Addendum to Special Permit Application for 100 Quidnet Road
The Applicant is applying for relief for an intrusion into the side yard setback,
under section 139-16 Cl, which allows the Board of Appeals to grant a special
permit in the R-20 zone to reduce the ten -foot side yard setback to five feet.
Alternatively, relief is sought under section 139-16 C2, under which the Board of
Appeals is allowed to grant a special permit to validate unintentional setback
intrusions not greater than five feet into a required yard and not closer than four
feet from a lot line.
There is a mathematic discrepancy in the different plans of Land Court Case 8606
which results in the possible need for the requested relief, depending on which way
the differing math is interpreted. The northeast building corner calculates to be
9.0 -feet off the northerly lot line if the 1980 Plan (8606-N) is relied upon. The
corner calculates to be 10.4 -feet off that line if the 1945 Plan (8606-G) is relied
upon.
Granting of the Special Permit would eliminate ambiguity with respect to setback
intrusion with no adverse effect on the surrounding area, in harmony with the
Bylaw. The attached Certificate of Occupancy was issued for the structure based
on the attached 2009 plan which relied on the monument locations and math in the
alternate position (based on 8606-G).

1. At a public hearing of the Nantucket Zoning Board of Appeals (the `Board") held on
Thursday, May 9, 2019, in the Conference Room, at 4 Fairgrounds Road, Nantucket.
Massachusetts, the Board made the following Decision on the application of MARTIN T.
LONG, Trustee of the MARTIN T. LONG REVOCABLE TRUST, and FRANCES E.
LONG, Trustee of the FRANCES E. LONG REVOCABLE TRUST, the owners of
record at the time the application was submitted, and BRADLEY C. MEYER and
ALICIA C. MEYER, Trustees of the BRADLEY C. MEYER REVOCABLE TRUST,
the contract purchaser, ("Applicants") and current owner, c/o Glidden & Glidden PC, 37
Centre Street, P. O. Box 1079, Nantucket, MA 02554, in File No. 08-19.
2. Applicants are requesting Special Permit relief pursuant to Zoning By-law Section 139-
16.C(1) to reduce the ten (10) foot side yard setback to five (5) feet. In the alternative,
applicant requests relief pursuant to Section 139-16.C(2) to validate an unintentional
setback intrusion not greater than five (5) feet into a required yard and not closer than four
(4) feet from a lot line. Varying and discrepant plans show the structure to be either a
compliant 10.4'± from the northerly side yard lot line or as close as nine (9) feet. Locus is
situated at 100 Quidnet Road, shown on Assessor's Map 21 as Parcel 73 and as Lot 40
upon Land Court Plan 8506-C. Evidence of priori owners' title is registered on Certificate
of Title No. 23478 at the Nantucket County District of the Land Court. The site is zoned
Residential Twenty (R-20).
3. Our decision is based upon the application and accompanying materials and
representations and testimony received at our public hearing. There was no Planning
Board recommendation on the basis that no matters of planning concern were presented.
' Per submission of the Application on March 11, 2019, the Locus was owned by Martin T. Long, Trustee, Martin T.
Long Revocable Trust & Frances E. Long, Trustee, Frances E. Long Revocable Trust who conveyed the Locus to
Bradley C. Meyer & Alicia C. Meyer, Trustees, Bradley C. Meyer Revocable Trust by deed registered with the
Nantucket County District of the Land Court on March 29, 2019, at Document 161345.

One abutter submitted a letter of concern in advance of the hearing. No opposition to the
application, written or oral, was presented at the public hearing.
4. Applicant, through its legal counsel, presented testimony at the public hearing. When Mr.
& Mrs. Long built their house circa 2008-2009, their surveyor, Bob Emack, used a circa
1945 Land Court Plan (LCP No. 8606-G) for monuments which led him to site the house
no closer than 10.4' from the northerly side yard lot line, abutting "Beach Road", as
shown upon As -Built Plot Plan dated September 24, 2009 (attached herewith as "Exhibit
A"). In reliance upon this earlier survey, the owner was issued a Certificate of Occupancy
for Building Permit # 125-08 in 2009. Per explanation of Attorney Richard Glidden, Mr.
& Mrs. Long had put their property on the market. The prospective buyer hired Art
Gasparro to do a new survey to confirm that there were no zoning issues. Mr. Gasparro
prepared a plan entitled "Plot Plan to Accompany Application to the ZBA in Nantucket.
MA.", dated March 14, 2019, (attached herewith as "Exhibit B"), using a 1980 Land Court
Plan (LCP No. 8606-N) to establish the monuments upon which his plan is predicated. As
a result, his plan shows the existing house to be as close as nine (9) feet from the northerly
lot line, in the R-20 district where minimum side yard setback is ten (10) feet.
5. Preferred relief is being sought Pursuant to Section 139-16.C(1) which reads:
The Board ofAppeals may grant a special permit to reduce the ten foot side yard setback in
R-5 and the ten foot side and rear yard setback in R-10, SR -10, R-20 and SR -20 to five feet.
6. In response to a concern expressed by an abutter, Attorney Glidden maintains that there is
no intention to build any additions or construct anything in the slightly reduced side yard
set -back. The only purpose is to cure any possible issues with the existing house based on
these conflicting surveys. In connection with this assertion, Attorney Glidden suggested
that the Board grant the relief subject to a condition that no new structures may be placed
or erected within this reduced setback.
7. Based upon the foregoing, the Board made the finding that the requested relief could be
granted. The validation of the existing As -Built dwelling with a de minimis northerly side
yard setback intrusion shall not be substantially more detrimental to the neighborhood and
said structure otherwise conforms to all other applicable dimensional requirements.
8. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested SPECIAL
PERMIT pursuant to Zoning By-law Section 139-16.C(1) to reduce the ten (10) foot side
yard setback to nine (9) feet in order to validate the dwelling as shown on "Exhibit B"
upon the condition that there shall be no further expansion within the setback without
further relief from the Board.
