The Premises is also shown as Parcel 41 on Nantucket Assessor's Map 83. On June 11, 2018, the Nantucket Planning Board approved a subdivision plan for the reconfiguration of the Premises as shown on a plan entitled "Mothball Way Extension Definitive Subdivision Plan", 273 and 281 Hummock Pond Road, Nantucket, Massachusetts, dated April 16, 2018, revised June 4, 2018, prepared for 281 Hummock Pond Nominee Trust by Site Design Engineering, LLC ("New Subdivision Plan") (Copies of the New Subdivision Plan and Planning Board Subdivision Approval Decision are annexed hereto as Exhibit A) The Premises has an area of 132,217+ square feet and is located in the Village Residential Zoning District ("VR") which requires a minimum lot size of 20,000 square feet. The proposed swimming pool and pool equipment will be located more than twenty (20') feet from side and rear lot lines. At the closest point, the pool equipment will be located approximately 33.4+ feet from the side lot line. Accordingly, the Applicant meets the requirements for a Special Permit to construct and use the swimming pool as set forth in Section 13902A of the By Law and the 281 Hummock Pond Nominee Trust asks the Board of Appeals to issue a Special Permit for the swimming pool. The property is located at 273 and 281 Hummock Pond Road, Nantucket, Massachusetts 02554 (the "Premises'). The premises has a lot area of approximately 248,292 square feet with four (4) existing dwellings. The proposed two (2) buildable lot subdivision will be accessed from Mothball Way via an existing driveway easement that is already in use for the Premises and additional abutting properties to the west The lots will obtain the required frontage through creation of a. small roadway lot at the end of Mothball Way. The Premises is located in the Village Residential zoning district. The proposed subdivision is shown on the plan entitled "Mothball Way Extension Definitive Subdivision Plan, 273 and 281 Hummock Pond Road, Nantucket, MA," dated April 16, 2018 with a revision date of June 4, 2018 prepared for 281 Hummock Pond Road .Nominee Trust by Site Design Engineering, LLC. As shown on the proposed Plan, the subdivision will consist of one 132,217 square foot buildable lot, one 106,261 square foot buildable lot, and one 10,170 square foot roadway lot. Each of the lots will be serviced by underground telephone, electric and cable services. The Nantucket Planning Board at its June 11, 2018 meeting voted 4-0 to close the public hearing and voted 4-0 to APPROVE the Definitive Subdivision Plan (Alt) for property located at 273 and 281 Hummock Pond Road. The application for approval of this definitive subdivision plan was received by the Planning Board on April 18, 2018 and approval of the subdivision was based on the following documents: ■ Application for Approval of a Definitive Subdivision Plan dated April 17, 2018; ■ The proposed subdivision plan entitled "Mothball Way Extension Definitive Subdivision Plan, 273 and 281 Hummock Pond Road, Nantucket, MA," dated April 16, 2018 with a revision date of June 4, 2018 prepared for 281 Hummock Pond Road Nominee Trust by Site Design Engineering, LLC, page 1 of 1; • Letter regarding the proposal submitted by Site Design Engineering, LLC, dated April 17 and June 4, 2018; ■ Letter regarding the proposal submitted by Vaughn, Dale, Hunter and Beaudette dated May 16, 2018; ■ Staff Reports dated May 14, 2018 and May 31, 2018; • Representation and testimony received in connection with the public hearing held May 14 and June 11, 2018; and, • Other assorted documents that are on file with the Planning Board. The Planning Board closed the public hearing on June 11, 2018. Approval of the subdivision is granted conditionally upon the aforementioned documents, compliance with the Planning Board's Rules and Regulations Governing the Subdivision of Land (as amended through December 20, 1999), and on the following additional requirements and agreements: 1. That the final definitive plans shall be presented to the Planning Board within sig (6) months from the date of this decision Qune 11, 2018); 3. That Lot 3 shall be dedicated for roadway purposes and shall be unbuildable; 4. That the lot layout for the interior roadway (Lot 3) shall be held in common ownership with one of the buildable lots, set aside for roadway purposes. The conveyance of the interior roadway (Lot 3) shall not occur until either Lot 1 or Lot 2 is sold Evidence of the conveyance shall be presented to the Planning Staff; 5. That the Planning Board may grant extension of deadlines stated herein without holding a public hearing; and, 6. Each lot shall be prohibited from further subdivision. Minor lot line adjustments which do not result in the creation of any additional buildable lots shall be permitted through the Approval Not Required (ANR) process.
