Recoder and Isabelle Schiavi (hereinafter referred to as "Recoder and Schiavi") are the owners of 22 Bassett Road ("the Premises") by virtue of Certificate of Title No. 21,554 registered with the Nantucket County Registry District of the Land Court. Applicants are requesting Zoning Administrator relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(1)(b). The Premises is nonconforming with respect to frontage and ground cover. The lot has less than the required 200 feet of frontage required in the Limited Use General — 3 (LUG -3) zoning district, however, is a lot of record and is therefore grandfathered with respect to this nonconformity. The existing structures had an aggregate ground cover of 6,539 square feet (5.13%), which exceeds the maximum ground cover ratio in the LUG -3 zoning district of 3%. However, while the property was initially conforming with respect to ground cover, the Zoning Bylaw was amended as of January 1, 2000 to restrict the ground cover ratio for properties in the LUG -3 zoning district to 3% from 7% and is therefore grandfathered with respect to the ground cover overage. The property conforms to all other respects of the Zoning Bylaw. The Premises has the benefit of a Special Permit from the Zoning Board of Appeals registered in 2004 (File No. 064-02) as Document No. 108500 at the Nantucket Registry District of the Land Court. Said Special Permit allowed for the reallocation of ground cover on the Premises, while still in excess of the 3% allowed under the LUG -3 intensity regulations. Accordingly, the predecessor in title was allowed to demolish a partially constructed pole bard on the Premises and reallocate the ground cover for said pole barn to allow for the enlargement and renovation of an existing single-family dwelling. The Applicants proceeded with said work, however, revised the plans so as to ultimately reduce the size of the addition and renovation to the primary dwelling. While the Board of Appeals allowed a total ground cover ratio of 5.13%, as a result of the renovations, the proposed ground cover of the structures is 5.07%, as shown on the plan entitled "Proposed Site Plan" prepared by Bracken Engineering, dated March 27, 2019 and attached hereto as Exhibit B. Said renovations have been approved by virtue of Historic District Commission Certificate of Appropriateness Nos. 49,093, 49,692, 50,828, and 70,969, as may be amended from time to time. Therefore, because the proposed alteration decreases the nonconforming nature of property by lessening the amount of ground cover from what was approved in Special Permit No. 064-02, but still more than the allowed amount under the LUG -3 intensity regulations, Zoning Administrator relief may be granted to allow the Applicant to alter the structure in accordance with Historic District Commission Certificate of Appropriateness Nos. 49,093, 49,692, 50,828, and 70,969, as may be amended from time to time. The Board• acknowledges, however, that when the pole barn is demolished, the ground cover nonconformity will be temporarily eliminated. Even so, the majority of the Board rejects the practice of leaving "one stick standing" to preserve the nonconformity and relies on its precedent to find that Special Permit relief is appropriate in this case. Moreover, Section 139-33A(9) of the By-law now clarifies this issue and provides that Special Permit relief is appropriate to authorize the construction of a new structure after removal of the pre-existing, nonconforming structure, in certain circumstances. Although Section 139-33A(9) excludes Special Permit relief for "relocation" of pre-existing, excess ground cover, like this case, the Board finds that this Application predates the enactment of Section 139- 33A(9) of the By-law and is not subject to its provisions. The Board finds further that the design for the enlarged primary dwelling on the Property has been approved by the HDC in Certificate of Appropriateness No. 43,684. 6. Based upon the foregoing, the Board finds that the issuance of a Special Permit to demolish the existing pole barn and to enlarge and renovate the existing primary dwelling is warranted in this case and such demolition and renovation would not be substantially more detrimental to the neighborhood than the existing structures on the Property. The Board notes this Application was filed prior to the effective date of Section 139-33A-4(9) of the By-law, an amendment that expressly provides for Special Permit relief to allow the demolition and reconstruction of a pre-existing, nonconforming structure with a ground cover ratio in excess of the permitted ground cover ratio, as long as the new ground cover ratio remains the same and is not relocated or attached to another building. Prior to this amendment, the Board notes further there were different interpretations as to whether a Variance or Special Permit was required for such demolition and relocation of ground cover. Here, the rescission of the LUG -d intensity regulation amendment rendered the Property nonconforming as to the maximum permitted ground cover ratio. In all other respects, the Property conforms to current Nantucket Zoning By-law provisions. Special Permit relief is appropriate in this matter pursuant to the provisions of Section 139-33A(4) of the By-law and the Board finds the pole barn allowed by Building Permit No. 128- 99 is duly issued and active. The Applicant is entitled to the issuance of a new Building Permit for the primary dwelling enlargement and renovation, and this renovation would not be substantially more detrimental to the neighborhood than the existing uses and structures on the Applicant's property and would not create any new nonconformities. 7. Accordingly, by a vote of four in favor (Sevrens, Toole, Wiley and Murphy) and one opposed (Loftin), the Board GRAN'T'S the requested SPECIAL PERMIT relief under Nantucket Zoning By-law Section 139-33A to allow the demolition of the partially constructed pole barn on the Property and reallocation of the ground cover associated with that structure to allow the enlargement and renovation of the existing primary single-family dwelling on the Locus upon the following conditions: a) The renovation and enlargement of the existing primary single- family dwelling shall conform substantially to the design plans approved by the Nantucket Historic District Commission in April 2004, Certificate of Appropriateness No. 43,684, as may be amended from time to time; and b) The structures shall be substantially as shown upon the "Site Plan", done by Applicant's contractor, Twig Perkins Inc., dated 7/24/2000, a reduced copy of which is attached hereto as Exhibit A.
