The meeting took place in the Town and County Building, 16 Broad Street, Nantucket, MA 02554. Members of the Board present were Brian Chadwick, Patricia Roggeveen, Whiting Willauer, Allen Reinhard and Michael Kopko. Chairman Willauer called the meeting to order at 6:00 PM. Approval of Payroll Warrant for Week Ending 16 March 2008. The payroll warrant was approved by unanimous consent of the Board. Approval of Treasury Warrant and Pending Contracts for 19 March 2008. The treasury warrant and pending contracts were approved by unanimous consent of the Board. OFFICIAL BUSINESS Request for Surplus Property Declarations (14A Sparks Avenue, Kent and Berkeley Streets, Cliff Road) Pursuant to Town Meeting Authorizations. Town Administrator C. Elizabeth Gibson explained that a Board vote is needed to complete the process of declaring this property surplus, in order to dispose of it as authorized by Town Meeting. Mr. Chadwick moved to declare the properties surplus; seconded by Mr. Reinhard. So voted unanimously. Request for Approval of Application of Beachside Associates LLC, dba the Summer House Bistro, for a Change of Manager for Seasonal All-Alcohol Restaurant License for Premises Located at 16 Ocean Avenue. Mr. Kopko moved the change of manager for the Summer House from Charles Salliou to Terrence Cullinan; seconded by Mr. Reinhard. So voted unanimously. PUBLIC HEARINGS Public Hearing to Consider Amendment to Shellfish Regulations Regarding Christmas Holiday. Dave Fronzuto, Marine Superintendent, explained that this change would allow Marine Department employees not to have to work on Christmas Day and that the Harbor and Shellfish Advisory Board (“SHAB”) and the Fishermen’s Association support the change. Mr. Reinhard moved to so amend the Shellfish Regulations; seconded by Mr. Chadwick. So voted unanimously. Public Hearing to Consider Application of the Nantucket Boys & Girls Club for a Public Assembly Permit for Fundraiser Dinner and Auction on Saturday, June 7, 2008, from 6 PM to 10 PM at the Nantucket Yacht Club. A representative from the Boys & Girls Club explained the function. Mr. Kopko moved to approve the permit; seconded by Mr. Chadwick. So voted unanimously. Public Hearing to Consider Application of Angel and Marcos Tejada General Partnership, dba El Rincon Salvadoreno, Andrea Calandriello. Manager, for a Local Entertainment License for Premises Located at 17 Old South Road. Ms. Calandriello explained that the license would allow the restaurant to play recorded music and have two television sets for patron viewing. Mr. Kopko moved to approve the entertainment license; seconded by Mr. Chadwick. So voted unanimously. Public Hearing to Consider Application of Andre Associates LLC, dba, The Summer House, Terrence Cullinan, Manager, for a New Live and Non-Live Entertainment License for Premises Located at One Magnolia Avenue. No representative from the Summer House was present. Mr. Kopko asked Police Chief Pittman if the Police Department has recently experienced problems with the Summer House, to which Chief Pittman replied no. Mr. Kopko moved to approve the entertainment license for the Summer House under its current form; seconded by Ms. Roggeveen. So voted unanimously. Public Hearing to Consider Application of Andre Associates LLC, dba, The Summer House, Terrence Cullinan, Manager, for a New Common Victualler License for Premises Located at One Magnolia Avenue. Mr. Kopko moved to approve the license; seconded by Mr. Chadwick. So voted unanimously. Public Hearing to Consider Application of Fish Stix, LLC, dba Fresh, Joshua Harde, Manager, for a Common Victualler License for Premises Located at 3 Salem Street. Mr. Harde asked for a continuance of this hearing until after a scheduled special permit hearing before the Zoning Board of Appeals. Ms. Gibson indicated that the hearing could be continued to May 7th, which was approved by unanimous consent of the Board. Public Hearing to Consider Application of A.C.D.C. Promotions, LLC, dba, Epernay, David V. Cantella, Manager, for New Seasonal Wine & Malt Package Store License for Premises Located at 1 North Beach Street (tabled from 20 February 2008). Counsel representing the applicant provided an overview of the proposed business and explained that a Planning Board special permit for its operation has been granted. Curtis Barnes, Judy Brownell, and Wayne Holmes, Esq., spoke against the application. Amber Cantella discussed the business plan she and her husband have developed for Epernay and presented a number of letters in support of the application. Ms. Roggeveen moved to approve the license; seconded by Mr. Chadwick. Motion carried 4 to 1 with Mr. Kopko in opposition. Public Hearing to Consider Application of Timothy P. Lonergan, dba The Dancing Pickle, Timothy Lonergan, Manager, for New Annual Wine & Malt Package Store License for Premises Located at 128 Old South Road. Timothy Lonergan explained that this license would complement a take-out business. Mr. Reinhard expressed concern that the building where the new business is to be located has not been built. Town Counsel Paul DeRensis advised that if no premises exist then a plan of the premises should be prepared for the Board to inspect. To address the Board’s concern as to approving a license for a building that has yet to be built, Mr. Lonergan agreed to withdraw his application and re-submit the application once the building approaches completion. The meeting was adjourned at 7:35 PM. Approved the 7th day of May 2008.
