HomeMy WebLinkAboutBoard of Selectmen Minutes December 31, 2008_2014020615180830351 BOARD OF SELECTMEN Minutes of the Meeting of 31 December 2008. The meeting took place in the Conference Room, Town and County Building, 16 Broad Street, Nantucket, MA 02554. Members of the Board present were Rick Atherton, Brian Chadwick, Allen Reinhard, and Patricia Roggeveen. Vice-chairman Roggeveen called the meeting to order at 9:00 AM. A discussion ensued about the status of Sherburne Commons. Ryan/Ames Avenue Executive Assistant to the Town Manager Erika Mooney updated the Board on the Ryan lease for land owned by Mr. Ryan in Madaket, to the Town, as authorized at the 8 December 2008 Special Town Meeting, specifically the changes that were made by Town Counsel and accepted by Mr. Ryan’s attorney. She said the quitclaim deed was in order as well as the Memorandum of Agreement, and that the real estate taxes have been paid, and the ANR plan was approved by the Planning Board on 29 December, although the plan has not been recorded yet. Mr. Chadwick asked about Land Bank paperwork; Ms. Mooney said she will be speaking with Town Counsel Lou Ross at the conclusion of this meeting to discuss the closing of the documents and will discuss the Land Bank paperwork with him. Mr. Reinhard moved that the Board of Selectmen accept as a gift the grants of that certain property known as Millie’s Cottage, numbered 345 Madaket Road, located off Ames Avenue and shown as Lot 1A on the plan entitled “Being a Subdivision of Lot 1 as shown on Plan File No. 43-M, Plan of Land in Nantucket Massachusetts,” dated December 15, 2008, and prepared by Nantucket Surveyor’s, LLC for general municipal use and access to Hither Creek and the permanent easements over 343 Madaket Road for septic system and water purposes, all pursuant to the Quitclaim Deed and Grants of Easements with exhibits before the Board of Selectmen; Mr. Atherton seconded. All in favor, so voted. Mr. Reinhard moved that the Town grant to Charles Ryan and Caren Lambert a lease of the above- described property for a term not to exceed twelve years pursuant to the vote on Article 2 of the Special Town Meeting held on December 8, 2008 and a revocable license to use the lawn and driveway appurtenant to such property, all pursuant to the lease and exhibit before the Board of Selectmen; Mr. Chadwick seconded. Mr. Atherton asked the difference between a lease and a license. Assistant Town Manager Malachy Rice called Mr. Ross to clarify the language. Mr. Ross explained that the license is to use the driveway and it is only found in paragraph two of the lease. All in favor, so voted. Mr. Reinhard moved that the Town execute the agreement between the Town and Charles Ryan and Caren Lambert before the Board of Selectmen as settlement of that certain lawsuit on file with the Commonwealth of Massachusetts District of the Land Court as Docket No. 07-MISC-341895; seconded by Mr. Chadwick. All in favor, so voted. DMF letter Mr. Atherton moved to execute a letter to the Division of Marine Fisheries which Vice-chairman Roggeveen will present at a hearing on 6 January 2009 concerning scallop regulations; seconded by Mr. Reinhard. All in favor, so voted. The meeting was unanimously adjourned at 9:45 AM. Approved the 11th day of March, 2009.
