a manner inconsistent with
these restrictions unless the Grantor, in addition to any other permission required by law, grants
to the Grantee or to all their successors, heirs and assigns, such Grantor’s prior written release for
such use, conveyance, division or subdivision and recorded with said Deeds.
By accepting and recording this Quitclaim Deed, the Grantee expressly agrees to the
Grantor’s reservation of, and otherwise grants to the Grantor, such restrictions on the use of the
Combined Premises. These restrictions shall be enforceable for a term of 200 years from the date
hereof, and all of the agreements, restrictions, rights and covenants contained herein shall be
deemed to be “other restrictions held by any governmental body,” pursuant to G.L. c. 184, §26,
such that the restrictions contained herein shall be enforceable for the term of 200 years and not
be limited in duration by any contrary rule or operation of law. Nevertheless, if recording of a
notice is ever needed to extend the time period for enforceability of these restrictions, the
Grantee hereby appoints the Grantor as its agent and attorney in fact to execute and record such
notice and further agrees that the Grantee shall execute and record such notice upon request.
The undersigned certifies that there has been full compliance with the provisions of G. L.
c. 44 §63A.
No deed stamp taxes are due on this conveyance pursuant to G.L. c. 64D, §1.

The Grantor’s conveyance of the Parcels is based in part on the Grantee’s warranty and

LICENSE AGREEMENT
THIS AGREEMENT is entered into this 26th day of October, 2011, by and between the
Town of Nantucket acting by and through its Board of Selectmen (the “Licensor”) and
D. Eric McKechnie (the “Licensee”), owner of property known as Unit 1, One
Cambridge Condominium, 6 South Water Street, Nantucket, Nantucket County,
Massachusetts (the “Property”),
WHEREAS, the Licensee is renovating and constructing a second and third floor addition
to the existing building (the “Building”) situated on the Property; and
WHEREAS, the existing granite step located in the front of each of the two doorways of
the Building (collectively, the “Steps”) encroaches upon the public sidewalk (“Licensor’s
Property”), as more particularly shown on the plan attached hereto and marked
Exhibit A; and
WHEREAS, the renovations work includes the construction of new cornices at the
second floor level of the Building (collectively, the “Cornices”) and the installation of
gutters at the second floor and third floor levels of the Building (collectively, the
“Gutters”), which cornices and gutters will project up to thirteen inches (13”) from the
façade of the Building over Licensor’s Property, as more particularly shown on the plan
attached hereto and marked Exhibit A; and
WHEREAS, the renovations work includes the construction of new window sills and trim
(collectively, the “Window Treatment”), which window sills and trim will project up to
four inches (4”) from the façade of the Building over Licensor’s Property, as more
particularly shown on the plan attached hereto and marked Exhibit A; and
WHEREAS, the renovations work also includes the construction of a new roof line and
roof eaves on the Cambridge Street side of the Building (collectively, the “Roof
Projections”), which will project up to 12 inches (12”) from the façade of the Building
over Licensor’s Property, as more particularly shown on the plan attached hereto and
marked Exhibit A; and
WHEREAS, the undersigned has asked the Board of Selectmen for permission to allow
the Steps, the Cornices, the Gutters, the Window Treatment and the Roof Projections
(collectively, the “Building Projections”) to encroach upon and over Licensor’s Property,
as more particularly shown on the plan attached hereto and marked Exhibit A; and
WHEREAS, the Licensor has agreed, under certain conditions as more particularly set
forth herein, to allow the encroachment of the Building Projections upon and over
Licensor’s Property.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
made, the parties hereto agree as follows:
1. The Licensor hereby permits the Licensee for an indefinite term the exclusive
right to construct, repair and maintain the Building Projections upon and over
Licensor’s Property in accordance with the plan the Licensee had submitted to
the Building Commissioner of the Town of Nantucket, a copy of which is
attached hereto as Exhibit A.
The Licensee agrees to submit to the Building Commissioner final “As-Built”
plans of the Building and its related improvements. Once approved by the
Building Commissioner, such plans shall be attached hereto as Exhibit A-1
and shall be deemed to have superseded the plans attached hereto as
Exhibit A for purposes of determining the location and extent of the Building
Projections’ encroachment upon and over the Licensor’s Property.
2. The Licensee agrees to indemnify and hold the Licensor harmless from and
against all losses, costs, damages, causes of action, or liabilities whatsoever,
including but not limited to mechanic’s liens and reasonable attorney’s fees, in
connection with the construction, installation, repair and maintenance of the
Building Projections. The Licensee will be solely responsible for any hazards
created through the Licensee’s conduct in connection with this License.
3. This License to encroach upon and over Licensor’s Property as described
herein shall be only for the limited purpose of constructing, installing,
repairing and maintaining the Building Projections in accordance with the
above-referenced plans. This License is terminable at the will of the Licensor
upon sixty (60) written notice to the Licensee. During said sixty (60) day
period, if the Licensor requests, the Licensee, at his sole cost, will remove the
Building Projections, as the case may be, and return Licensor’s Property to
substantially the same condition as the rest of Licensor’s Property which is
located adjacent to the Property.
4. When any of all of the Building Projections are no longer required by the
Licensee, the Licensee, at its sole cost, shall remove such Building
Projections, as appropriate, and Licensor’s Property will be returned to
substantially the same condition as then exists for Licensor’s Property, which
is located adjacent to the Property.
5. This License is personal and exclusive to the Licensee and is not intended to
run with the land. This License may be transferred or assigned only upon the
expressed written consent of the Licensor acting through its Board of
Selectmen.
6. This License represents the complete understanding and entire agreement
between the parties hereto. Any prior agreements or understandings, whether
written or oral, are hereby superseded and of no effect.
7. This License is to be interpreted under and construed in accordance with the
laws of the Commonwealth of Massachusetts. The parties agree that venue for
any dispute arising from this License will be Nantucket District Court.

