AIRPORT COMMISSION MEETING
October 9, 2018
The meeting was called to order at 5:00 pm by Chairman Daniel Drake with the following
Commissioners present: Arthur Gasbarro, Tony Bouscaren, and Jeanette Topham.
Commissioner Andrea Planzer was absent.
The meeting took place in the 1" floor Community room at the Public Safety Facility, 4 Fairgrounds
Rd. Nantucket MA.
Airport employees present were: Thomas Rafter, Airport Manager, Noah Karberg, Assistant
Airport Manager, David Sylvia, Safety & Compliance Officer, Janine Torres, Office Manager and
Katy Perales, Administrative Assistant.
Mr. Drake announced the meeting was being audio and video recorded.
Mr. Drake asked for comments on the Agenda; hearing none, the Agenda was adopted.
Mr. Bouscaren made a Motion to approve the draft minutes dated 9/11/18. Second by Ms. Topham
and Passed unanimously.
Ms. Topham made a Motion to ratify the 9/26/18 and approve the 10/10/18 Warrants. Second by
Mr. Bouscaren and Passed unanimously.
100918-1 Notice of Lease- Airport Gas Station Inc
Mr. Gasbarro recused himself from this topic and left the table.
Mr. Bouscaren made a Motion to approve the Notice of Lease for the Airport Gas Station Inc.
Second by Ms. Topham and Passed unanimously. Commissioners Bouscaren, Drake and Topham
voted in favor. There were none opposed.
Mr. Gasbarro returned to the table.
Public Comment
None
Pending Leases/Contracts — Mr. Rafter presented for approval the following lease agreement and
contracts:
• Nantucket Electric Company — 5 -year lease agreement for Bunker Road parcel in the
amount of $28,600 annually, plus a $1500 Annual Business Fee.
• McFarland Johnson Inc.- Task Order #10 for Passenger Facility Charge (PFC)
Administrative Services and to develop PFC Application #2 in the amount of $37,622.
Contract expires 6/30/2020. This is an operating expense.
• The Egan Group- Contract to provide leadership development consulting, and workshop
facilitation for Management Staff in the amount of $10,000. Several sessions will be
offered through 12/31/19. This is an operating expense.
Mr. Bouscaren made a Motion to approve the contracts as presented, Second by Mr. Gasbarro and
Passed unanimously.
Pending Matters — Mr. Rafter reported on:
011315-2 General Fund Repayment Proposal and Discussion of In -Kind Service- the Finance
Department continues to prepare the appeal of the FAA's decision to disqualify some of the items
as ineligible. The Commission concurred with Mr. Rafter's suggestion that he send a letter to the
Town Finance Director, copying the Select Board and the Town Manager, to encourage swift
resolution of the matter.
+ 050916-1 Crew Quarters Development- Airport Administration has asked the
consultant, TJ Waterson, to provide a conceptual floor plan layout and cost estimates for
two buildings with a total of two 2 -bedroom and two/3-bedroom units.
+ 081418-6 N119RW Violation Appeal- Mr. Walter Gezari the pilot of helicopter, N119RW
was banned from operating at ACK by Airport Administration for serious violations on
7/16/18. Pilot has contacted Airport Administration and has asked to present to the
Commission after the holidays in 2019. This item will be removed from future agendas
and will be placed back on an agenda when Mr. Gezari contacts Airport Administration
regarding attending a Commission meeting.
091217-2 Hangar and Tie -Down Rental Policy
Mr. Rafter reviewed the following:
• Hangar and Tie -Down Rental Policy- Draft policy that covers Common Hangar, T -Hangar.
and Tie -Down rentals.
• Draft General (Common) Hangar Lease Agreement- month to month lease agreement for
Common Hangar space rental.
• Draft Secondary Hangar Lease Agreement- Short term licensing agreement for Common
Hangar rental.
• Draft T -Hangar Lease Agreement- Lease agreement for individual T -Hangar tenants
• 091118-1 Rates & Charges - Proposed T -Hangar Rent listed at $450 a month. There will
also be a change made to the Common Hangar Fees in the proposed Rates & Charges. A
Public Hearing will be scheduled for the 11/13/18 Commission meeting to formalize the
change.
Right of first refusal was discussed for T -hangar tenants and subtenants.
Mr. Bouscaren made a Motion to approve that any T -hangar sub lessees with a signed lease dated
prior to June 30, 2018 will be given right of first refusal when the Airport assumes control of the
T -hangar, Second by Ms. Topham and Passed unanimously.

