The Applicants seek a special permit pursuant to Nantucket Zoning By-
law (the "By-law") §§139-30 and 139-33 or, in the alternative, a variance
pursuant to By-law §139-32 to reconfigure three (3) pre-existing,
nonconforming lots by way of lot line adjustments between the three
owners. The reconfigured lots will be approximately as shown on a plan
entitled "Proposed Conditions Plan of Land," drawn by Blackwell &
Associates, Inc., dated December 14, 2018, a copy of which is su.
As so reconfigured, the property at 11 Sandsbury Road, now Lot 707,
proposed as Concept Lot A, becomes less conforming as to area (about
45,220 square feet, down to about 40,144 square feet) and less conforming
as to frontage (about 232.60 feet along Hollister Road, now down to about
174.49 feet along Sandsbury Road)
13 Sandsbury Road, now Lot 717, proposed as Concept Lot B, becomes more
conforming as to area (about 12,396 square feet, up to about 21,537
square feet) and more conforming as to frontage (about 110.87 feet along
Sandsbury Road to about 110.87 feet along Hollister Road and about 163.49
feet along Wanoma Way).
15 Sandsbury Road, now Lots 718 and 719, proposed as Concept Lot C,
becomes less conforming as to area (about 24,546 square feet, down to
about 20,478 square feet) and the same frontage along Sandsbury Road
less frontage along Wanoma Way (about 185.40 feet down to about 142.90).
All lots maintain regularity compliance. As a result of such
reconfiguration, there would be no increase in development potential.
The allowable ground cover would remain the same, and there would be no
increase in the number of potential bedrooms. As lots of record, Concept
Lot A would have maximum allowable ground cover of 2,000 square feet,
and Concept Lot B and Concept Lot C would each be allowed maximum ground
cover of 1,500 square feet. All of the septic systems would be upgraded
to incorporate innovative alternative technology, and there will be no
increase in the possible number of bedrooms.
Submitted with the application, in addition to the Proposed Conditions
Plan, is an Existing Conditions Plan of Land and a Proof Site Plan of
Land, both drawn by Blackwell & Associates, Inc. and dated December 14,
2018. The Proof Site Plan shows how the land could be reconfigured in
a way that all lots would remain the same or become less nonconforming.
Evidence of owners' title is registered with Nantucket Registry District
as Certificates of Title Nos. 18503, 23750, and 24616. The Locus is
located at 11, 13, and 15 Sandsbury Road, are shown on Nantucket Tax
Assessor's Map 92.4 as Parcels 272, 284, and 285, and are located in
Limited Use General 3 ("LUG -3") Zoning District.