upon interpretation of April, 2003 aerial photography.

Map Accuracy for 1"=100’ scale maps.
The parcel boundaries are based primarily upon
the Tax Assessor’s data through December, 2005.

Dear Chairman Atherton:
I am asking for the Board’s support of House Bill HB1972 “An Act Regulating Election Primaries.”
Attached is a Resolution currently being adopted by Select Boards and City Councils throughout
the Commonwealth, as well as a list of towns who I know have already voted, or are scheduled to
vote on this resolution. The bill would advance the state primary from September to June. For
reasons we cannot discern, the current Secretary of the Commonwealth has resisted changing the
date in order to comply with suggestions by Federal authorities.
The basic problem with the present Primary setup is that absentee ballots to military personnel and
US citizens who reside overseas are much delayed, and sometimes never received. Additionally, if
we could combine the State Primary with the Presidential Preference Primary, the town could save
at least $5000 every four years.
Eventually, it would be wonderful if we could mandate that the political parties pay for their own
“partisan exercises” but, one monkey at a time, I guess.

RESOLVED
Whereas, according to the Department of Defense Federal Voting Assistance Program (FVAP),
there are 11,691 active military duty Massachusetts residents residing overseas; and
Whereas, for the November 2010 election, Massachusetts requested a waiver from a requirement
of the Military and Overseas Voter Empowerment Act (the MOVE Act) to send absentee ballots
to Americans overseas at least 45 days before an election "due to a late primary"; and
Whereas, a report by the Secretary of the Commonwealth revealed that in the November 2010
election only 400 ballots from Massachusetts active duty military personnel stationed overseas
were counted; and
Whereas, the General Court is considering H1972 "An Act Regulating State Primaries," a bill
that moves the state primary to allow Massachusetts residents residing overseas to vote privately
and securely, and combines the presidential primary with the state primary to save taxpayers at
least $8,000,000.00; and
Whereas, a number of states have moved their primary dates earlier in the year to comply with
the federal MOVE Act and to provide relief to taxpayers by reducing the cost of elections; and
'Whereas, the Massachusetts state primary scheduled for September 18, 2012 stands alone as the
last state primary in the country in 20l2; and
Whereas, in written testimony the FVAP concluded "passing HB1972 will significantly improve
voter success for many military members, overseas voters, and their families"; and
Whereas, HB1972 simplifies the election process, decreases the opportunity for "voter fatigue",
reduces the cost of elections for taxpayers, and establishes fairness among candidates;
Now, Therefore, Be It Resolved by the of the Board of Selectmen of the Town of Nantucket that
the Town of Nantucket supports the adoption of HB1972 "An Act Regulating Election
Primaries" pending before the 187th General Court of the Commonwealth of Massachusetts and
directs the Town Clerk to transmit a copy of this action to the municipality's State
Delegation and to the Joint Committee on Election Laws.

The Federal Voting Assistance Program (FVAP) of the US Department of Defense presents this written
testimony in support of a bill before the Legislature of the Commonwealth of Massachusetts to move its
primary from September to June of federal election years. FVAP was created to assist military and
overseas civilian voters to effectively cast a ballot and to have it counted.
We submit this testimony in an effort to assist our targeted voting population during elections in
Massachusetts -- the 11,691 men and women of the armed services, and their 3,899 spouses and voting
age dependents, as well as those citizens of Massachusetts who are overseas on Election Day, whether
federal workers, Peace Corps Volunteers, business men and women, missionaries or students abroad.
Late last month FVAP sent letters to Speaker DeLeo, Senator Murray, and Secretary of State Galvin in
which FVAP outlined three legislative initiatives that are recommended, but still lacking, in
Massachusetts Code. Adoption of HB 1972 would significantly improve the possibility that
Massachusetts’ military and overseas citizens will be able to successfully mark and return a ballot and
have it counted in the upcoming presidential elections in 2012.
The Problem
As President Truman recognized in 1952, the men and women of the armed forces, “in many cases
risking their lives, deserve above all others to exercise the right to vote.”1 For over half a century, this
still remains a significant problem for this nation. Congress has determined that it is the right of absent
uniformed services voters and overseas voters to vote by absentee ballot in all elections for federal
office. Congress has codified this right through the Uniformed and Overseas Citizens Absentee Voting
Act of 1986 (UOCAVA), as amended in 2009, by the Military and Overseas Voter Empowerment Act

(MOVE Act), and by other federal legislation. As Congress has stated: “All eligible American voters
should have an equal opportunity to cast a vote and have their vote counted.”2
Military and overseas voters still face many challenges almost 60 years after President Truman’s
concern. FVAP’s 2008 Report to Congress indicates the existence of a significant discrepancy in the
number of successfully returned ballots between the stateside non-UOCAVA absentee voting population
(91% return rate) and the UOCAVA absentee voters, of whom only 67% were able to successfully
return their ballots in U.S. elections.
The overwhelming area of failure in the absentee voting process for UOCAVA voters, comprising the
military, their spouses and voting age dependents and overseas citizens, was not registration problems or
absentee ballot application failures, but, primarily, ballot return problems and, secondarily, voted ballots
that were returned by UOCAVA voters, but not counted, usually because they arrived back too late. In
fact, FVAP’s surveys indicate that over 78% of all UOCAVA voting problems fell into these two areas.
FVAP’s goal is that military and overseas voters have the same absentee ballot return and acceptance
rate as the general absentee voter population. Towards that end, States need to address a variety of
problems facing UOCAVA voters, such as:
• Difficulty in registering to vote from outside the State;
• Frequent address changes among military voters;
• Slow mail delivery that causes ballots and ballot applications to arrive late or not at all;
• Difficulty in obtaining information about candidates or issues from outside the State, particularly
when internet access is spotty or non-existent;
• Inability to comply with witness or verification procedures in places where there may not be
other Americans, much less voters from the same State; and
• A voter’s unintentional failure to properly comply with seemingly insignificant requirements to
vote absentee, such as the use of “8 1/2 x 11” size paper, in a location where the available
standard paper size is different.
The challenges to voting presented to military and overseas citizens are myriad. Finding the forms to
register or to apply for an absentee ballot, whether on paper or online, and then returning these forms
can be a challenge. Even more difficult, however, is timely receipt and return of absentee ballots. Many
of the problems faced are often not the fault of the military or overseas voter; these can be, for example,
postal delays when a Peace Corps volunteer uses foreign postal services, or postal delays for military
serving on the front lines or on ships at sea, when the military postal service is also the
transportation/delivery network for food, ammunition, medical supplies and other wartime essentials.
Other minor challenges, but still significant barriers to participation when they arise, include the
inability of the voter to find a proper witness under state law, the inability to properly print forms when
the paper available overseas does not match stateside paper size or layout, difficulty in determining who
is the proper local election official, or who the general election political nominees are when access to the
internet is minimal or non-existent. Different military and overseas voters face unique challenges, and,
therefore, the best solutions are multiple solutions. Providing emailed blank ballots assists some voters;

making blank ballots available for a military or overseas citizen to access online and print out at the
cyber-café, simplifies the voting process for other voters; some voters can use fax, but many cannot.
Most overwhelming are the logistical challenges presented by the transit by mail of paper applications
and ballots. FVAP acknowledges that there are significant logistical challenges for state officials to
send ballots at least 45 days in advance. Yet, for some UOCAVA voters, ballots sent 45 days in
advance by mail may still not give them enough time to vote. In November 2008, MPSA, the military
postal service agency, recommended on its website the allowance of a period of 28 days for a one-way
transit of mail to Iraq and Afghanistan. The average Priority mail delivery times to aircraft carriers
frequently exceed two weeks; and carriers are the first stop in mail distribution to the smaller ships in a
carrier battle group. If a soldier or sailor is at the end of this logistics distribution chain and cannot
open, act upon and return mail during the short time that the mail delivery personnel are in the area, it
can be weeks before this voter is again able to post his/her ballot for return.
FVAP does want to acknowledge the hard work and innovative comprehensive plan for UOCAVA
voters that was implemented in 2010 by Massachusetts’ elections officials. Use of priority mail both to
voters and for voters to return their ballots did assist in allowing more voters than otherwise would have
been able to successfully participate in the 2010 elections. Even though this had some positive impact,
however, due to the challenges outlined above priority mail only improves delivery times by a very
small margin. Despite the hard work and significant resources devoted to this solution, it pales in
comparison to moving the primary date back sufficiently to ensure ballots are mailed at least 45 days in
advance of the general election. Moreover, while Massachusetts requested and was granted a waiver
under the MOVE Act for the 2010 election cycle and met their commitments under their comprehensive
plan, each election cycle requires a new waiver request, and there is no guarantee that future waiver
requests will be granted.
Potential Solution
HB 1972 proposes moving Massachusetts’ September primary back into June. This is in line with the
recently passed federal amendment to UOCAVA in the 2009 MOVE Act. It is also in line with a
number of states that have recently moved their primary elections earlier to more easily comply with the
new federal requirement, and would provide ample time for Massachusetts’ election officials to certify a
ballot and ensure it is mailed at least 45 days prior to Election Day.
Conclusion
Military sacrifice should not include sacrificing the right to vote. Passing HB1972 will significantly
improve voter success for many military members, overseas voters, and their families.
