Upon review of the Application submitted by the Applicant, 28 Lily Street, LLC, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law (the `By-law") §139-33.A(1)(b) that the proposed extension, alteration, and change to the pre-existing, nonconforming structure on a conforming lot will not increase the nonconforming nature of the structure and will not create any new nonconformities. 2. The Applicant proposes to renovate the existing two and one-half story, wood -frame dwelling (the "Dwelling" on the Locus), including adding a dormer, a screened porch, and steps, all in accordance with Certificate of Appropriateness No. 71943 issued by the Nantucket Historic District Commission, as the same may be modified and amended from time to time. 3. The Locus is located in the Residential Old Historic ("ROH") zoning district. The Dwelling is an historic structure, having been constructed circa 1800. The front steps of the Dwelling are located within the historic layout of Lily Street, as is often the case with historic structures in the ROH District and are pre-existing, nonconforming; otherwise, the Locus, as existing and as proposed, is conforming as to use, parking, and all dimensional requirements of the By-law, except height. 4. The Locus is situated within the Town Overlay District ("TOD") pursuant to By-law §139-4.E. Under By-law §139-17, the maximum height permitted within the TOD and the ROH zoning district is thirty (30) feet. The Dwelling has a height for zoning purposes of about 35 feet, 9 inches. As a result, the Dwelling, having been constructed prior to the July 1972 effective date of the By-law, is a validly pre-existing, nonconforming structure as to height. 5. The proposed dormer on the Dwelling will have a height of about 35 feet, 3 inches for zoning purposes and, as such, is an extension of, and an alteration to, the pre-existing, nonconforming Dwelling, but will not increase the nonconforming nature of the structure or create any new nonconformities. 6. Based upon the elevations prepared by Design Associates Inc., revised through April 12, 2019, and the proposed conditions site plan drawn by Blackwell & Associates, Inc., dated April 12, 2019, copies of which are attached hereto as Exhibits A and B, respectively, the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the structure and will not create any new nonconformities and hereby issues the permit as requested.
