In the Decision, the ZEO states, in relevant part, that: "This is a notice regarding the development of your property at 18 Gladlands Ave. (Map# 80, Parcel# 221), particularly with regards to the cabana. The ground coverage for the cabana is listed on the application form as 78 square feet, which seems to solely consider the interior half -bath and changing room. However, the entire 16x20 -foot footprint, or a total of 320 s.f., will count towards your ground coverage maximum. I note this because, as represented on the submitted site plan, a future proposed garage will have a ground coverage of 672 s.f., which when combined with the dwelling and cabana will put you over your allowed ground coverage." This notification, which the ZEO has confirmed is a decision by the ZEO within the meaning of By-law §139-31A.(2), is in error in that it includes within the calculation of ground cover areas that are exempt from ground cover pursuant to the definition of "ground cover" in Bylaw §139-2, which reads as follows: The horizontal area of a lot covered at grade by structures, together with those portions of any overhangs which contain enclosed interior space; excluding, for instance, tents, retaining walls, substantially below grade finished or unfinished space, decks, unenclosed porches, unenclosed roofed overhangs and connectors, entryway hoods and projections, gazebos, pergolas, play structures, platforms and steps, docks, game playing courts at grade, exterior in -ground residential swimming pools, exterior in -ground or above grade hot tub/spas, chimneys, bulkheads, bay and bow windows, window wells, unenclosed breezeways, air conditioning units, unroofed walled enclosures, exterior showers, fuel tanks, roof eaves, trash bins, and not more than one accessory detached shed, provided that the shed shall not exceed 16 feet in height, that only a slab, pier, or crawl space foundation shall be constructed, and that the ground cover shall not to exceed 200 square feet. [Emphasis supplied.] The cabana in question consists of two 8.5' x 4.5' pods that are connected by an unenclosed roofed connector. As shown on the plans submitted with the building permit application, this connector consists of a roof connecting the two pods. The connector has fully open sides and no floor. A continuation of a bluestone patio at grade runs under the roofed connector. The two pods, which are structures not exempt from ground cover, have total ground cover of about 78 square feet. Under a clear, common sense reading of the definition of ground cover in By-law §139-2, this unenclosed roofed connector is excluded from ground cover. In fact, in addition to being excluded as an unenclosed roofed connector, this connector could also be deemed to be excluded from ground cover as either an unenclosed porch or an unenclosed breezeway. The ZEO has erroneously included the roofed connector as ground cover and is calculating ground cover based upon the entire 16' x20' footprint of the structure and unenclosed roofed connector, increasing the ground cover of the cabana by about 242 square feet to a total of about 320 square feet. This increase in ground cover has been noted on the building permit application for the cabana, and Building Permit No. 1602-18 was issued for a cabana having 320 square feet. There is no support in the By-law for this determination of ground cover. In addition, the total ground cover for the building permit application for the main dwelling and its Building Permit N0. 1603-18 has been altered to reflect this erroneous increase and should be corrected. For these reasons, the Applicant requests that the Zoning Board of Appeals overturn the Decision of the ZEO and, to the extent necessary, Building Permit No. 1602-18 and find that the unenclosed roofed connector is excluded from ground cover under Bylaw §139-2 and that the ground cover of the cabana in question is 78 square feet. The Applicant also requests that Building Permits Nos. 1602- 18 and 1603-18 and their underlying applications be reformed to reflect the accurate ground cover. Evidence of owner's title is recorded with Nantucket Deeds in Book 1645, Page 288.