Airport Counsel was also consulted on the possibility of giving preference to year-round residents
above others. It was determined by Counsel that this would be in violation of our grant assurances.
Mr. Drabkin asked a question regarding the draft T -hangar lease. Mr. Rafter shared that each
individual overhead door will be the responsibility of the tenant for contracting and payment of
repairs. This will be clarified in the document.
Mr. Karberg, Assistant Airport Manager, gave a presentation that explained the rational for the
proposed lease rate for a T -hangar. This rational was based off of the Fair Market Value (FMV)
assessment that was done for non -aeronautical land at the Airport. It also factored in the
information on the cost centers for the Airport and information supplied to Airport
Administration by the current lease holder of the T -hangar.
T -hangar tenants Mr. Ray Kairawicz and Mr. John Schwanbeck shared with the Commission that
_the current monthly fee that they are paying for a T -hangar is lower than what was presented at
the meeting. They also shared that they paid an upfront cost ranging from $35,000 to $60,000 at
the start of their individual leases.
In response to a question from Mr. Frank Hanlon, Mr. Rafter reported there are currently twelve
people on the hangar wait list.
MassDOT Grant Award/Grant Assurances- Mr. Rafter presented:
+ 100918-2 AIP 68 - Install Emergency Backup Generator in the amount of $21,250
+ 100918-3 AIP 69 - Environmental Study (EA/EIR) in the amount of $26,415
Ms. Topham made a Motion to approve the Grant Award and Grant Assurances as presented,
Second by Mr. Bouscaren and Passed unanimously.
100918-4 Declaration of Surplus Property - 143 Old South Road- Mr. Rafter presented:
Declaration of Surplus Property for current United Parcel Services (UPS) leased lot location. The
land was appraised at $1.47 per square foot.
Mr. Bouscaren made a Motion to approve the Declaration of Surplus Property for 143 Old South
Road, Second by Ms. Topham and Passed unanimously.
Manager's Report — Mr. Rafter reported:
Project Updates
+ North Ramp- The pavement has been rutting in 4 areas on the North Ramp all where
pavement was replaced in the last 18 months. Airport Administration has begun working
with Jacobs and FAA to determine next step towards a resolution to the problem.
+ ALP Update (Geometry Analysis) — Consultant is looking at the recommendation by the
FAA to determine feasibility of the changes that are being proposed.
+ Taxiway E- Warrant article included in the Special Town Meeting being held on October
10, 2018 to request the authorization for project funding appropriation.
+ Security Upgrades- Scope is complete. Administration is reviewing the design fee
estimate, engaged a firm for the Independent Fee Estimate, and advertised for an Owners
Project Manager for the project. Warrant article included in the Special Town meeting
being held on October 10, 2018 to request the authorization for project funding
appropriation.
+ EA/EIS- A project kickoff meeting with McFarland Johnson and the FAA is being
scheduled.

RFP/IFB Bid Status — Mr. Rafter reported the procurements being worked on include:
+ Sun Island RFP - one proposal was received for 0.5 acres of land. The proposal was
deemed unresponsive and was rejected. The RFP will be re -advertised at a future date.
+ Owners Project Manager (OPM) for the Security Upgrades project is being advertised.
+ ARFF Door Repair IFB- requests for bids were advertised twice with no bids received
either time.
+ 143 Old South Road Lot- Land Lease RFP is being developed.
Operations — Mr. Rafter reported:
+ Draft budgets are due to the Town November 13, 2018. Final budgets will be submitted in
January/February 2019.
+ Freight services will no longer be provided through the terminal building with the
exception of medical freight for as long as no other freight option is available between
Nantucket and Boston. A change to the Minimum Standards will be presented at the
November meeting to address medical freight.
Statistics — Mr. Rafter reviewed the August 2018 statistics:
+ Operations are down 19.3% from August 2017; and down 19.4% from last FYTD.
+ Enplanements are up 9.32% from August 2017; and up 8.05% from last FYTD.
+ Jet A Gallons are up 19.51% from August 2017; and up 8.29% from last FYTD.
+ Jet A Gallons are up 28.53% from September 2017.
+ AvGas Gallons are up 12.63% from August 2017; and up 11.20% from last FYTD.
+ AvGas Gallons are up 9.19% from September 2017.
+ Freight is up 1.9% from August 2017.
+ 21 Noise Complaints were filed for August 2018 compared to 50 in August 2017.
Mr. Drake asked for clarification on the two noise complaints listed in the Statistics Report that
stated follow-up was not requested. Mr. Karberg explained that when the online form is filled out
there is a box can be checked for no response necessary. This was checked on both of the noise
complaints in question.
Personnel Report- Mr. Rafter Reported:
+ Janine Torres, Office Manager, will be retiring November 1, 2018. Katy Perales has
accepted the position and a new Administrative Assistant will be hired.
+ A resignation in the Operations Department was accepted recently.
Commissioners Comments
+ 100918-5 Commissioner Airport Email Addresses- Airport email addresses will be
activated for all Commissioners.
+ 100918-6 2019 Commission Meeting Dates- With no objections to the schedule presented
it is adopted by the Commission.
Mr. Gasbarro requests an Environmental Sub -Committee meeting be scheduled to discuss the
El/EIS project at the discretion of Airport Administration at a time near the start of the project.

Having no further business for Open Session, Ms. Topham made a Motion to go into Executive
Session, under G.L. Chapter 30A, Section 21A, not to return to Open Session, to review
Executive Session Minutes as enumerated on the Agenda; Clause 3: To discuss strategy with
respect to pending litigation in respect to Airport Improvement Plan (AIP) projects. The Chair
has determined that an open session may have a detrimental effect on the litigation position of the
Airport Commission; and under Clause 6: To consider the lease value of various leases. The
Chair has determined that an open session may have a detrimental effect on the negotiation
position of the Airport Commission; and under Clause 3: To discuss strategy with respect to
pending litigation in respect to the Airport's Minimum Standards. The Chair has determined that
an open session may have a detrimental effect on the litigation position of the Airport
Commission. Second by Mr. Bouscaren and Passed unanimously, by the following roll -call vote:
