(20) days after this day's date. Notice of the action with a copy
of the complaint and certified copy of the Decision must be given
to the Town Clerk so as to be received within such TWENTY (20)

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals ("ZBA"), opened on
Thursday, December 13, 2018, in the conference room at 4 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following decision on the application of the SANKATY
HEAD GOLF CLUB, c/o P.O. Box 293, 100 Sankaty Road, Siasconset, MA 02564, File No.
45-18:
2. Applicant is requesting modification of prior Special Permits (File Nos. 061-89, 062-94.
066-97, 020-03, 087-04, 04-12, 04-16, 14-17) and in the alternative prior Variance relief (File
No. 022-83) to allow for construction of a 142 sq. ft. restroom kiosk on the fairway adjacent to
the caddie camp pursuant to Zoning By-law Sections 139-33 and 139-32. The proposed structure
and use are accessory to the pre-existing nonconforming recreational facility use. The structure
will meet all dimensional requirements of the By-law. The Locus is situated at 100 Sankaty
Road, is shown on Assessor's Map 49 as Parcel 163, and as Lot 1 on Land Court Plan 9548-C.
Evidence of owner's title is registered as Certificate of Title No. 1308 in the Nantucket County
District of the Land Court. The site is zoned Limited Use General 3 (LUG -3).
3. Our decision is based upon the application and accompanying materials, prior special
permits and the prior variance, and representations and testimony received at the public hearing.
There was no Planning Board recommendation on the basis there were no matters of planning
concern. There was no opposition to the application.
4. The Locus has an area of approximately 126+ acres and includes a private golf course
that was constructed in 1921. The Property is improved with a golf club house, a cart barn,
maintenance buildings, garage, three (3) employee dormitories, three (3) single dwelling units,
four (4) duplex employee housing units and seven (7) caddie camp residential buildings. The
multiple dwellings are non -conforming because they exceed the allowable number of dwelling
units in the LUG -3 Zoning District. A maximum of three (3) dwelling units are permitted in the
LUG -3 Zoning District.

5. Applicant seeks a modification of prior Special Permits to construct a 142.5 ± sq. f1.
restroom kiosk on its 13th golf hole fairway next to the Sankaty Head Foundation, Inc. Caddie
Camp as shown on the plan entitled, "Proposed Conditions Plan, Bathroom Kiosk at 12*` -13''
Hole", prepared by Blackwell & Associates, Inc., dated October 22, 2018, and attached herewith
as "Exhibit A". Applicant's counsel represented to the Board that the proposed restroom kiosk
will provide comfort and convenience to the members of the Sankaty Head Golf Club and would
be connected to the existing septic system which services the Caddie Camp. The restroom has
received Nantucket Historic District Commission approval by virtue of Certificate of
Appropriateness No. 71502.
6. Therefore, based upon the foregoing, the Board finds the proposed restroom kiosk is in
harmony with the intent and purpose of the By -Law. Futher, it will provide comfort and
convenience to the members of the Sankaty Head Golf Club and serve the health and safety of
the membership. Moreover, the proposed restroom will not be substantially more detrimental to
the Sankaty Head Golf Club neighborhood than existing conditions but will, in fact, enhance the
neighborhood by providing a safe and sanitary restroom for the membership of the golf club.
7. Accordingly, by a UNANIMOUS vote, the Board GRANTS relief to the Applicant by a
MODIFICATION of prior SPECIAL PERMITS to allow the construction and use of the
proposed restroom pursuant to Zoning By-law Sections 139-33 subject to the following
conditions:
a) The restroom shall be constructed in accordance with the design plans approved by
the Nantucket Historic District Commission Certificate of Appropriateness No.
71502, as the same may be amended from time to time; and
b) The restroom shall be constructed in accordance with the Site Plan attached
herewith as "Exhibit A".
