At today’s meeting of the ACNVT, we revisited the matter raised in our
letter to you of 10/3/07 (copy attached) of lots being stripped of native
vegetation in the course of development. Thinking that a draft warrant article
might help in furthering Town action on this recommendation, one is
attached.
We think that all island residents, year-round as well as summer, would
appreciate any further steps the BOS decides to take in this matter, perhaps a
referral to the Planning staff with your endorsement.

ARTICLE XX
(Zoning Change: Intensity Regulations)
To see if the Town will vote to amend Chapter 139 (Zoning) of the Code of the Town of
Nantucket as by taking the following actions (NOTE: new language is shown as
highlighted text, language to be deleted is shown by strikeout; these methods to
denote changes are not meant to become part of the final text):
1. By amending section 16 by adding the following subsection:
Z. Except as may be allowed by special permit, natural vegetation on an undeveloped lot
lying within any required setback shall not be removed in preparation for constructing a
structure or building, or otherwise, except as required to provide legal access. Natural
vegetation within the lot and interior of such setbacks may be removed but only to
provide an unvegetated area not exceeding a total twice the allowable ground cover for
such lot. Natural vegetation, for purposes of this provision, shall be understood as trees,
bushes and vines having a height of two (2) feet or greater. To the extent that natural
vegetation is removed contrary to this provision, it shall promptly be replaced with
comparable native vegetation.
And, further, that non-substantive changes to the numbering of this Bylaw be permitted
in order that it be in compliance with the numbering format of the Code of the Town of
Nantucket.
