At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, April 11, 2019, at 1:00 PM, in the First Floor Community Room of the Public Safety Facility at Four Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of KATHY HERDT CHARRON & PAUL R. CHARRON, TRUSTEES, PAUL R. CHARRON 48 WALSH STREET TRUST & KATHY HERDT CHARRON 48 WALSH STREET TRUST under Declarations of Trust both dated November 13, 2012, a Massachusetts limited liability company, owner and applicant, 44 Contentment Island Road, Darien, Connecticut 06820, File No. 07-19: 2. Applicant is requesting relief by Special Permit pursuant to Zoning By-law Section 139-17(c)(7) to remove and/or demolish a pre-existing nonconforming dwelling and construct a new dwelling to be placed on a new foundation in conformance with applicable building codes and Federal Emergency Management Agency ("FEMA") regulations. The proposed height is approximately 28.5 feet above the minimum First Floor Elevation ("FFE") of eight (8) for an average height of 32.3 feet where thirty (30) feet is maximum allowed pursuant to Section 139-17.A. The existing structure is nonconforming as to front and rear yard setbacks. The proposed structure will be sited so as to cure both the front and rear yard setback encroachments. Locus is situated at 48 Walsh Street, is shown on Assessor's Map 29 as Parcel 101 and as Lot 9 upon Land Court Plan 15800-F. Evidence of owners' title is registered on Certificate of Title No. 24495 at the Nantucket County District of the Land Court. The site is zoned Residential One (R-1). 3. Our decision is based upon the application and accompanying materials and representations and testimony received at our public hearing. The Applicant's surveyor spoke in support of the application. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. No opposition to the application, written or oral, was received. 4 4. The Applicant, through its surveyor, explained to the Board that it proposes to remove and/or demolish the existing dwelling and construct a new dwelling upon a foundation which will be in full compliance with FEMA regulations. Nantucket Zoning By-law Section 139-17.A provides for a maximum height of thirty (30) feet for structures located in the R-1 district. In such cases, height is measured from average mean grade. The applicant seeks approval to bring the new building into compliance with applicable building codes and FEMA requirements by establishing a minimum first floor elevation of 8.0 (NGVD 88). Accordingly, pursuant to Section 139-17.C(7), relief is available to allow a height of thirty (30) feet above the minimum height at which the first floor of the structure will conform with all applicable building codes. 5. Existing and Proposed conditions are shown on plan entitled, "Proposed Site Plan in Nantucket, Massachusetts", prepared by Bracken Engineering, Inc. and dated March 7, 2019, a reduced copy of which is attached herewith as "Exhibit A". Applicant proposes to demolish and/or remove the existing 1,485 square foot dwelling unit and construct a new 1,506 sq. ft. dwelling on a FEMA compliant foundation with a FFE at elevation 8.2f. The Locus falls within a special Flood Hazard Zone AE / Elevation 7, as shown on FEMA Flood Insurance Rate Map dated June 9, 2014. 6. The existing structure has an approximate height of twenty-five (25) feet. The resulting structure will be approximately 28.5 feet above the FFE, for a roof peak elevation of 36.5 feet and a proposed height of 32.3 feet where maximum allowed height is thirty (30) feet. The Locus contains 5,132 sq. ft. in R-1 and is pre-existing nonconforming with respect to front and rear yard setbacks. The newly constructed dwelling will be sited in compliance with all setbacks, thus curing the front and rear yard setback intrusions. The ground cover will be increasing from 28.9% to 29.3% where maximum Ground Cover Ratio is 30%. The project benefits from approval by the Historic District Commission ("HDC") by virtue of Certificate of Appropriateness No.s 71763 (Removal / Demolition) and 71873 (New Dwelling). 7. Relief is sought pursuant to Section 139-17.C(7) cited in pertinent part below: C. Exceptions by special permit. The special permit granting authority may grant a special permit to allow the following structures to exceed such height limitations: I ...] The height of a structure which is situated within the "Areas of one -hundred -year Flood" andlor the "Areas of 100 -Year Coastal Flood with Velocity" as established by the Federal Emergency Management Agency ("FEMA') and depicted upon the Flood Insurance Rate Map promulgated by FEMA, as from time to time revised, shall not exceed 30 feet above the minimum height at which the first floor of the structure will conform with all applicable building codes and FEMA requirements, 3 except in the CDT District where a maximum height may be determined by special permit. 8. Based upon the foregoing and the representations and testimony received at the public hearing, the Board finds that granting the relief as requested by Special Permit to allow the removal of the current pre-existing nonconforming dwelling and construction of a new dwelling unit upon the Locus onto a new FEMA compliant foundation, as proposed by the Applicants and shown on "Exhibit A", is in harmony with the general purposes and intent of the By-law and will not be substantially more detrimental to the neighborhood than the existing dwelling. 9. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning By -Law Section 139-17.C(7) to allow the replacement new dwelling to exceed the height limitations in Section 139-17.A subject to the following conditions: a. The alterations upon the Locus shall be performed in substantial conformity with the Site Plan attached herewith as "Exhibit A'; a) The proposed alterations shall be performed in substantial conformity with the plans as approved by the HDC under Certificate of Appropriateness No. 71873, as may be amended from time to time; b) There shall be no exterior construction, with the exception of routine maintenance such as painting and landscaping, permitted between Memorial Day and Labor Day of any given year in connection with the work contemplated in this application.
